Lorsqu\u2019un employ\u00e9 r\u00e9alise des heures au-del\u00e0 du plafond l\u00e9gal, le dirigeant est passible de sanctions civile et p\u00e9nale. Mais <span class=\"exergue\">qu\u2019en est-il lorsque l\u2019employ\u00e9 \u00e0 choisi de lui-m\u00eame de r\u00e9aliser ces heures ?<\/span> Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, fait un tour de la question.<\/p>\n<figure id=\"attachment_6507\" aria-describedby=\"caption-attachment-6507\" style=\"width: 188px\" class=\"wp-caption aligncenter\"><img decoding=\"async\" class=\"wp-image-6507 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/sarl-ou-sas-241x300.jpg\" alt=\"heures compl\u00e9mentaires\" width=\"188\" height=\"235\" \/><figcaption id=\"caption-attachment-6507\" class=\"wp-caption-text\">Dirigeants : faut-il laisser les employ\u00e9s de l&rsquo;entreprise faire des heures compl\u00e9mentaires ?<\/figcaption><\/figure>\n<h2>A quoi correspondent les heures compl\u00e9mentaires\u00a0?<\/h2>\n<div class=\"encadre-style\">Attention, Il ne faut pas confondre les heures <strong>compl\u00e9mentaires<\/strong> avec les heures <strong>suppl\u00e9mentaires<\/strong>. Les premi\u00e8res concernent les contrats de travail \u00e0 temps partiel. Les secondes concernent, elles, les contrats de travail \u00e0 temps plein. Or, ni les dirigeants, ni les salari\u00e9s, d\u2019ailleurs, ne comprennent pas toujours tr\u00e8s bien ces deux notions. (Voir notre article <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/heures-supplementaires-heures-complementaires\/\" target=\"_self\" rel=\"noopener\">Heures compl\u00e9mentaires ou suppl\u00e9mentaires ?<\/a>)<\/p>\n<p>Les heures compl\u00e9mentaires sont toutes les heures r\u00e9alis\u00e9es par un employ\u00e9 \u00a0\u00e0 temps partiel en dehors de <a title=\"La modification du contrat de travail\" href=\"https:\/\/valoxy.org\/blog\/la-modification-du-contrat-de-travail\/\" target=\"_blank\" rel=\"noopener noreferrer\">la dur\u00e9e pr\u00e9vue dans son contrat de travail<\/a>. Or, l<span class=\"exergue\">a r\u00e9glementation limite la quantit\u00e9 d\u2019heures compl\u00e9mentaires <strong>\u00e0 10% de la dur\u00e9e de travail inscrite dans le contrat<\/strong>.<\/span> Les conventions collectives peuvent augmenter ce plafond jusqu\u2019\u00e0 un maximum de 1\/3 de cette dur\u00e9e.<\/div>\n<h2>Que risque l\u2019employeur\u00a0?<\/h2>\n<p><img decoding=\"async\" class=\"alignleft wp-image-6459 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/falling-man-276x300.jpg\" alt=\"heures compl\u00e9mentaires\" width=\"160\" height=\"174\" \/><\/p>\n<p>La cours de cassation vient de pr\u00e9ciser qu\u2019en cas de d\u00e9passement du plafond des <strong>heures compl\u00e9mentaires<\/strong>, l\u2019employeur est passible d\u2019une amende maximale de 1\u00a0500 \u20ac par salari\u00e9 concern\u00e9. <strong><span class=\"exergue\">Cette amende est une sanction p\u00e9nale. Elle s&rsquo;applique dans tous les cas, qu&rsquo;il s&rsquo;agisse d&rsquo;heures impos\u00e9es par l\u2019employeur, ou effectu\u00e9es de mani\u00e8re volontaire.<\/span><\/strong><\/p>\n<p>Lorsque le nombre d\u2019heures compl\u00e9mentaires d\u00e9passe le plafond l\u00e9gal, l\u2019employeur peut \u00eatre sanctionn\u00e9 (au civil) \u00e0 devoir verser des dommages et int\u00e9r\u00eats aux salari\u00e9s. Mais il risque aussi une \u00ab\u00a0requalification\u00a0\u00bb du contrat de travail en \u00ab\u00a0temps plein\u00a0\u00bb.<\/p>\n<p>De plus, l\u2019amende p\u00e9nale pour d\u00e9passement du plafond l\u00e9gal d\u2019heures compl\u00e9mentaires peut s&rsquo;alourdir d\u2019une amende de 750 euros par salari\u00e9 pour non majoration de salaire des heures d\u00e9passant le plafond l\u00e9gal !<\/p>\n<h2>Pourquoi cette sanction pour des heures r\u00e9alis\u00e9es volontairement par les employ\u00e9s ?<\/h2>\n<p>En fait, <span class=\"exergue\">la r\u00e9glementation sur le temps partiel ne distingue pas les notions d\u2019heures impos\u00e9es par le dirigeant et d\u2019heures \u00ab\u00a0choisies\u00a0\u00bb ou r\u00e9alis\u00e9es volontairement par l\u2019employ\u00e9.<\/span> Pour cette question, le code du travail \u00a0ne prend donc en consid\u00e9ration que deux notions, les heures contractuelles et les heures compl\u00e9mentaires. <strong><span class=\"exergue\">Toutes les heures effectu\u00e9es au-del\u00e0 de la dur\u00e9e inscrite dans <a title=\"Les documents \u00e0 remettre au salari\u00e9 lorsque son contrat de travail se termine\" href=\"https:\/\/valoxy.org\/blog\/rupture-contrat-travail-documents-a-remettre-au-salarie-04022014avla1\/\" target=\"_blank\" rel=\"noopener noreferrer\">le contrat de travail<\/a> ont donc la qualification d\u2019heures compl\u00e9mentaires.
