Quelle est sa dur\u00e9e&nbsp;? Quelles sont ses cons\u00e9quences sur le contrat de travail&nbsp;? Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, explique le cong\u00e9 de pr\u00e9sence parentale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u00c0 qui s\u2019adresse le<\/strong><strong> cong\u00e9 de pr\u00e9sence parentale ?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Lorsque l&rsquo;\u00e9tat de sant\u00e9 de son enfant n\u00e9cessite une pr\u00e9sence soutenue et des soins contraignants, un salari\u00e9, <strong>quelle que soit son anciennet\u00e9<\/strong>, peut s\u2019arr\u00eater de travailler pour s\u2019en occuper. L\u2019enfant doit :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>avoir moins de 20 ans,<\/li>\n\n\n\n<li>\u00eatre <strong>\u00e0 la charge <\/strong>effective et permanente du salari\u00e9,<\/li>\n\n\n\n<li>ne pas percevoir un salaire mensuel brut sup\u00e9rieur \u00e0 1\u00a0144,21\u00a0\u20ac,<\/li>\n\n\n\n<li>ne pas b\u00e9n\u00e9ficier \u00e0 titre personnel d&rsquo;une allocation logement ou d&rsquo;une prestation familiale.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019employeur ne peut ni refuser, ni reporter un cong\u00e9 de pr\u00e9sence parentale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>La dur\u00e9e du cong\u00e9 <\/strong><strong>de pr\u00e9sence parentale<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Le cong\u00e9 initial<\/strong>&nbsp;<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Il ne peut d\u00e9passer (dur\u00e9e maximale) 310 jours ouvr\u00e9s par enfant et par maladie, accident ou handicap. La dur\u00e9e du cong\u00e9 doit correspondre \u00e0 la dur\u00e9e du traitement de l\u2019enfant. Cette \u201cr\u00e9serve\u201d de jours peut s\u2019utiliser en fonction des besoins, dans la limite maximale de 3 ans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le cong\u00e9 peut se prendre en une ou plusieurs fois. Il peut se transformer, avec l&rsquo;accord de l\u2019employeur, en activit\u00e9 \u00e0 temps partiel, ou se fractionner par demi-journ\u00e9es.\u00a0<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Le renouvellement du cong\u00e9<\/strong>&nbsp;<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Il peut s&rsquo;accorder, \u00e0 l\u2019issue de\u00a0la p\u00e9riode initiale de 3 ans, ou dans le cas o\u00f9 la \u201cr\u00e9serve\u201d de 310 jours a \u00e9t\u00e9 utilis\u00e9e avant la fin des 3 ans du cong\u00e9 initial :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>en cas de rechute ou de r\u00e9cidive de la pathologie de l\u2019enfant,<\/li>\n\n\n\n<li>lorsque la gravit\u00e9 de la maladie n\u00e9cessite une pr\u00e9sence permanente et des soins contraignants.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Le renouvellement du cong\u00e9 de pr\u00e9sence parentale n&rsquo;est plus soumis \u00e0 l&rsquo;accord de la CAF ou de la MSA depuis 2024. Il faut simplement adresser \u00e0 son employeur un nouveau certificat m\u00e9dical \u00e9tabli par le m\u00e9decin qui suit l\u2019enfant.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Les<\/strong><strong> d\u00e9marches \u00e0 effectuer&nbsp;<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">La demande de cong\u00e9 de pr\u00e9sence parentale se fait aupr\u00e8s de l\u2019employeur&nbsp;au moins 10 jours avant la date souhait\u00e9e de d\u00e9but du cong\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La demande peut se faire par lettre recommand\u00e9e avec avis de r\u00e9ception (LRAR) ou remise en main propre contre d\u00e9charge. Il faudra y joindre un certificat m\u00e9dical attestant de&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la gravit\u00e9 de la maladie, de l&rsquo;accident ou du handicap,<\/li>\n\n\n\n<li>la n\u00e9cessit\u00e9 d&rsquo;une pr\u00e9sence soutenue aupr\u00e8s de l&rsquo;enfant et des soins contraignants.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Le certificat m\u00e9dical doit pr\u00e9ciser la dur\u00e9e pr\u00e9visible du traitement de l\u2019enfant.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>D\u00e9lai de pr\u00e9venance vis \u00e0 vis de l\u2019employeur<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Il faut informer son employeur au moins 48 heures \u00e0 l\u2019avance \u00e0 chaque prise de cong\u00e9 (demi-journ\u00e9e, un ou plusieurs jours).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aucun d\u00e9lai de pr\u00e9venance n&rsquo;est par contre exig\u00e9 en cas de d\u00e9gradation soudaine de l&rsquo;\u00e9tat de sant\u00e9 de l\u2019enfant ou de situation de crise n\u00e9cessitant la pr\u00e9sence imm\u00e9diate du salari\u00e9 aupr\u00e8s de lui.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En cas de prolongation du cong\u00e9 au-del\u00e0 de la dur\u00e9e pr\u00e9vue dans le certificat m\u00e9dical, pr\u00e9venir l\u2019employeur se fait dans les m\u00eames conditions que lors de la demande initiale.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Cons\u00e9quences sur le contrat de travail<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le contrat de travail est suspendu pendant la dur\u00e9e du cong\u00e9 de pr\u00e9sence parentale,<\/li>\n\n\n\n<li>L\u2019employeur ne peut pas licencier un salari\u00e9 pendant le cong\u00e9 de pr\u00e9sence parentale, ni pendant les p\u00e9riodes travaill\u00e9es si le cong\u00e9 est fractionn\u00e9 ou pris \u00e0 temps partiel, ni pendant les 10 semaines suivant la fin du cong\u00e9 de pr\u00e9sence parentale.<\/li>\n\n\n\n<li>Le contrat de travail peut cependant \u00eatre rompu en cas de faute grave ou d&rsquo;impossibilit\u00e9 de le maintenir. (pour un motif autre que le cong\u00e9 de pr\u00e9sence parentale).<\/li>\n\n\n\n<li>\u00c0 la fin du cong\u00e9, le salari\u00e9 retrouve son emploi pr\u00e9c\u00e9dent, ou un emploi similaire, avec une r\u00e9mun\u00e9ration au moins \u00e9quivalente. Il garde \u00e9galement tous les avantages qu&rsquo;il avait acquis avant le d\u00e9but du cong\u00e9.<\/li>\n\n\n\n<li>Le calcul des avantages li\u00e9s \u00e0 l\u2019anciennet\u00e9 prend en compte la totalit\u00e9 de l&rsquo;absence. De m\u00eame pour le calcul des heures de formation qui alimentent <a href=\"https:\/\/valoxy.org\/blog\/le-compte-personnel-de-formation-cpf\/\">le Compte Personnel de Formation (CPF)<\/a><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>L\u2019indemnisation du cong\u00e9 de pr\u00e9sence parentale<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Le salari\u00e9 ne touche plus son salaire. Il est cependant possible, sous conditions, de percevoir <a href=\"https:\/\/www.service-public.gouv.fr\/particuliers\/vosdroits\/F15132\">l&rsquo;allocation journali\u00e8re de pr\u00e9sence parentale (AJPP)<\/a>, \u00e0 demander aupr\u00e8s de la CAF ou de la MSA.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Une meilleure&nbsp;<\/strong><strong>protection<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">La loi n\u00b02023-622 du 19 juillet 2023 am\u00e9liorait la <a href=\"https:\/\/valoxy.org\/blog\/protection-des-parents-denfants-gravement-malades\/\">protection des parents d\u2019enfants gravement malades<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La loi du 12 juin 2026 va plus loin, et :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>allonge de 10 semaines apr\u00e8s la fin du cong\u00e9 de pr\u00e9sence parentale le d\u00e9lai pendant lequel un\u00a0employeur ne peut pas rompre le contrat de travail.(article L.1225-4-4 du code du travail modifi\u00e9).\u00a0<\/li>\n\n\n\n<li>fait b\u00e9n\u00e9ficier les parents (ou les responsables l\u00e9gaux) d&rsquo;un <strong>am\u00e9nagement d&rsquo;horaires individualis\u00e9<\/strong> lorsque l\u2019\u00e9tat de sant\u00e9 de l\u2019enfantrend indispensables une pr\u00e9sence soutenue et des soins contraignants (article L.3121-49 du code du travail modifi\u00e9).<\/li>\n\n\n\n<li>raccourcit le d\u00e9lai de pr\u00e9venance d&rsquo;au moins 15 jours avant le d\u00e9but du cong\u00e9 \u00e0 <strong>au moins 10 jours<\/strong> (article L.1225-63 du code du travail modifi\u00e9).<\/li>\n\n\n\n<li>rallonge de 5 \u00e0 <strong>10 jours<\/strong> le cong\u00e9 lors de l\u2019annonce de la survenue d&rsquo;un handicap, d&rsquo;une pathologie chronique n\u00e9cessitant un apprentissage th\u00e9rapeutique ou d&rsquo;un cancer chez un enfant (article L.3142-2 du code du travail modifi\u00e9).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Cet article vous a \u00e9t\u00e9 utile ?
