Voulu par le pr\u00e9sident Macron, il est int\u00e9gr\u00e9 dans la loi de Financement de la S\u00e9curit\u00e9 Sociale 2026. Il entre en vigueur au 1er Juillet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Qu\u2019est-ce que ce \u201cnouveau\u00a0\u00bb cong\u00e9 de naissance ? Que comprend-il ? Comment est-il r\u00e9mun\u00e9r\u00e9 ? Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, fait le point.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Qu\u2019est-ce que ce cong\u00e9 suppl\u00e9mentaire de naissance ?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Les d\u00e9crets, parus au JO le 31 Mai 2026, d\u00e9taillent ses modalit\u00e9s, qui ont fait l&rsquo;objet de discussions avec les partenaires sociaux.  Le cong\u00e9 suppl\u00e9mentaire de naissance se pr\u00e9sente comme un <strong>compl\u00e9ment<\/strong> des cong\u00e9s existants :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le cong\u00e9 de maternit\u00e9 (16 semaines, 26 \u00e0 partir du 3<sup>e<\/sup> enfant),<\/li>\n\n\n\n<li><a href=\"https:\/\/valoxy.org\/blog\/conge-de-paternite\/\">le cong\u00e9 de paternit\u00e9<\/a> et d&rsquo;accueil de l&rsquo;enfant (28 jours),<\/li>\n\n\n\n<li>le <a href=\"https:\/\/valoxy.org\/blog\/le-conge-dadoption\/\">cong\u00e9 d\u2019adoption<\/a>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Le principal avantage<\/strong> du cong\u00e9 suppl\u00e9mentaire de naissance est d\u2019\u00eatre mieux r\u00e9mun\u00e9r\u00e9. Son principe est celui d\u2019une indemnit\u00e9 journali\u00e8re, comme les cong\u00e9s maternit\u00e9 et paternit\u00e9. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L&rsquo;indemnit\u00e9 journali\u00e8re de naissance, financ\u00e9e par la S\u00e9curit\u00e9 sociale, se base sur un pourcentage du salaire ant\u00e9rieur. (70% du salaire net le premier mois, et 60 % le second). L&#8217;employeur peut, s&rsquo;il le souhaite, compl\u00e9ter la r\u00e9mun\u00e9ration pour atteindre 100&nbsp;% du salaire (non obligatoire).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00c0 qui s&rsquo;adresse le cong\u00e9 suppl\u00e9mentaire de naissance ?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Tous les parents en activit\u00e9 remplissant les conditions d&rsquo;ouverture de droits applicables aux cong\u00e9s de maternit\u00e9 et de paternit\u00e9 peuvent b\u00e9n\u00e9ficier du cong\u00e9 suppl\u00e9mentaire de naissance :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les&nbsp;salari\u00e9s&nbsp;du secteur priv\u00e9 ;<\/li>\n\n\n\n<li>les agents publics ;<\/li>\n\n\n\n<li>les&nbsp;travailleurs ind\u00e9pendants.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Il s&rsquo;agit d&rsquo;un droit individuel et personnel, non transf\u00e9rable d&rsquo;un parent \u00e0 l&rsquo;autre. Tous les parents d&rsquo;enfants n\u00e9s ou adopt\u00e9s \u00e0 partir du 1er janvier 2026, ainsi que les enfants n\u00e9s avant cette date si la naissance \u00e9tait initialement pr\u00e9vue \u00e0 compter du 1er janvier 2026, peuvent en b\u00e9n\u00e9ficier.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Et les d\u00e9marches administratives ?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>une d\u00e9claration pr\u00e9alable \u00e0 l\u2019employeur. (au moins un mois avant le d\u00e9but du cong\u00e9, ou quinze jours si le cong\u00e9 suit imm\u00e9diatement un cong\u00e9 de paternit\u00e9 ou d&rsquo;adoption)&nbsp;<\/li>\n\n\n\n<li>une notification \u00e0 la CPAM pour l\u2019indemnisation. (avec justificatifs comme l\u2019acte de naissance ou le jugement d\u2019adoption).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La demande \u00e0 l&#8217;employeur doit pr\u00e9ciser la dur\u00e9e choisie (un ou deux mois), ainsi que le mode de fractionnement envisag\u00e9. Il faut la remettre&nbsp;en main propre contre r\u00e9c\u00e9piss\u00e9, ou la transmettre par&nbsp;lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception (LRAR)&nbsp;;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Quand prendre le cong\u00e9 suppl\u00e9mentaire de naissance ?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Le cong\u00e9 suppl\u00e9mentaire de naissance peut se prendre \u00e0 partir du 1er juillet 2026 pour tous les parents d\u2019enfants n\u00e9s ou adopt\u00e9s \u00e0 partir du 1er janvier 2026. (ou dont la date de naissance \u00e9tait pr\u00e9vue \u00e0 compter de cette date mais qui sont n\u00e9s pr\u00e9matur\u00e9ment). <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il peut se fractionner en deux p\u00e9riodes d\u2019un mois. Chaque parent peut prendre le cong\u00e9 simultan\u00e9ment ou en alternance avec l\u2019autre. Et ce, \u00e0 la suite du cong\u00e9 maternit\u00e9, de paternit\u00e9 ou d\u2019adoption. Et dans un d\u00e9lai maximum de 9 mois \u00e0 compter de<strong> la naissance<\/strong> ou de l&rsquo;arriv\u00e9e de l&rsquo;enfant au foyer. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour les parents d&rsquo;enfants n\u00e9s ou adopt\u00e9s entre le 1er janvier et le 30 juin 2026, ce d\u00e9lai de neuf mois ne se d\u00e9compte qu&rsquo;\u00e0 partir du 1er juillet 2026 (et non \u00e0 partir de la naissance). <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Cumuls<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Le cong\u00e9 suppl\u00e9mentaire de naissance ne peut d\u00e9marrer qu&rsquo;apr\u00e8s l&rsquo;expiration des cong\u00e9s de maternit\u00e9, de paternit\u00e9 et d&rsquo;accueil de l&rsquo;enfant ou d&rsquo;adoption auxquels le parent a droit.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On ne peut percevoir l&rsquo;indemnit\u00e9 de cong\u00e9 suppl\u00e9mentaire de naissance en m\u00eame temps que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les Indemnit\u00e9s Journali\u00e8res de maladie ou d&rsquo;accident du travail,<\/li>\n\n\n\n<li>l&rsquo;allocation d&rsquo;Aide au Retour \u00e0 l&rsquo;Emploi (ch\u00f4mage),<\/li>\n\n\n\n<li>la Prestation partag\u00e9e d&rsquo;\u00e9ducation de l&rsquo;enfant (PreParE) pour la m\u00eame p\u00e9riode,<\/li>\n\n\n\n<li>le Compl\u00e9ment de libre choix du mode de garde (CMG) pour l&rsquo;enfant concern\u00e9.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Rappel sur le cong\u00e9 parental<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Le cong\u00e9 suppl\u00e9mentaire de naissance devait initialement <strong>remplacer<\/strong> <a href=\"https:\/\/valoxy.org\/blog\/le-conge-parental-deducation\/\">le cong\u00e9 parental d\u2019\u00e9ducation et d&rsquo;accueil de l&rsquo;enfant<\/a>. Cependant, <em>\u00ab\u00a0compte tenu des&nbsp;tensions qui p\u00e8sent sur les modes de garde\u00a0\u00bb,<\/em> la disparition du \u00ab\u00a0cong\u00e9 parental\u00a0\u00bb n\u2019est plus \u00e0 l\u2019ordre du jour. Le cong\u00e9 suppl\u00e9mentaire de naissance <strong>cohabitera <\/strong>donc avec lui.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La r\u00e9mun\u00e9ration du cong\u00e9 parental d\u2019\u00e9ducation et d\u2019accueil de l\u2019enfant, cr\u00e9\u00e9 en&nbsp;1977, est faible. La Prestation partag\u00e9e d&rsquo;\u00e9ducation de l&rsquo;enfant (PreParE) n\u2019atteint en effet que 456 \u20ac par mois, mais offre l\u2019immense avantage de la flexibilit\u00e9. Elle permet aux parents, \u00e0 l&rsquo;issue de leur cong\u00e9 de maternit\u00e9 ou de paternit\u00e9, de <strong>suspendre<\/strong> leur activit\u00e9 professionnelle jusqu&rsquo;aux deux ans de l\u2019enfant. Voire trois ans si les parents se partagent le cong\u00e9.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Le cong\u00e9 suppl\u00e9mentaire de naissance ne rem\u00e9diera cependant pas, \u00e0 lui seul, \u00e0 la&nbsp; baisse de la natalit\u00e9. Il devrait s\u2019articuler avec de nombreuses autres mesures, qu\u2019il faut appr\u00e9hender comme un ensemble.
