On parle de <strong>mise \u00e0 la retraite<\/strong> quand l\u2019employeur en est \u00e0 l\u2019origine, et de <strong>d\u00e9part volontaire<\/strong> quand la demande \u00e9mane du salari\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, pr\u00e9cise dans cet article la diff\u00e9rence entre ces deux modes de d\u00e9part \u00e0 la retraite.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ce d\u00e9part ne peut dans tous les cas intervenir avant que le salari\u00e9 n\u2019ait atteint l\u2019\u00e2ge l\u00e9gal de d\u00e9part \u00e0 la retraite. Fix\u00e9 \u00e0 60 ans pour les salari\u00e9s n\u00e9s avant le 1<sup>er<\/sup> juillet 1951 (Loi Auroux de 1981), il a \u00e9t\u00e9 repouss\u00e9 \u00e0 62 ans pour ceux n\u00e9s entre le 1<sup>er<\/sup>&nbsp;janvier 1955 et le 31&nbsp;ao\u00fbt 1961 inclus (R\u00e9forme Woerth de 2010). Pour les assur\u00e9s n\u00e9s \u00e0 partir du 1<sup>er<\/sup> septembre 1961, il augmentera progressivement, \u00e0 raison de 3&nbsp;mois suppl\u00e9mentaires par an, pour atteindre 64&nbsp;ans pour ceux n\u00e9s \u00e0 partir du 1<sup>er<\/sup>&nbsp;janvier&nbsp;1968. La r\u00e9forme Macron\/Borne de 2023, qui acc\u00e9l\u00e9rait ce rythme, a \u00e9t\u00e9 suspendue.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Si la condition d\u2019\u00e2ge n\u2019est pas remplie, le d\u00e9part du salari\u00e9 \u00e0 la retraite constitue une d\u00e9mission ou un licenciement.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le d\u00e9part volontaire (\u00e0 l\u2019initiative du salari\u00e9)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Le d\u00e9part volontaire \u00e0 la retraite est un mode de rupture particulier du contrat de travail, \u00e0 l\u2019initiative du salari\u00e9. <strong>Ce n\u2019est pas une d\u00e9mission<\/strong>. C\u2019est <em>\u201cune d\u00e9cision r\u00e9sultant d\u2019une volont\u00e9 claire et non \u00e9quivoque du salari\u00e9\u00a0en vue de rompre son contrat de travail pour b\u00e9n\u00e9ficier d\u2019une pension de vieillesse\u201d <\/em>(article L.1237-5 du Code du travail).\u00a0Le salari\u00e9 doit n\u00e9anmoins atteindre l\u2019\u00e2ge l\u00e9gal de d\u00e9part \u00e0 la retraite. Il doit aussi :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>adresser&nbsp;sa demande de retraite aupr\u00e8s de sa caisse r\u00e9gionale de retraite du r\u00e9gime g\u00e9n\u00e9ral (<a href=\"https:\/\/www.mademandederetraitenligne.fr\/\">Assurance retraite<\/a>) et de sa caisse de retraite compl\u00e9mentaire (<a href=\"https:\/\/espace-personnel.agirc-arrco.fr\/auth\/login?service=https:\/\/espace-personnel.agirc-arrco.fr\/shiro-cas\">Agirc-Arrco<\/a>),<\/li>\n\n\n\n<li>pr\u00e9venir son employeur, et respecter le pr\u00e9avis de d\u00e9part \u00e0 la retraite,&nbsp; identique \u00e0 celui pr\u00e9vu en cas de licenciement. (ou pr\u00e9venir <a href=\"https:\/\/www.francetravail.fr\/candidat\/mes-droits-aux-aides-et-allocati\/a-chaque-situation-son-allocatio\/quelle-est-ma-situation-professi\/je-suis-en-cours-dindemnisation\/je-suis-proche-de-la-retraite.html#:~:text=\">France Travail<\/a> s\u2019il est au ch\u00f4mage).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pour b\u00e9n\u00e9ficier d\u2019une retraite \u00e0 taux plein, le salari\u00e9 doit, outre la condition d\u2019\u00e2ge l\u00e9gal, avoir valid\u00e9 un certain nombre de trimestres (voir notre article <a href=\"https:\/\/valoxy.org\/blog\/preparer-sa-demande-de-retraite\/\">Pr\u00e9parer sa demande de retraite<\/a>), ou atteint l\u2019\u00e2ge de 67 ans, quelle que soit la dur\u00e9e d\u2019assurance valid\u00e9e. Sans disposer d\u2019une dur\u00e9e d\u2019assurance suffisante pour le taux plein \u00e0 l\u2019\u00e2ge l\u00e9gal, le salari\u00e9 peut cependant d\u00e9cider de liquider ses droits \u00e0 retraite. La pension sera alors minor\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La mise \u00e0 la retraite (\u00e0 l\u2019initiative de l\u2019employeur)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Avant 70 ans, l\u2019employeur ne peut pas mettre un salari\u00e9 \u00e0 la retraite d\u2019office. Il peut en revanche lui proposer de partir \u00e0 la retraite, s\u2019il a atteint l\u2019\u00e2ge d\u2019ouverture automatique du droit \u00e0 pension \u00e0 taux plein (67 ans). Mais il ne peut en aucun cas l&rsquo;y obliger. Sinon, il s\u2019agit d\u2019un licenciement sans cause r\u00e9elle et s\u00e9rieuse (licenciement abusif), voire m\u00eame un licenciement nul, car discriminatoire, s\u2019il est motiv\u00e9 par l\u2019\u00e2ge du salari\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trois mois avant la date \u00e0 laquelle le salari\u00e9 atteindra l\u2019\u00e2ge d\u2019ouverture automatique du droit \u00e0 pension \u00e0 taux plein, l\u2019employeur interrogera par \u00e9crit le salari\u00e9 sur son intention de quitter volontairement l\u2019entreprise pour prendre sa retraite. Dans le mois qui suit cette interrogation, le salari\u00e9 doit r\u00e9pondre.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>S\u2019il donne son accord, la mise \u00e0 la retraite est possible et le d\u00e9part du salari\u00e9 fix\u00e9, en tenant compte d\u2019un d\u00e9lai de pr\u00e9avis,<\/li>\n\n\n\n<li>S\u2019il refuse, l\u2019employeur ne peut pas mettre le salari\u00e9 \u00e0 la retraite pendant l\u2019ann\u00e9e qui suit. Il pourra de nouveau l\u2019interroger, selon la m\u00eame proc\u00e9dure, chaque ann\u00e9e, jusqu\u2019\u00e0 son 69\u00e8me anniversaire inclus.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c0 partir des 70 ans du salari\u00e9, l\u2019employeur peut le mettre \u00e0 la retraite <strong>d\u2019office<\/strong>,\u00a0 sans avoir besoin de son accord. Le d\u00e9part \u00e0 la retraite est alors \u00e0 l&rsquo;initiative de l\u2019employeur. Les textes ne pr\u00e9voient ucune proc\u00e9dure particuli\u00e8re, sauf mention dans une convention collective, ou un accord collectif. Un d\u00e9lai de pr\u00e9avis sera accord\u00e9. La mise \u00e0 la retraite ne constitue pas un licenciement, et n\u2019entra\u00eene donc pas de convocation, ni d\u2019entretien pr\u00e9alable, ni de notification par lettre recommand\u00e9e. Valoxy recommande n\u00e9anmoins d\u2019effectuer cette proc\u00e9dure par \u00e9crit, avec remise contre d\u00e9charge ou lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019autorisation pr\u00e9alable de <a href=\"https:\/\/valoxy.org\/blog\/inspection-du-travail-definition\/\">l\u2019inspection du travail<\/a> est requise lorsque la mise \u00e0 la retraite concerne un salari\u00e9 prot\u00e9g\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Indemnit\u00e9s de d\u00e9part \u00e0 la retraite<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Un salari\u00e9 mis \u00e0 la retraite \u00e0 70 ans ou qui rompt volontairement son contrat de travail pour toucher sa pension de vieillesse a droit \u00e0 une&nbsp;indemnit\u00e9 de mise \u00e0 la retraite volontaire.&nbsp;(article L1237-9 du Code du travail).&nbsp;Le calcul de l\u2019indemnit\u00e9 de retraite en cas de d\u00e9part volontaire&nbsp;varie selon l\u2019anciennet\u00e9 du salari\u00e9 dans son entreprise :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00bd mois du salaire de r\u00e9f\u00e9rence apr\u00e8s 10 ans d\u2019anciennet\u00e9,<\/li>\n\n\n\n<li>1 mois apr\u00e8s 15 ans,<\/li>\n\n\n\n<li>1 mois \u00bd apr\u00e8s 20 ans,<\/li>\n\n\n\n<li>2 mois apr\u00e8s 30 ans d\u2019anciennet\u00e9.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Retrouvez sur notre blog les articles :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/valoxy.org\/blog\/la-provision-pour-indemnite-de-depart-a-la-retraite-idr-et-sa-comptabilisation\/\">Provision pour indemnit\u00e9 de d\u00e9part \u00e0 la retraite (IDR)<\/a>&nbsp;<\/li>\n\n\n\n<li><a href=\"https:\/\/valoxy.org\/blog\/comment-sont-imposees-les-indemnites-de-depart-a-la-retraite\/\">Comment sont impos\u00e9es les indemnit\u00e9s de d\u00e9part \u00e0 la retraite ?<\/a><\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\">Le salaire pour le calcul de l\u2019indemnit\u00e9 sera le plus avantageux entre :<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Soit 1\/12e de la r\u00e9mun\u00e9ration brute des 12 derniers mois pr\u00e9c\u00e9dant le d\u00e9part \u00e0 la retraite,<\/li>\n\n\n\n<li>Soit 1\/3 des 3 derniers mois (dans ce cas, toute prime ou autre \u00e9l\u00e9ment de salaire annuel ou exceptionnel vers\u00e9 au salari\u00e9 pendant cette p\u00e9riode est recalcul\u00e9 sur 3 mois).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Le salari\u00e9 percevra \u00e9galement :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s,<\/li>\n\n\n\n<li>Une indemnit\u00e9 compensatrice de pr\u00e9avis,<\/li>\n\n\n\n<li>Une contrepartie p\u00e9cuniaire en cas de clause de non-concurrence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Cet article vous a-t-il \u00e9t\u00e9 utile ?
