Les nouvelles r\u00e8gles sont dor\u00e9navant inscrites dans la loi n\u00b02024-364 du 22 Avril 2024. Elles ont \u00e9t\u00e9 int\u00e9gr\u00e9es au Code du travail.<\/p>\n<p class=\"p1\">Celui-ci pr\u00e9voit maintenant que les salari\u00e9s en arr\u00eat de travail pour accident ou maladie, d&rsquo;origine professionnelle ou non, acqui\u00e8rent ou continuent d&rsquo;acqu\u00e9rir des jours de cong\u00e9s.<\/p>\n<p class=\"p1\">Valoxy, cabinet d<span class=\"s1\">\u2019<\/span>expertise comptable dans les Hauts-de-France, reprend dans cet article les principaux points de cette nouvelle l\u00e9gislation.<\/p>\n<p class=\"p4\"><b>Pour rappel, le contexte est le suivant :<span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/p>\n<p class=\"p4\">Plusieurs arr\u00eat de la Cour de cassation dat\u00e9s du 13 septembre 2023 ont balay\u00e9 les r\u00e8gles d\u2019acquisition des cong\u00e9s pay\u00e9s pr\u00e9vues par le droit fran\u00e7ais pour appliquer le droit europ\u00e9en. (Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/jurisprudence-sociale-2023\/\"><span class=\"s2\">Jurisprudence sociale 2023<\/span><\/a>). A la suite de cette jurisprudence bouleversante, c\u2019est au tour du l\u00e9gislateur de mettre en conformit\u00e9 le droit fran\u00e7ais avec les normes europ\u00e9ennes.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Maladie et accident \u00e0 caract\u00e8re non professionnel<\/strong><\/h2>\n<p class=\"p1\">Avant l\u2019entr\u00e9e en vigueur de la loi du 22 avril 2024, un salari\u00e9 en arr\u00eat maladie (ou accident) d\u2019origine non-professionnelle n\u2019acqu\u00e9rait pas de droit \u00e0 cong\u00e9 pay\u00e9 (sauf dispositions conventionnelles plus favorables).<\/p>\n<p>Les articles L3143-5 et suivants du Code du Travail,\u00a0modifi\u00e9s par la loi pr\u00e9cit\u00e9e, posent dor\u00e9navant le principe qu<span class=\"s4\">\u2019<\/span>un salari\u00e9 atteint d<span class=\"s4\">\u2019<\/span>une maladie non professionnelle, ou victime d<span class=\"s4\">\u2019<\/span>un accident non professionnel acquiert des j<span class=\"s5\">ours<\/span><span class=\"s6\"> <a href=\"https:\/\/valoxy.org\/blog\/conges-payes-2\/\"><span class=\"s7\">de cong\u00e9s pay\u00e9s<\/span><\/a><\/span><span class=\"s3\"> pendant le temps de son arr\u00eat de travail.\u00a0<\/span><\/p>\n<p class=\"p4\"><span class=\"s3\">L<\/span><span class=\"s8\">\u2019<\/span><span class=\"s3\">absence du salari\u00e9 en raison de son \u00e9tat de sant\u00e9 n\u2019a donc plus d\u2019impact<b>\u00a0<\/b>sur\u00a0<a href=\"https:\/\/valoxy.org\/blog\/conges-payes\/\"><span class=\"s9\">le calcul de ses droits \u00e0 cong\u00e9s<\/span><\/a>. <\/span>L\u2019absence pour maladie ou accident d&rsquo;origine non professionnelle, sans limite de dur\u00e9e, est donc d\u00e9sormais assimil\u00e9e \u00e0 du temps de travail effectif pour la d\u00e9termination de la dur\u00e9e des cong\u00e9s pay\u00e9s, et ouvrira droit (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049459068\/2024-04-26\"><span class=\"s10\">article L3141-5-1<\/span><\/a>) \u00e0 <span class=\"s5\"><b>2 jours ouvrables<\/b><\/span><b> <\/b>de cong\u00e9s pay\u00e9s par mois d\u2019absence. (dans la limite de 24 jours ouvrables par an).<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014<\/span><strong>A<\/strong><strong>ccident du travail et maladie professionnelle<\/strong><\/h2>\n<p class=\"p1\">Avant l\u2019entr\u00e9e en vigueur de la loi, l\u2019acquisition de cong\u00e9 pay\u00e9 en cas d<span class=\"s1\">\u2019<a href=\"https:\/\/valoxy.org\/blog\/declarer-accident-travail\/\"><span class=\"s2\">accident du travail<\/span><\/a><\/span><span class=\"s3\">\u00a0<\/span>ou de maladie professionnelle se limitait \u00e0 un an. Dor\u00e9navant, les salari\u00e9s en arr\u00eat de travail pour accident ou maladie d&rsquo;origine professionnelle continuent d&rsquo;acqu\u00e9rir 2,5 jours ouvrables de cong\u00e9s pay\u00e9s par mois (soit 30 jours ouvrables par an)<b> sans limitation de dur\u00e9e<\/b>.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Report des cong\u00e9<\/strong><strong>s<\/strong><\/h2>\n<p class=\"p1\">Le droit \u00e0 report des cong\u00e9s ne pourra pas d\u00e9pa<span class=\"s1\">sser 15 mois <\/span>(<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000049459071\/2024-04-26\"><span class=\"s2\">Article L3141-19-1<\/span><\/a>).<\/p>\n<p class=\"p2\">Le point de d\u00e9part de ce d\u00e9lai va d\u00e9pendre de la dur\u00e9e de l\u2019arr\u00eat\u00a0:<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li4\"><span class=\"s3\">Pour les arr\u00eats maladie inf\u00e9rieurs \u00e0 un an, le d\u00e9lai de 15 mois de report d\u00e9bute <\/span>\n<ul class=\"ul1\">\n<li class=\"li4\"><span class=\"s3\"><b>apr\u00e8s la reprise du salari\u00e9 <\/b><\/span><\/li>\n<li class=\"li4\"><span class=\"s3\"><b>et \u00e0 compter de l\u2019information<\/b> par l\u2019employeur des droits \u00e0 cong\u00e9s pay\u00e9s du salari\u00e9.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"p2\"><b>Attention <\/b>: une nouvelle obligation est cr\u00e9\u00e9e pour les employeurs\u00a0:<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p2\">Celui-ci dispose d\u2019un d\u00e9lai d\u2019un mois \u00e0 compter de la reprise du salari\u00e9 pour l\u2019informer du nombre de CP acquis et de la date jusqu\u2019\u00e0 laquelle ces jours peuvent \u00eatre pris. Cette information a lieu par tout moyen conf\u00e9rant date certaine. (L3141-19-3).<\/p>\n<ul class=\"ul1\">\n<li class=\"li4\"><span class=\"s3\">Pour les arr\u00eats d\u2019une dur\u00e9e sup\u00e9rieure \u00e0 un an, la p\u00e9riode de report d\u00e9butera \u00e0 la fin de la p\u00e9riode d&rsquo;acquisition des CP. (L3141-19-2). Ce d\u00e9lai de 15 mois commencera \u00e0 courir m\u00eame si le salari\u00e9 n\u2019a pas repris le travail et m\u00eame si l\u2019employeur ne l\u2019a pas inform\u00e9. Cela signifie qu\u2019au terme du d\u00e9lai de 15 mois \u00e0 compter de la fin de la p\u00e9riode d\u2019acquisition, les CP sont perdus.<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<\/ul>\n<h2><span style=\"color: #c1d72e;\">\u2014<\/span><strong>R\u00e9troactivit\u00e9 et prescription\u00a0<\/strong><\/h2>\n<p class=\"p1\">Il conviendra d<span class=\"s1\">\u2019<\/span>appliquer r\u00e9troactivement ces nouvelles r\u00e8gles d&rsquo;acquisition et de report des droits \u00e0 cong\u00e9s pour la p\u00e9riode courant <b>entre le 1<\/b><span class=\"s2\"><b><sup>er<\/sup><\/b><\/span><b> d\u00e9cembre 2009 et la date d&rsquo;entr\u00e9e en vigueur de la loi.<span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/p>\n<p class=\"p1\">Le d\u00e9lai de prescription diff\u00e8re en fonction de la pr\u00e9sence ou non du salari\u00e9 dans l\u2019entreprise\u00a0:<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li2\"><span class=\"s3\">Pour les salari\u00e9s toujours pr\u00e9sents dans l\u2019entreprise\u00a0: le d\u00e9lai de prescription est de 2 ans<span class=\"Apple-converted-space\">\u00a0<\/span><\/span><\/li>\n<li class=\"li2\"><span class=\"s3\">Pour les salari\u00e9s qui ne font plus partie des effectifs de l\u2019entreprise, le d\u00e9lai de prescription est de 3 ans.
