Les contr\u00f4leurs peuvent s\u2019int\u00e9resser \u00e0 l\u2019ensemble de la paie et de la partie \u00abcotisations sociales \u00bb\u00a0 de l\u2019entreprise. En effet, <span class=\"exergue\">pour \u00eatre exon\u00e9r\u00e9e de cotisations sociales, l\u2019indemnit\u00e9 d\u2019un stagiaire ne doit pas d\u00e9passer le montant de gratification minimal<\/span> qui est de 12,5% du plafond horaire de la S\u00e9curit\u00e9 sociale (soit 2,875 \u20ac\/heure en 2014).<\/p>\n<h2>Les remboursements de frais\u00a0: le caviar des contr\u00f4leurs URSSAF\u00a0!<\/h2>\n<p><strong><span class=\"exergue\"><img decoding=\"async\" class=\" wp-image-6337 alignleft\" style=\"margin-right: 10px;\" title=\"les \u00e9l\u00e9ments du controle urssaf\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/09\/.jpg\" alt=\"remboursement de frais et controle urssaf\" width=\"168\" height=\"112\" \/>L\u2019\u00e9tude stricte et pointilleuse des remboursements de frais est un incontournable du contr\u00f4le URSSAF.<\/span> <\/strong>N\u2019\u00e9tant pas soumis aux charges sociales, les remboursements de frais font l\u2019objet d\u2019une attention toute particuli\u00e8re des contr\u00f4leurs qui pourraient par exemple s\u2019\u00e9tonner de frais de restaurant le dimanche ou de remboursements kilom\u00e9triques importants en p\u00e9riode de vacances.<\/p>\n<p>Sur ce point la r\u00e9glementation est claire :\u00a0<span class=\"exergue\">pour ne pas \u00eatre soumis aux cotisations sociales, chaque remboursement de frais doit faire l\u2019objet d\u2019un justificatif (facture)<\/span>. Les remboursements de frais de restauration devront en outre pr\u00e9ciser l\u2019identit\u00e9 des personnes invit\u00e9es.<\/p>\n<h2>Les avantages en nature : le plat principal du contr\u00f4le URSSAF !<\/h2>\n<p><strong><span class=\"exergue\">L&rsquo;Urssaf consid\u00e8re tout avantage en nature accord\u00e9 aux salari\u00e9s (et aux dirigeants !) comme un \u00e9l\u00e9ment de salaire.<\/span><\/strong> Il doit par cons\u00e9quent se d\u00e9clarer comme tel sur la fiche de paie ou la DSI (D\u00e9claration Sociale des Ind\u00e9pendants pour les TNS). Il doit \u00eatre soumis aux charges sociales en vigueur. En cas de contr\u00f4le URSSAF, les avantages en nature sous-\u00e9valu\u00e9s ou oubli\u00e9s (logement, voiture de fonction, cadeaux et avantages divers,\u2026) \u00a0feront l\u2019objet d\u2019une r\u00e9int\u00e9gration dans les charges sociales ainsi que d\u2019un redressement.<\/p>\n<p><img decoding=\"async\" class=\"size-full wp-image-5721 alignright\" style=\"margin-left: 10px;\" title=\"le contr\u00f4le urssaf\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/07\/cice.png\" alt=\"avantages en nature et controle urssaf\" width=\"246\" height=\"189\" \/>Il ne reste plus que quelques possibilit\u00e9s d\u2019exon\u00e9rations qui sont strictement encadr\u00e9es par la loi. Certains articles \u00e9crits pr\u00e9c\u00e9demment\u00a0 vous expliquent comment tirer profit de ces quelques possibilit\u00e9s d\u2019exon\u00e9ration (<a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/le-titre-restaurant\/\" target=\"_self\" rel=\"noopener\">Le titre-restaurant<\/a>, <a title=\"Ch\u00e8ques cadeaux et bons d\u2019achats : le plafond 2013 \u00e0 ne pas d\u00e9passer\" href=\"https:\/\/valoxy.org\/blog\/les-cheques-cadeaux-et-bons-dachats-2\/\" target=\"_blank\" rel=\"noopener noreferrer\">bons d\u2019achats<\/a>, \u2026).<\/p>\n<p>On pourra noter l\u2019attention particuli\u00e8re \u00e0 porter <a title=\"Ch\u00e8ques cadeaux et bons d\u2019achats : le plafond 2013 \u00e0 ne pas d\u00e9passer\" href=\"https:\/\/valoxy.org\/blog\/les-cheques-cadeaux-et-bons-dachats-2\/\" target=\"_blank\" rel=\"noopener noreferrer\">lors de l\u2019attribution des bons d\u2019achats<\/a> qui doit \u00eatre identique pour l\u2019ensemble du personnel, sans discrimination. L&rsquo;entreprise conservera une liste d\u2019\u00e9margement comme justificatif.<\/p>\n<h2>Les indemnit\u00e9s kilom\u00e9triques\u00a0: un mets de choix lors d\u2019un contr\u00f4le URSSAF\u00a0!<\/h2>\n<p class=\"p1\"><span class=\"s1\"><a href=\"https:\/\/valoxy.org\/blog\/bareme-kilometrique-2026\/\">Les indemnit\u00e9s kilom\u00e9triques<\/a><\/span><strong><span class=\"exergue\">\u00a0sont certainement l\u2019un des points les plus surveill\u00e9s lors d\u2019un contr\u00f4le URSSAF.<\/span><\/strong> Le respect de la r\u00e9glementation permet de subir un contr\u00f4le qui ne pose pas de probl\u00e8me particulier.<\/p>\n<p>Pensez \u00e0 respecter les bar\u00e8mes \u00e9tablis par l\u2019administration fiscale et \u00e0 devancer les demandes de justificatifs du contr\u00f4leur :<\/p>\n<ul>\n<li>en conservant\u00a0 la copie de la carte grise<\/li>\n<li>en ayant des d\u00e9placements coh\u00e9rents. Pensez aux d\u00e9placements lointains sans justificatifs de p\u00e9age\u2026 (il faut reconna\u00eetre que les d\u00e9partements et\/ou r\u00e9gions qui n\u2019ont pas de p\u00e9age comme le Nord ont un avantage de ce point de vue\u2026).<\/li>\n<\/ul>\n<h2>La loi Fillon : de quoi pimenter votre c<span style=\"line-height: 1.5em;\">ontr\u00f4le URSSAF !<\/span><\/h2>\n<p>La complexit\u00e9\u00a0du mode de calcul des r\u00e9ductions Fillon sur les bas salaires est l\u2019occasion pour les contr\u00f4leurs URRSAF de s\u2019assurer de la qualit\u00e9 du calcul de ces r\u00e9ductions\u00a0qui concernent tous les salaires jusqu\u2019\u00e0 1,6 fois le SMIC.<strong><span class=\"exergue\"> L\u2019\u00e9volution annuelle du mode de calcul et la qualit\u00e9 du suivi des heures en font une niche \u00e0 redressement\u00a0!<\/span><\/strong><\/p>\n<div class=\"encadre-style\">Si la complexit\u00e9 du calcul des r\u00e9ductions Fillon fait de leur v\u00e9rification un incontournable des contr\u00f4les URSSAF, la constatation \u00e9ventuelle d\u2019un trop vers\u00e9 de la part de l\u2019entreprise aboutit souvent \u00e0 un remboursement de l\u2019administration fiscale.<\/div>\n<p>On int\u00e9grera dans cette partie l&rsquo;attention particuli\u00e8re que les contr\u00f4leur portent \u00e0 la v\u00e9rification du bon suivi de la r\u00e9glementation sur les exon\u00e9ration particuli\u00e8res comme pour<strong> <a title=\"Zone franche : quels avantages ?\" href=\"https:\/\/valoxy.org\/blog\/zone-franche-quels-avantages\/\" target=\"_blank\" rel=\"noopener noreferrer\">la ZFU<\/a><\/strong>\u00a0(Zone Franche Urbaine)\u00a0<strong>les JEI<\/strong>\u00a0(Jeunes Entreprises Innovantes), etc.<\/p>\n<h2>Les contrats collectifs\u00a0: la poire pour la soif des contr\u00f4leurs URSSAF<\/h2>\n<p>Les r\u00e8gles de mise en place des contrats collectifs ont beaucoup \u00e9volu\u00e9 ces derni\u00e8res ann\u00e9es. Ils comprennent les contrats de pr\u00e9voyance, sant\u00e9 et\/ou retraite \u00a0(hors convention collective).\u00a0 <strong><span class=\"exergue\">Le formalisme impos\u00e9 par l\u2019administration fiscale en fait un terrain propice aux erreurs. Cela incite les contr\u00f4leurs \u00e0 faire des contrats collectifs une cible prioritaire.<\/span><\/strong><\/p>\n<p><code>Rappel sur la d\u00e9marche \u00e0 suivre lors de la mise en place d\u2019un contrat collectif\u00a0:<br \/>\nLorsqu\u2019un contrat collectif est mis en place, il doit concerner l\u2019ensemble des salari\u00e9s (il est possible d\u2019avoir un contrat pour les cadres et un contrat pour les non cadres). La mise en place doit \u00eatre imp\u00e9rativement formalis\u00e9e par la r\u00e9daction d\u2019une D\u00e9cision Unilat\u00e9rale de l'employeur (DUE), faute de quoi les contrats seront assimil\u00e9s \u00e0 des avantages en nature.<\/code><\/p>\n<h2>Le conseil de l\u2019expert-comptable<\/h2>\n<p>Les entreprises employant des salari\u00e9s ont potentiellement un contr\u00f4le URSSAF tous les 3 ans. C&rsquo;est une fr\u00e9quence que nous n&rsquo;observons cependant pas chez la plupart de nos clients. Le contr\u00f4le dit \u00ab sur pi\u00e8ce \u00bb, qui \u00e9vite au contr\u00f4leur de se d\u00e9placer, tend \u00e0 se g\u00e9n\u00e9raliser.
