Cette obligation est valable quels que soient le statut juridique de l\u2019entreprise, la nature de son activit\u00e9, la nature du contrat de travail ou le motif de la rupture.<\/span><\/p>\n<p>Le respect de la proc\u00e9dure est important car une erreur peut amener l\u2019employeur \u00e0 devoir verser des dommages et int\u00e9r\u00eats. I<\/span>l est obligatoire et doit \u00eatre remis d\u00e8s la fin du contrat de travail. Il pr\u00e9cise plusieurs \u00e9l\u00e9ments :<\/p>\n<ul>\n<li>Les dates de d\u00e9but et de fin du contrat de travail,<\/li>\n<li>Le motif de la rupture du contrat,<\/li>\n<li>Le salaire brut des 12 derniers mois<\/li>\n<li>Le montant des sommes vers\u00e9es dans le cadre de la rupture du contrat de travail.<\/li>\n<\/ul>\n<p>En plus de le fournir au salari\u00e9, l\u2019entreprise doit <span class=\"exergue\">envoyer une copie de l\u2019attestation ch\u00f4mage au centre de traitement P\u00f4le emploi<\/span> et faire parvenir une copie en cas de demande du bureau local de P\u00f4le emploi.<\/p>\n<div class=\"encadre-style\">Remarque<\/p>\n<p>L\u2019employeur qui ne remettrait pas l\u2019attestation d\u2019assurance ch\u00f4mage s\u2019expose \u00e0 des sanctions p\u00e9nales. En cas de retard dans la remise de l\u2019attestation, et \u00e0 fortiori en cas de d\u00e9faut de remise, l\u2019employeur peut avoir \u00e0 payer des dommages et int\u00e9r\u00eats au salari\u00e9.<\/div>\n<h3>Le re\u00e7u pour solde de tout compte<\/h3>\n<p>Le re\u00e7u pour solde de tout compte est un document qui inventorie les sommes vers\u00e9es au titre de la derni\u00e8re fiche de paie et qui cl\u00f4ture d\u00e9finitivement le contrat de travail.<\/p>\n<div class=\"encadre-style\">Remarque\u00a0:<\/p>\n<p>Il a un effet lib\u00e9ratoire \u00e0 condition d\u2019\u00eatre sign\u00e9 par le salari\u00e9 sans r\u00e9serve et s\u2019il ne le conteste pas dans les 6 mois de sa signature.<\/div>\n<h2>Rupture du contrat de travail\u00a0: les documents \u00e0 remettre occasionnellement<\/h2>\n<p><strong><span class=\"exergue\">Lorsque l\u2019entreprise dispose d\u2019une \u00e9pargne salariale<\/span> <\/strong>elle est tenue de fournir au salari\u00e9 un \u00e9tat r\u00e9capitulatif de l\u2019\u00e9pargne salariale dont il dispose.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-6507 alignleft\" style=\"margin-right: 10px;\" title=\"la rupture du contrat de travail\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/sarl-ou-sas.jpg\" alt=\"contrat de travail\" width=\"178\" height=\"222\" \/><\/p>\n<p><strong><span class=\"exergue\">Lorsque le contrat de travail du salari\u00e9 contient une clause de non concurrence,<\/span><\/strong> l\u2019entreprise doit se prononcer sur sa volont\u00e9 de l\u2019actionner ou pas. Lorsqu\u2019elle ne l\u2019actionne pas, elle doit en faire part au salari\u00e9 en respectant le formalisme pr\u00e9vu dans le contrat de travail ou dans la convention collective<\/p>\n<p><strong><span class=\"exergue\">Les entreprises disposant d\u2019une pr\u00e9voyance ou d\u2019une mutuelle<\/span><\/strong> doivent proposer le maintien des garanties comme le pr\u00e9voit la loi. La portabilit\u00e9 de la mutuelle et de la pr\u00e9voyance sont obligatoires, sauf en cas de d\u00e9mission.
