Si <span class=\"exergue\">le g\u00e9rant est la seule personne apte \u00e0 proposer de ne pas \u00eatre r\u00e9mun\u00e9r\u00e9, la d\u00e9cision finale revient \u00e0 l\u2019assembl\u00e9e qui doit n\u00e9cessairement la valider.<\/span><\/p>\n<h2>Absence de r\u00e9mun\u00e9ration et cotisations sociales<\/h2>\n<p><img decoding=\"async\" class=\"wp-image-6464 alignleft\" style=\"margin-right: 10px;\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/x-or-v-signs.jpg\" alt=\"l'abscence de r\u00e9mun\u00e9ration du g\u00e9rant\" width=\"167\" height=\"196\" \/>L\u2019absence de r\u00e9mun\u00e9ration ne signifie pas qu\u2019il n\u2019y aura pas de cotisations sociales. En effet, <span class=\"exergue\">m\u00eame sans r\u00e9mun\u00e9ration, le g\u00e9rant sera soumis \u00e0 une avance minimale sur cotisations qui se monte en 2014 \u00e0 1 677 \u20ac pour les artisans et 1 640 \u20ac pour les commer\u00e7ants.<\/span> Si en fin d\u2019ann\u00e9e civile le g\u00e9rant ne d\u00e9clare aucune r\u00e9mun\u00e9ration dans sa DSI (D\u00e9claration Sociale des Ind\u00e9pendants), il pourra alors se faire rembourser une partie de l\u2019avance vers\u00e9e.<\/p>\n<p>En cas de tr\u00e9sorerie tendue, le g\u00e9rant qui est certain de ne pas se verser de r\u00e9mun\u00e9ration sur l\u2019ensemble de l\u2019ann\u00e9e peut demander une dispense d\u2019une partie des cotisations.<\/p>\n<h2>Le g\u00e9rant minoritaire perd sa couverture sociale lorsqu\u2019il n\u2019a pas de r\u00e9mun\u00e9ration<\/h2>\n<p>Sans les cotisations sociales li\u00e9es \u00e0 sa r\u00e9mun\u00e9ration, le g\u00e9rant minoritaire n\u2019atteint pas les seuils minimum lui permettant de b\u00e9n\u00e9ficier de l\u2019assurance maladie et maternit\u00e9, et de faire valider ses trimestres de retraite. En effet, il est n\u00e9cessaire de justifier d&rsquo;une cotisation minimum pour b\u00e9n\u00e9ficier d\u2019une protection sociale, ainsi que pour faire valider ses trimestres de retraite :<\/p>\n<ul>\n<li>En 2014,\u00a0 l<span class=\"exergue\">a r\u00e9mun\u00e9ration annuelle d\u2019un g\u00e9rant doit \u00eatre d\u2019un moins 15\u00a0019 \u20ac pour pouvoir b\u00e9n\u00e9ficier de l\u2019assurance maladie et maternit\u00e9<\/span>.<\/li>\n<li>Le versement minimum de <span class=\"exergue\">r\u00e9mun\u00e9ration doit \u00eatre de 150 fois le SMIC horaire (soit 1\u00a0429,50 \u20ac en 2014) pour valider un trimestre de retraite<\/span> (assurance vieillesse de base + retraite compl\u00e9mentaire).<\/li>\n<\/ul>\n<p style=\"text-align: center;\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-6457 aligncenter\" title=\"cr\u00e9ation d'entreprise : un g\u00e9rant peut-il ne pas se r\u00e9mun\u00e9rer ?\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/green-red-light-1.jpg\" alt=\"expert-comptable : la r\u00e9mun\u00e9ration du g\u00e9rant minoritaire\" width=\"406\" height=\"223\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/green-red-light-1.jpg 1500w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/green-red-light-1-300x165.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/green-red-light-1-1024x562.jpg 1024w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/green-red-light-1-768x421.jpg 768w\" sizes=\"(max-width: 406px) 100vw, 406px\" \/><\/p>\n<h2>Les conseils \u00e0 suivre lorsqu\u2019un g\u00e9rant pr\u00e9voit de ne pas se payer<\/h2>\n<p>Le premier des conseils est de <span class=\"exergue\">faire un diagnostic sur la raison qui pousse le g\u00e9rant \u00e0 ne pas se r\u00e9mun\u00e9rer.<\/span> Si la situation n\u2019est pas temporaire ou ind\u00e9finie dans le temps, il semble important d\u2019aborder le sujet avec son expert-comptable qui tentera d&rsquo;\u00e9clairer sur les choix possibles et leurs cons\u00e9quences.<\/p>\n<p>Si la situation est temporaire, <span class=\"exergue\">il est pr\u00e9f\u00e9rable de pr\u00e9voir une r\u00e9mun\u00e9ration minimum qui permettra de valider au moins 4 trimestres de retraite.<\/span> En effet, m\u00eame si les temps sont difficiles, il est important de pr\u00e9voir une retraite minimum pour l\u2019avenir en se versant une r\u00e9mun\u00e9ration au moins \u00e9gale \u00e0 600 fois le SMIC horaire soit 5\u00a0718 \u20ac en 2014.
