Si l\u2019administration consid\u00e8re qu\u2019il s\u2019agissait de travail dissimul\u00e9, l\u2019infraction devient un d\u00e9lit puni d\u2019une peine maximale de 3 ans de prison et dune amende de 45 000 \u20ac.<\/p>\n<h2><b>Le jour de l\u2019embauche\u00a0: <\/b><\/h2>\n<p><strong>1 <\/strong><b>&#8211; l\u2019inscription dans le registre du personnel<\/b><\/p>\n<p>Vous devez <span class=\"exergue\">tenir \u00e0 jour un registre du personnel par ordre chronologique d\u2019<strong>embauche<\/strong><\/span>. Celui-ci doit imp\u00e9rativement indiquer\u00a0:<\/p>\n<ul>\n<li>le nom et le pr\u00e9nom du salari\u00e9<img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6559 alignright\" style=\"margin-left: 10px;\" title=\"L'embauche en entreprise\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/10\/recrutement-2-300x216.jpg\" alt=\"L'embauche\" width=\"222\" height=\"161\" \/><\/li>\n<li>le sexe<\/li>\n<li>la date de naissance<\/li>\n<li>la nationalit\u00e9<\/li>\n<li>l\u2019emploi<\/li>\n<li>la qualification<\/li>\n<li>la date d&rsquo;entr\u00e9e et de sortie<\/li>\n<li>et donner des informations sur le type de contrat quand il ne s\u2019agit pas d\u2019un CDI \u00e0 temps complet.<\/li>\n<\/ul>\n<p>A d\u00e9faut de mise \u00e0 jour, l\u2019employeur sera sanctionn\u00e9 par le paiement d\u2019une amende de 4\u00e8me classe autant de fois que de salari\u00e9s concern\u00e9s.<\/p>\n<h3>2 <b>&#8211; l\u2019affiliation aux r\u00e9gimes de retraite compl\u00e9mentaire,\u00a0 \u00e0 la pr\u00e9voyance et \u00e0 une compl\u00e9mentaire Sant\u00e9 (Mutuelle)<\/b><\/h3>\n<p>Vous \u00eates tenu d\u2019affilier votre <span class=\"exergue\">salari\u00e9 non cadre\u00a0 \u00e0 une institution relevant de l\u2019ARRCO<\/span> et votre <span class=\"exergue\">salari\u00e9 cadre \u00e0 une institution relevant de l\u2019AGIRC<\/span>.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-3245 alignleft\" style=\"margin-right: 15px;\" title=\"l'embauche d'un salari\u00e9\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/05\/credit-impot-recherche.png\" alt=\"Embaucher\" width=\"60\" height=\"58\" \/>A d\u00e9faut d\u2019affiliation, le salari\u00e9 pourra intenter contre vous une action en r\u00e9gularisation ou, s\u2019il a d\u00e9j\u00e0 liquid\u00e9 sa retraite, une action en dommages et int\u00e9r\u00eats.<\/p>\n<h2><b>Avant la fin de la p\u00e9riode d\u2019essai\u00a0: la visite m\u00e9dicale <\/b><\/h2>\n<p>La d\u00e9claration pr\u00e9alable \u00e0 l\u2019<strong><span class=\"exergue\">embauche<\/span> <\/strong>remplace la demande d\u2019examen m\u00e9dical. <span class=\"exergue\">La visite m\u00e9dicale doit avoir lieu au plus tard avant la fin de la p\u00e9riode d\u2019essai<\/span> qui suit l\u2019embauche.<\/p>\n<p>Si vous n\u2019y veillez pas, vous pourriez devoir payer une amende de 5\u00e8me classe. Votre salari\u00e9 pourra en outre vous demander des dommages-int\u00e9r\u00eats.<\/p>\n<p><b>\u00a0<\/b><b>Et pour les entreprises de plus de 50 salari\u00e9s, le relev\u00e9 des contrats dans les 8 premiers jours de chaque mois<\/b><\/p>\n<p><span class=\"exergue\">Si votre entreprise compte plus de 50 salari\u00e9s, vous devez adresser une d\u00e9claration des mouvements de main d\u2019\u0153uvre<\/span> (DDMO) \u00e0 la Direction de l\u2019Animation de la Recherche, des Etudes et des Statistiques (DARES), dans les 8 premiers jours de chaque mois. Cette d\u00e9claration mentionne les embauches et r\u00e9siliations de contrats survenues le mois pr\u00e9c\u00e9dent, \u00e0 l\u2019exception des CDD d\u2019une dur\u00e9e maximale d\u2019un mois.<\/p>\n<p>Depuis le 1er janvier 2013, les employeurs peuvent remplir cette obligation par Internet au moyen de la d\u00e9claration sociale nominative (DSN) destin\u00e9e \u00e0 remplacer la d\u00e9claration des mouvements de main d\u2019\u0153uvre \u00e0 compter du 1er janvier 2016.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4275 alignleft\" style=\"margin-right: 10px;\" title=\"L'embauche dans une entreprise de plus de 50 salari\u00e9s\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/06\/compte-courant-dassocie-1-300x262.png\" alt=\"L'embauche en entreprise\" width=\"69\" height=\"59\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/06\/compte-courant-dassocie-1-300x262.png 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/06\/compte-courant-dassocie-1.png 438w\" sizes=\"(max-width: 69px) 100vw, 69px\" \/>A d\u00e9faut de communication de la d\u00e9claration des mouvements de main d\u2019\u0153uvre, vous pourriez \u00eatre sanctionn\u00e9 pour chaque oubli, par le paiement d\u2019une amende de 4\u00e8me classe.<\/p>\n<p><b>\u00a0<\/b><\/p>\n<h2><b>Le cas du salari\u00e9 n\u2019ayant jamais travaill\u00e9<\/b><\/h2>\n<p><a title=\"16 conseils pour r\u00e9ussir votre recrutement (conseils 1 \u00e0 4)\" href=\"https:\/\/valoxy.org\/blog\/conseils-pour-recruter\/\" target=\"_blank\" rel=\"noopener noreferrer\">Vous avez embauch\u00e9 un salari\u00e9<\/a> dont c\u2019est le premier poste\u00a0?
