C\u2019est pourquoi le sujet est trait\u00e9 avec grand s\u00e9rieux par les tribunaux. \u00bb<\/p>\n<p><div class=\"encadre-style\">Un arr\u00eat en date du 15 d\u00e9cembre 2010 fait mouche et reconsid\u00e8re la promesse d\u2019embauche.<span class=\"exergue\"> Un employeur qui s\u2019\u00e9tait r\u00e9tract\u00e9 suite \u00e0 une promesse d\u2019embauche s\u2019est vu requalifier son acte comme un licenciement sans cause r\u00e9elle et s\u00e9rieuse. Un salari\u00e9 a d\u00fb reverser le co\u00fbt du cabinet de chasseurs de t\u00eates engag\u00e9 par l\u2019employeur pour le recruter. \u00bb<\/p>\n<p>En g\u00e9n\u00e9ral, les dommages et int\u00e9r\u00eats exig\u00e9s au salari\u00e9 qui se r\u00e9tracte \u00e9quivalent \u00e0 un \u00e0 trois mois de salaire, en fonction de la p\u00e9riode d\u2019essai de l\u2019employeur.<\/p>\n<h2>Promesse d\u2019embauche : les conditions de forme<\/h2>\n<p>Si la jurisprudence est de plus en plus ferme, les conditions de forme d\u2019une promesse d\u2019embauche, quant \u00e0 elles, restent souples\u2026 D\u2019o\u00f9 les incompr\u00e9hensions et les probl\u00e8mes qui en d\u00e9coulent !<br \/>\nUne promesse d\u2019embauche peut \u00eatre \u00e9crite. Elle peut r\u00e9sulter d\u2019un mail ou d\u2019un courrier simple. Elle peut m\u00eame \u00eatre orale !<\/p>\n<p>\u00c9videmment, pour \u00e9viter tout d\u00e9sagr\u00e9ment, il est n\u00e9cessaire aujourd\u2019hui de s\u2019adapter \u00e0 la jurisprudence. Un \u00e9crit s\u2019impose ! <span class=\"exergue\">Le minimum est de stipuler la promesse de mani\u00e8re concr\u00e8te, de pr\u00e9ciser la nature du poste, la date de d\u00e9marrage, le lieu de travail et le montant de la r\u00e9mun\u00e9ration. Il est \u00e9galement possible de soumettre la promesse \u00e0 une condition, comme l\u2019obtention d\u2019un dipl\u00f4me sp\u00e9cifique par exemple.<\/p>\n<p><span class=\"exergue\">Si le salari\u00e9 ne d\u00e9couvre pas de \u00ab surprises \u00bb apr\u00e8s avoir accept\u00e9 la promesse, il ne sera pas \u00e0 m\u00eame de se r\u00e9tracter ni de se retourner contre l\u2019employeur.<\/span><\/p>\n<h2>Promesse d\u2019embauche : l\u2019employeur se r\u00e9tracte en toute l\u00e9gitimit\u00e9<\/h2>\n<p>Oui, le tribunal des prud\u2019hommes a pour r\u00e9putation de favoriser le salari\u00e9. <span class=\"exergue\">Dans le cas de la promesse d\u2019embauche, la pr\u00e9f\u00e9rence n\u2019est pas \u00e9vidente.<\/span> Pour exemple, un chauffeur routier arr\u00eat\u00e9 pour alcoolisme \u00e0 permis \u00e0 l\u2019employeur de justifier sa r\u00e9tractation. <span class=\"exergue\">Lors de difficult\u00e9s \u00e9conomiques, d\u00e9cider d\u2019abandonner une promesse d\u2019embauche est l\u00e9gitime, \u00e0 condition de prouver que les probl\u00e8mes n\u2019existaient pas au moment de la signature.<\/span><\/p>\n<div class=\"encadre-style\">En conclusion, gardez \u00e0 l\u2019esprit que la promesse d\u2019embauche vous engage, vous, employeur, \u00e0 recruter le salari\u00e9 \u00e0 la date sp\u00e9cifi\u00e9e.
