﻿{"id":7932,"date":"2014-06-18T17:15:30","date_gmt":"2014-06-18T15:15:30","guid":{"rendered":"https:\/\/valoxy.org\/blog\/?p=7932"},"modified":"2026-01-13T14:07:12","modified_gmt":"2026-01-13T13:07:12","slug":"certificat-de-travail-definition-contenu","status":"publish","type":"post","link":"https:\/\/valoxy.org\/blog\/certificat-de-travail-definition-contenu\/","title":{"rendered":"Le certificat de travail : d\u00e9finition et contenu"},"content":{"rendered":"<p>Les entreprises doivent d\u00e9livrer un certificat de travail \u00e0 chaque employ\u00e9 qui les quitte. <span class=\"exergue\">La r\u00e9glementation impose la pr\u00e9sence d\u2019un certain nombre de mentions obligatoires sur ce document.<\/span> La portabilit\u00e9 obligatoire de la compl\u00e9mentaire sant\u00e9 a ajout\u00e9 certaines mentions obligatoires.<\/p>\n<p>Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France, fait le point sur ce qu\u2019est un certificat de travail et sur ce qu\u2019il doit contenir.<\/p>\n<h2>Le certificat de travail\u00a0: un des documents \u00e0 remettre au salari\u00e9 qui quitte l\u2019entreprise<\/h2>\n<p><span class=\"exergue\">A la fin du contrat de travail d\u2019un salari\u00e9, la loi impose \u00e0 l\u2019entreprise de lui remettre un certain nombre de documents,<\/span> et ce quel que soit la raison pour laquelle il quitte l\u2019entreprise. Les documents \u00e0 remettre sont les suivants\u00a0:<\/p>\n<ul>\n<li>Une attestation P\u00f4le emploi,<\/li>\n<li>Un re\u00e7u pour solde de tout compte,<\/li>\n<li>Un certificat de travail.<\/li>\n<\/ul>\n<h2>Le contenu du certificat de travail<\/h2>\n<h3>Le contenu du certificat de travail avant le 1\/06\/14<\/h3>\n<p>Avant la r\u00e9forme sur la portabilit\u00e9, le certificat de travail devait obligatoirement mentionner les \u00e9l\u00e9ments suivants:<\/p>\n<ul>\n<li>\n<figure id=\"attachment_5219\" aria-describedby=\"caption-attachment-5219\" style=\"width: 215px\" class=\"wp-caption alignright\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-5219 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/07\/arnaque-les-registres-240x300.png\" alt=\"Le contenu du certificat de travail\" width=\"215\" height=\"269\" \/><figcaption id=\"caption-attachment-5219\" class=\"wp-caption-text\">Le contenu du certificat de travail<\/figcaption><\/figure>\n<p><span class=\"exergue\">La date d\u2019entr\u00e9e du salari\u00e9<\/span> dans l\u2019entreprise (cette date comprend les \u00e9ventuelles p\u00e9riodes de stage ainsi que la p\u00e9riode d\u2019essai).<\/li>\n<li><span class=\"exergue\">La date de sortie du salari\u00e9<\/span> (cette date comprend les p\u00e9riodes de pr\u00e9avis, m\u00eame lorsqu\u2019ils n\u2019ont pas \u00e9t\u00e9 effectu\u00e9s).<\/li>\n<li><span class=\"exergue\">La nature et les p\u00e9riodes du ou des emplois occup\u00e9s<\/span> avec la qualification exacte des fonctions r\u00e9ellement remplies par le salari\u00e9. Se contenter de mentionner la cat\u00e9gorie professionnelle est insuffisant, il faut remplir les fonctions par r\u00e9f\u00e9rence au contrat de travail, aux bulletins de paie et aux classifications professionnelles.<\/li>\n<li><span class=\"exergue\">Le solde du nombre d\u2019heures acquises pour le DIF<\/span> (Droit Individuel \u00e0 la Formation) qui n\u2019ont pas \u00e9t\u00e9 utilis\u00e9es. Il faut aussi pr\u00e9ciser la somme correspondant \u00e0 ce solde (nombre d\u2019heure x 9,15 euros).<\/li>\n<li><span class=\"exergue\">Les coordonn\u00e9es de l\u2019organisme collecteur<\/span> des heures de DIF.<\/li>\n<li>Les entreprises soumises aux intemp\u00e9ries peuvent aussi pr\u00e9ciser le nombre de journ\u00e9es qui ont \u00e9t\u00e9 indemnis\u00e9es pour ch\u00f4mage intemp\u00e9rie depuis le 1<sup>er <\/sup>janvier de l\u2019ann\u00e9e en cours.<\/li>\n<\/ul>\n<h3>Les mentions \u00e0 ajouter au certificat de travail depuis le 1\/06\/14<\/h3>\n<p><span class=\"exergue\">Depuis le 1<sup>er<\/sup> juin 2014, la portabilit\u00e9 de la compl\u00e9mentaire sant\u00e9 doit \u00eatre mentionn\u00e9e dans le <strong>certificat de travail<\/strong>.<\/span> La loi sur la s\u00e9curisation pr\u00e9voit qu\u2019en cas de cessation du contrat de travail, les salari\u00e9s couverts par une compl\u00e9mentaire sant\u00e9 et\/ou une pr\u00e9voyance continueront de profiter de cette assurance pendant un maximum de 12 mois. Si la gratuit\u00e9 de la portabilit\u00e9 des frais de sant\u00e9 est entr\u00e9e en vigueur le 1<sup>er<\/sup> juin 2014, il faudra attendre le 1<sup>er<\/sup> juin 2015 pour que la gratuit\u00e9 de la portabilit\u00e9 de la pr\u00e9voyance soit effective.<\/p>\n<div class=\"encadre-style\">Remarque :\u00a0<a href=\"https:\/\/valoxy.org\/blog\/portabilite\/\">La portabilit\u00e9 de la mutuelle et de la pr\u00e9voyance<\/a> n\u2019est possible que lorsque la rupture du contrat de travail n\u2019est pas li\u00e9e \u00e0 une faute lourde du salari\u00e9.
