﻿{"id":69140,"date":"2024-09-19T16:47:23","date_gmt":"2024-09-19T14:47:23","guid":{"rendered":"https:\/\/valoxy.org\/blog\/?p=69140"},"modified":"2024-09-19T17:33:24","modified_gmt":"2024-09-19T15:33:24","slug":"la-contre-visite-medicale","status":"publish","type":"post","link":"https:\/\/valoxy.org\/blog\/la-contre-visite-medicale\/","title":{"rendered":"La contre-visite m\u00e9dicale"},"content":{"rendered":"\n<p>La contre-visite m\u00e9dicale patronale est un outil qui permet aux employeurs de v\u00e9rifier la l\u00e9gitimit\u00e9 des arr\u00eats de travail et de lutter contre un absent\u00e9isme croissant.<\/p>\n\n\n\n<p>Publi\u00e9 au Journal officiel, le <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGIARTI000049898786\/2024-07-07\/\">d\u00e9cret 2024-692<\/a> du 5 Juillet 2024 vise \u00e0 mieux encadrer la pratique de la contre-visite, et \u00e0 clarifier les obligations de chacun.<\/p>\n\n\n\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France d\u00e9crypte les nouvelles modalit\u00e9s de la contre-visite m\u00e9dicale patronale lors d\u2019un arr\u00eat maladie et ses implications pour les entreprises et les salari\u00e9s.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><mark style=\"background-color:rgba(0, 0, 0, 0);color:#c0d233\" class=\"has-inline-color\">\u2014<\/mark><strong>Les objectifs de la contre-visite m\u00e9dicale<\/strong><\/h2>\n\n\n\n<p>La contre-visite m\u00e9dicale est la contrepartie naturelle du paiement d\u2019indemnit\u00e9s (S\u00e9curit\u00e9 sociale) ou d\u2019indemnit\u00e9s compl\u00e9mentaires (employeur). L\u2019employeur mandate un m\u00e9decin pour v\u00e9rifier si l\u2019arr\u00eat de travail d\u2019un salari\u00e9 est justifi\u00e9.<em><\/em><\/p>\n\n\n\n<p>Les articles <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGIARTI000049898796\/2024-07-07\">R1226-10<\/a>, <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGIARTI000049898798\/2024-07-07\">R1226-11<\/a> et <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGIARTI000049898800\/2024-07-07\">R1226-12<\/a> du Code du Travail, cr\u00e9\u00e9s par le <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/LEGIARTI000049898786\/2024-07-07\/\">d\u00e9cret 2024-692<\/a> du 5 Juillet 2024 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>pr\u00e9cisent les modalit\u00e9s de la contre-visite m\u00e9dicale patronale,<\/li>\n\n\n\n<li>renforcent le contr\u00f4le des arr\u00eats de travail,<\/li>\n\n\n\n<li>et facilitent la lutte contre des abus potentiels.<\/li>\n<\/ul>\n\n\n\n<p>Jusqu\u2019\u00e0 pr\u00e9sent en effet, seul <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000031687748\">l\u2019article L1226<\/a> faisait mention d\u2019une \u201ccontrevisite\u201d. (Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/comment-etre-sur-de-la-realite-dun-arret-maladie\/\">Comment \u00eatre s\u00fbr de la r\u00e9alit\u00e9 d\u2019un arr\u00eat maladie ?<\/a><em>)<\/em><\/p>\n\n\n\n<p>Compte tenu d\u2019une l\u00e9gislation locale sp\u00e9cifique, les employeurs des d\u00e9partements de la Moselle, du Bas-Rhin et du Haut-Rhin ne peuvent pas ordonner de contre-visite m\u00e9dicale.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><mark style=\"background-color:rgba(0, 0, 0, 0);color:#c0d233\" class=\"has-inline-color\">\u2014<\/mark><strong>Les obligations du salari\u00e9<\/strong><\/h2>\n\n\n\n<p>D\u00e8s le d\u00e9but de &nbsp;l\u2019arr\u00eat de travail, le salari\u00e9 doit informer l\u2019employeur :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>de son lieu de repos (s\u2019il diff\u00e8re de son domicile), une information qui figure sur l&rsquo;arr\u00eat de travail,<\/li>\n\n\n\n<li>des horaires permettant d\u2019effectuer la contre-visite m\u00e9dicale en cas de \u00ab&nbsp;sortie libre&nbsp;\u00bb.&nbsp; (il s&rsquo;agit d&rsquo;une nouvelle information \u00e0 communiquer \u00e0 l&#8217;employeur)<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><mark style=\"background-color:rgba(0, 0, 0, 0);color:#c0d233\" class=\"has-inline-color\">\u2014<\/mark><strong>Comment se d\u00e9roule la contre-visite ?<\/strong><\/h2>\n\n\n\n<p>L\u2019employeur peut demander &#8211; \u00e0 sa charge &#8211; une contre-visite \u00e0 tout moment de l\u2019arr\u00eat de travail. Il n\u2019est pas oblig\u00e9 d\u2019en informer \u00e0 l\u2019avance le salari\u00e9.<\/p>\n\n\n\n<p>La contre-visite est r\u00e9alis\u00e9e par un m\u00e9decin <strong>mandat<\/strong><strong>\u00e9 par l<\/strong><strong>\u2019<\/strong><strong>employeur,<\/strong> qui doit \u00eatre impartial, et ne peut donc \u00eatre ni le m\u00e9decin traitant du salari\u00e9, ni <a href=\"https:\/\/valoxy.org\/blog\/medecin-du-travail\/\">le m\u00e9decin du travail<\/a> de l\u2019entreprise, ni le m\u00e9decin conseil de la CPAM.&nbsp;La contre-visite peut se d\u00e9rouler :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>au domicile du salari\u00e9 ou \u00e0 l\u2019adresse communiqu\u00e9e, sans d\u00e9lai de pr\u00e9venance.<\/li>\n\n\n\n<li>sur convocation du salari\u00e9 au cabinet du m\u00e9decin, avec une date pr\u00e9cise. Le salari\u00e9 dans l&rsquo;impossibilit\u00e9 de se d\u00e9placer, notamment en raison de son \u00e9tat de sant\u00e9, doit en informer le m\u00e9decin et pr\u00e9ciser les raisons de son absence.<\/li>\n<\/ul>\n\n\n\n<p>Le m\u00e9decin contr\u00f4leur \u00e9value si l\u2019arr\u00eat de travail ainsi que sa dur\u00e9e sont justifi\u00e9s. Il doit adresser ensuite son rapport \u00e0 la CPAM (Caisse Primaire d\u2019Assurance Maladie) comme \u00e0 l\u2019employeur. Celui-ci en informera ensuite sans d\u00e9lai le salari\u00e9.<\/p>\n\n\n\n<p><em>Le cas \u00e9ch\u00e9ant, m\u00e9<\/em><em>decin contr<\/em><em>\u00f4leur informera l&#8217;employeur de l&rsquo;impossibilit\u00e9 d&rsquo;effectuer la contre-visite en raison d&rsquo;un motif imputable au salari\u00e9.<\/em><em><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><mark style=\"background-color:rgba(0, 0, 0, 0);color:#c0d233\" class=\"has-inline-color\">\u2014<\/mark><strong>Quelles suites donner \u00e0 une contre-visite m\u00e9dicale ?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>si le m\u00e9decin contr\u00f4leur juge l\u2019arr\u00eat justifi\u00e9, il n\u2019y a rien \u00e0 faire, et le salari\u00e9 n\u2019en subira aucune cons\u00e9quence n\u00e9gative.<\/li>\n\n\n\n<li>dans l\u2019hypoth\u00e8se o\u00f9 le m\u00e9decin consid\u00e8re l\u2019arr\u00eat comme injustifi\u00e9, ou que l\u2019examen n\u2019a pu avoir lieu du fait du salari\u00e9, l\u2019employeur <strong>peut suspendre le versement des indemnit\u00e9s compl\u00e9mentaires \u00e0 sa charge.<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>Attention aux abus !
