Qui sont le d\u00e9l\u00e9gu\u00e9 syndical (DS), le repr\u00e9sentant de la section syndicale (RSS), le repr\u00e9sentant syndical aupr\u00e8s du CSE (RSSCE) ? Quel est leur r\u00f4le ? Comment sont-ils nomm\u00e9s ? Font-ils partie du CSE (Comit\u00e9 social et \u00e9conomique) ?<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, fait le tour de la repr\u00e9sentation syndicale en entreprise.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Une section syndicale<\/strong><\/h2>\n<p>Une <strong>section syndicale<\/strong> est une instance cr\u00e9\u00e9e dans une entreprise par un syndicat y comptant au moins 2 adh\u00e9rents pour d\u00e9fendre les droits et int\u00e9r\u00eats des salari\u00e9s qu&rsquo;elle repr\u00e9sente. Elle est anim\u00e9e par un d\u00e9l\u00e9gu\u00e9 (DS) ou un repr\u00e9sentant de la section syndicale (RSS).<\/p>\n<h4><strong>Le repr\u00e9sentant de la section syndicale (RSS)<\/strong><\/h4>\n<p>C&rsquo;est une personne d\u00e9sign\u00e9e par un <strong><em>syndicat non repr\u00e9sentatif<\/em> <\/strong>\u00a0dans l\u2019entreprise comme \u201crepr\u00e9sentant de la section syndicale\u201d (RSS) dans l\u2019entreprise.<\/p>\n<p>Un syndicat non repr\u00e9sentatif r\u00e9pond \u00e0 l\u2019une des 2 conditions suivantes :<\/p>\n<ul>\n<li>Il est l\u00e9galement constitu\u00e9, c\u2019est \u00e0 dire :\n<ul>\n<li>qu\u2019il respecte les crit\u00e8res de respect des valeurs r\u00e9publicaines et d\u2019ind\u00e9pendance,<\/li>\n<li>qu\u2019il est l\u00e9galement constitu\u00e9 depuis au moins 2 ans,<\/li>\n<li>que son champ professionnel et g\u00e9ographique couvre l\u2019entreprise,<\/li>\n<li>qu\u2019il satisfait aux crit\u00e8re de transparence financi\u00e8re<\/li>\n<\/ul>\n<\/li>\n<li>Ou il est affili\u00e9 \u00e0 une organisation syndicale repr\u00e9sentative au niveau national et interprofessionnel.<\/li>\n<\/ul>\n<h4><strong>Le d\u00e9l\u00e9gu\u00e9 syndical (DS)<\/strong><\/h4>\n<p>C&rsquo;est la personne (salari\u00e9e de l\u2019entreprise) d\u00e9sign\u00e9e par un <a href=\"https:\/\/code.travail.gouv.fr\/fiche-service-public\/quest-ce-quun-syndicat-representatif-dans-lentreprise#\">syndicat repr\u00e9sentatif<\/a> dans l\u2019entreprise pour le repr\u00e9senter. Contrairement au RSS, il peut n\u00e9gocier d\u2019accords collectifs.<\/p>\n<p>En plus des 4 premiers crit\u00e8res list\u00e9s ci dessus, un syndicat repr\u00e9sentatif r\u00e9pond \u00e9galement aux 3 conditions suppl\u00e9mentaires suivantes :<\/p>\n<ul>\n<li>d\u2019influence, d\u00e9termin\u00e9e principalement d\u00e9termin\u00e9e par son activit\u00e9 et son exp\u00e9rience,<\/li>\n<li>il compte un nombre suffisant d&rsquo;adh\u00e9rents pour que leurs cotisations repr\u00e9sentent la partie principale de ses ressources, ce qui garantit son \u201cind\u00e9pendance\u201d,<\/li>\n<li>une audience suffisante aux \u00e9lections professionnelle, qui se traduit par avoir obtenu au moins 10\u00a0% des suffrages exprim\u00e9s lors du 1<sup>er<\/sup> tour des derni\u00e8res \u00e9lections des titulaires au CSE.<\/li>\n<\/ul>\n<h4>D\u00e9l\u00e9gu\u00e9 syndical et repr\u00e9sentant de la section syndicale :<\/h4>\n<p>Ils repr\u00e9sentent leur syndicat aupr\u00e8s de l\u2019employeur, animent leur section syndicale et assurent un lien entre les salari\u00e9s et l\u2019organisation syndicale.<\/p>\n<ul>\n<li><strong>Dans les entreprises de plus de 50 salari\u00e9s<\/strong>, le syndicat d\u00e9signe son repr\u00e9sentant (DS ou RSS) , acteur cl\u00e9 de la repr\u00e9sentation syndicale en entreprise, parmi les candidats aux \u00e9lections professionnelles qui ont obtenu \u00e0 titre personnel et dans leur coll\u00e8ge au moins 10 % des suffrages exprim\u00e9s au 1<sup>er<\/sup> tour des derni\u00e8res \u00e9lections au CSE. <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000006195667\/#LEGISCTA000006195667\">(Article L2143-3 du code du travail)<\/a><\/li>\n<li><strong>Dans les entreprises de plus de 500 salari\u00e9s<\/strong>, un syndicat repr\u00e9sentatif peut d\u00e9signer un d\u00e9l\u00e9gu\u00e9 syndical suppl\u00e9mentaire s&rsquo;il a obtenu un ou plusieurs \u00e9lus dans le coll\u00e8ge des ouvriers et employ\u00e9s lors de l&rsquo;\u00e9lection du CSE et s&rsquo;il compte au moins un \u00e9lu dans l&rsquo;un des deux autres coll\u00e8ges (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000006195667\/#LEGISCTA000006195667\">Article L2143-4 du Code du Travail)<\/a><\/li>\n<li><strong>Enfin, dans les entreprises de moins de 50 salari\u00e9s<\/strong>, il n\u2019y a pas de d\u00e9l\u00e9gu\u00e9 syndical. Et donc pas de d\u00e9signation d\u2019un d\u00e9l\u00e9gu\u00e9 syndical (DS),\u00a0 r\u00e9serv\u00e9e aux entreprises de 50 salari\u00e9s et plus. <strong><em>Toutefois, \u00e0 titre d\u00e9rogatoire, <\/em><\/strong><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006072050\/LEGISCTA000006198559?init=true&amp;page=1&amp;query=Article+L2143-6+-+Code+du+travail&amp;searchField=ALL&amp;tab_selection=all&amp;anchor=LEGIARTI000035653218#LEGIARTI000035653218\">l&rsquo;article L2143-6 du code du travail<\/a><strong><em> autorise la d\u00e9signation d<\/em><\/strong><strong><em>\u2019<\/em><\/strong><strong><em>un d\u00e9l\u00e9gu\u00e9 syndical parmi les membres titulaires \u00e9lus du CSE,<\/em><\/strong> pour la dur\u00e9e de son mandat, et \u00e0 la m\u00eame condition que pour les entreprises de plus de 50 salari\u00e9s (voir ci-dessus). Ce salari\u00e9 aura alors deux fonctions.<\/li>\n<\/ul>\n<p>Quelle que soit la taille de l\u2019entreprise, le salari\u00e9 qui souhaite devenir d\u00e9l\u00e9gu\u00e9 syndical doit r\u00e9pondre aux 3 conditions suivantes\u00a0:<\/p>\n<ul>\n<li>Avoir au moins 18 ans,<\/li>\n<li>Travailler dans l&rsquo;entreprise depuis 1 an minimum (ou depuis 4 mois en cas de cr\u00e9ation d&rsquo;entreprise ou d&rsquo;ouverture d\u2019\u00e9tablissement),<\/li>\n<li>N&rsquo;avoir fait l&rsquo;objet d&rsquo;aucune interdiction, d\u00e9ch\u00e9ance ou incapacit\u00e9 de ses droits civiques.<\/li>\n<\/ul>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Le Comit\u00e9 social et \u00e9conomique (CSE) <\/strong><\/h2>\n<p>Il s&rsquo;agit de l\u2019instance qui a remplac\u00e9, depuis 2020, le d\u00e9l\u00e9gu\u00e9 du personnel (DP), le Comit\u00e9 d\u2019Entreprise (CE), et le CHSCT (Comit\u00e9 d\u2019Hygi\u00e8ne et de S\u00e9curit\u00e9 et des Conditions de Travail). Le CSE a repris ls missions de ces instances. (Ordonnance Macron n\u00b0 2017-1386 du 22 d\u00e9cembre 2017). Voir nos articles :<\/p>\n<ul>\n<li><a href=\"https:\/\/valoxy.org\/blog\/le-comite-social-economique-cse\/\">Le Comit\u00e9 Social Economique (CSE)<\/a><\/li>\n<li><a href=\"https:\/\/valoxy.org\/blog\/le-fonctionnement-du-cse\/\">Le fonctionnement du CSE<\/a><\/li>\n<li><a href=\"https:\/\/valoxy.org\/blog\/le-cse-la-nouvelle-instance-du-dialogue-social\/\">Le CSE, la nouvelle instance du dialogue social<\/a><\/li>\n<\/ul>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Le repr\u00e9sentant syndical au CSE (RSCSE) <\/strong><\/h2>\n<p>Toute organisation syndicale repr\u00e9sentative dans une entreprise ou un \u00e9tablissement <strong>d<\/strong><strong>\u2019<\/strong><strong>au moins 50 salari\u00e9s<\/strong> a la possibilit\u00e9 de d\u00e9signer un repr\u00e9sentant syndical au sein du CSE (RSCSE). Salari\u00e9 de l\u2019entreprise, il repr\u00e9sentera les int\u00e9r\u00eats des salari\u00e9s dans l&rsquo;entreprise. Il agit en tant que porte-parole des salari\u00e9s affili\u00e9s au syndicat.<\/p>\n<p>Cette d\u00e9signation est optionnelle, accessible et r\u00e9versible \u00e0 tout moment. L\u2019entreprise ne peut refuser cette facult\u00e9 \u00e0 un syndicat.<\/p>\n<p>Le mandat de RSCSE n\u2019a pas de dur\u00e9e pr\u00e9cise. Il peut prendre fin :<\/p>\n<ul>\n<li>automatiquement \u00e0 la suite des \u00e9lections professionnelles ;<\/li>\n<li>si le syndicat le d\u00e9cide ;<\/li>\n<li>en cas de cessation anticip\u00e9e (d\u00e9c\u00e8s, d\u00e9mission, rupture du contrat de travail, etc.).<\/li>\n<\/ul>\n<p>Le CSE doit convoquer le repr\u00e9sentant syndical \u00e0 toutes ses r\u00e9unions. Il y dispose d\u2019une voix consultative (et non \u201cd\u00e9lib\u00e9rative\u201d). Il exprimera la position de son syndicat aux autres membres du CSE. Ainsi, il peut participer aux d\u00e9bats, mais ne dispose pas du droit de vote.<\/p>\n<p>Pour effectuer les missions li\u00e9es \u00e0 son mandat, le repr\u00e9sentant syndical <strong>peut <\/strong>disposer d\u2019un cr\u00e9dit d\u2019heures de d\u00e9l\u00e9gation :<\/p>\n<ul>\n<li>dans les entreprises de 50 \u00e0 moins de 501 salari\u00e9s : un accord doit le pr\u00e9voir ;<\/li>\n<li>dans les entreprises d\u2019au moins 501 salari\u00e9s : il aura droit \u00e0 entre 16 et 20 heures chaque mois.<\/li>\n<\/ul>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Qui peut \u00eatre repr\u00e9sentant au CSE (RSCSE) ?<\/strong><\/h2>\n<ul>\n<li>Dans les <strong>entreprises d<\/strong><strong>\u2019<\/strong><strong>au moins 300 salari\u00e9s<\/strong>: chaque organisation syndicale repr\u00e9sentative dans l\u2019entreprise, m\u00eame si elle n\u2019y a pas d\u2019\u00e9lus, peut d\u00e9signer un repr\u00e9sentant syndical au CSE distinct du d\u00e9l\u00e9gu\u00e9 syndical, \u00e0 condition que cette personne soit \u00e9ligible au CSE.<\/li>\n<li>Dans les <strong>\u00e9tablissements de 50\u00a0\u00e0 300\u00a0salari\u00e9s,<\/strong> le d\u00e9l\u00e9gu\u00e9 syndical de chaque organisation est, de droit, repr\u00e9sentant syndical au CSE. Il cumule ces 2 mandats. Cependant, lorsque le DS est \u00e9lu au CSE, il doit faire un choix.\u00a0 Son mandat de repr\u00e9sentant syndical au CSE (membre de droit) est incompatible avec celui de membre \u00e9lu au CSE.<\/li>\n<li>Et dans une <strong>entreprise de moins de 50 salari\u00e9s, il n\u2019y a pas de RS au CSE<\/strong>.<\/li>\n<\/ul>\n<p>Cet article\u00a0 sur la repr\u00e9sentation syndicale en entreprise vous a int\u00e9ress\u00e9 ?
