La cour de cassation a r\u00e9cemment rappel\u00e9 que <span class=\"exergue\">le paiement d\u2019une prime exceptionnelle ne peut se substituer au r\u00e8glement \u00a0des heures suppl\u00e9mentaires m\u00eame lorsque leur montant correspondent.<\/span><\/p>\n<p><img decoding=\"async\" class=\" wp-image-5789 alignleft\" style=\"margin-right: 10px;\" title=\"dirigeants \u00e9viter de payer les heures suppl\u00e9mentaires en prime\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/08\/juridique.png\" alt=\"Ne pas payer les heures suppl\u00e9mentaires en primes exc\u00e9ptionnelle\" width=\"104\" height=\"134\" \/>Une entreprise parisienne en a r\u00e9cemment fait les frais. Elle s&rsquo;est vue condamn\u00e9e \u00e0 verser le montant d\u00fb au titre des heures suppl\u00e9mentaires. (ainsi que des indemnit\u00e9s de dommages et int\u00e9r\u00eats pour non-respect des repos compensateurs).<\/p>\n<p>Par ailleurs,<span class=\"exergue\"> l\u2019entreprise a \u00e9galement \u00e9t\u00e9 redress\u00e9e pour travail dissimul\u00e9 pour avoir omis sciemment\u00a0 de mentionner ces heures sur le bulletin de paie du salari\u00e9.<\/span><\/p>\n<div class=\"encadre-style\">Ce qu\u2019il faut retenir\u00a0:<\/p>\n<p>Les heures suppl\u00e9mentaires et leur majoration doivent appara\u00eetre clairement sur le bulletin de paie. Et doivent \u00eatre pay\u00e9es en tant que telles.<\/div>\n<h2>L\u2019\u00e9valuation du nombre d\u2019heures suppl\u00e9mentaires en cas de litige rel\u00e8ve du juge de fond<\/h2>\n<p>La cour de Cassation a rappel\u00e9 derni\u00e8rement qu&rsquo;en cas de litige sur les heures suppl\u00e9mentaires, <span class=\"exergue\">les juges du fond appr\u00e9cient souverainement l\u2019importance de celles-ci et d\u00e9terminent\u00a0 les arri\u00e9r\u00e9s de salaires qui s\u2019y rattachent.<\/span><\/p>\n<figure id=\"attachment_5395\" aria-describedby=\"caption-attachment-5395\" style=\"width: 278px\" class=\"wp-caption aligncenter\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-5395 \" title=\"heures suppl\u00e9mentaires : comment les \u00e9valuer\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/07\/exercice-comptable.png\" alt=\"l\u2019\u00e9valuation des heures suppl\u00e9mentaires en cas de littige\" width=\"278\" height=\"181\" \/><figcaption id=\"caption-attachment-5395\" class=\"wp-caption-text\">L\u2019\u00e9valuation du nombre d\u2019heures suppl\u00e9mentaires rel\u00e8ve du juge du fond<\/figcaption><\/figure>\n<p>En effet, une fois que le juge du fond a constat\u00e9 l\u2019existence d\u2019heures suppl\u00e9mentaires non r\u00e9mun\u00e9r\u00e9es, il lui appartient d\u2019en \u00e9valuer l\u2019importance\u00a0 \u00ab\u00a0souverainement\u00a0\u00bb et de d\u00e9terminer le montant des rappels de salaires s\u2019y rattachant.<\/p>\n<p>Si le salari\u00e9 parvient \u00e0 fournir\u00a0 des \u00e9l\u00e9ments jug\u00e9s comme suffisamment pr\u00e9cis pour \u00e9valuer les heures suppl\u00e9mentaires, (feuilles de pointage, cahier d\u00e9taill\u00e9 pr\u00e9cisant les heures d\u00e9part et d\u2019arriv\u00e9e, relev\u00e9 informatique, \u2026) <span class=\"exergue\">la cour peut s\u2019en servir pour \u00e9valuer leur volume. (qui servira de base au calcul des rappels de salaires).<\/span><\/p>\n<div class=\"encadre-style\">Ce qu\u2019il faut retenir\u00a0:<\/p>\n<p>Une fois l\u2019existence d\u2019heures suppl\u00e9mentaires non r\u00e9mun\u00e9r\u00e9es \u00e9tablies, le juge du fond a toute libert\u00e9 pour \u00e9valuer le volume \u00e0 d\u00e9dommager\u2026 En cas de litige, c\u2019est un \u00e9l\u00e9ment dont il faut avoir conscience pour mesurer les risques financiers encourus.<\/div>\n<h2>Modulation du temps de travail\u00a0: le seuil de d\u00e9compte des heures suppl\u00e9mentaires est intangible<\/h2>\n<p>En cas de modulation du temps de travail, la dur\u00e9e annuelle de travail est fix\u00e9e \u00e0 1607 heures. (sauf en cas de plafond inf\u00e9rieur fix\u00e9 par la convention collective). La question \u00e9tait de savoir si le seuil de d\u00e9clenchement \u00e9tait relev\u00e9 lorsqu\u2019un salari\u00e9 n\u2019avait pas acquis la totalit\u00e9 de ses droits aux cong\u00e9s. Par exemple doit-on consid\u00e9rer, dans le cas d\u2019un salari\u00e9 r\u00e9cemment arriv\u00e9 dans l\u2019entreprise en modulation qui ne dispose que de 3 semaines de cong\u00e9s sur 5, que la premi\u00e8re heure suppl\u00e9mentaire commence \u00e0 la 1608<sup>\u00e8me<\/sup> heure ou \u00e0 la 1677<sup>\u00e8me<\/sup> (1607 + (2 x 35) ?<\/p>\n<p>La cour de cassation estime que <span class=\"exergue\">le plafond de 1607 heures annuel est intangible et que les heures suppl\u00e9mentaires commencent d\u00e8s la 1608<sup>\u00e8me<\/sup> heure pour tous les salari\u00e9s,<\/span> m\u00eame celui qui n\u2019aurait pas acquis la totalit\u00e9 de ses droits aux cong\u00e9s pay\u00e9s.<\/p>\n<div class=\"encadre-style\">Ce qu\u2019il faut retenir en cas de modulation du temps de travail ? La premi\u00e8re heure suppl\u00e9mentaire commence d\u00e8s que le seuil d\u2019heures suppl\u00e9mentaires est franchi.
