L\u2019article R1221-34 du Code du travail les reprend \u00e9galement. Elles proviennent de la loi DDADUE n\u00b02023-171 du 9 mars 2023, qui adapte le droit fran\u00e7ais au droit europ\u00e9en et confirme ou renforce les informations que l&rsquo;entreprise doit transmettre aux salari\u00e9s.<\/p>\n<p>Ces dispositions s&rsquo;appliquent en entreprise depuis le 1er novembre 2023. Il s\u2019agit cependant pour la plupart d\u2019informations d\u00e9j\u00e0 incluses dans les contrats de travail depuis longtemps.<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, <strong>rappelle<\/strong> dans cet article toutes les informations que l\u2019entreprise <strong>doit<\/strong> donner, de mani\u00e8re individuelle, aux salari\u00e9s.<\/p>\n<p>Pr\u00e9sent\u00e9es lors du petit d\u00e9jeuner Valoxy du 21 Novembre dernier, les informations list\u00e9es ici vous aident \u00e0 mieux comprendre les r\u00e8gles applicables, (Voir le lien <a href=\"https:\/\/www.legifrance.gouv.fr\/eli\/decret\/2023\/10\/30\/MTRT2317355D\/jo\/texte\">Lien Legifrance<\/a>) et leur impact sur l\u2019entreprise.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Rappel sur les informations essentielles \u00e0 communiquer aux salari\u00e9s :<\/strong><\/h2>\n<ul>\n<li>\n<h4><strong>Au plus tard le 7\u00e8me jour calendaire \u00e0 compter de la date d\u2019embauche :<\/strong><\/h4>\n<ul>\n<li>L\u2019identit\u00e9 des parties \u00e0 la relation de travail,<\/li>\n<li>Le ou les lieu(x) de travail et, si elle diff\u00e8re, l\u2019adresse de l\u2019employeur<\/li>\n<li>L\u2019intitul\u00e9 du poste, les fonctions, la cat\u00e9gorie socioprofessionnelle ou d\u2019emploi,<\/li>\n<li>La date d\u2019embauche,<\/li>\n<li>En cas de contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e (CDD), la date de fin ou la dur\u00e9e pr\u00e9vue du contrat,<\/li>\n<li>La dur\u00e9e et les conditions de la p\u00e9riode d\u2019essai,<\/li>\n<li>Les \u00e9l\u00e9ments constitutifs de la r\u00e9mun\u00e9ration (y compris les majorations pour les heures suppl\u00e9mentaires), la p\u00e9riodicit\u00e9 et les modalit\u00e9s de paiement,<\/li>\n<li>La dur\u00e9e de travail, les conditions dans lesquelles le salari\u00e9 peut \u00eatre conduit \u00e0 effectuer des heures suppl\u00e9mentaires ou compl\u00e9mentaires, ainsi que, le cas \u00e9ch\u00e9ant, toute modalit\u00e9 concernant les changements d\u2019\u00e9quipe en cas d\u2019organisation du travail en \u00e9quipes successives alternantes.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>\n<h4><strong>Au plus tard un mois apr\u00e8s l\u2019embauche :<\/strong><\/h4>\n<ul>\n<li>L\u2019identit\u00e9 de l\u2019entreprise utilisatrice, lorsqu\u2019elle est connue et aussit\u00f4t qu\u2019elle l\u2019est pour les salari\u00e9s temporaires,<\/li>\n<li>Le droit \u00e0 la formation assur\u00e9 par l\u2019employeur (article L. 6321-1 du Code du travail)<\/li>\n<li>La dur\u00e9e des cong\u00e9s pay\u00e9s auxquels le salari\u00e9 a droit, (ou les modalit\u00e9s de calcul de cette dur\u00e9e),<\/li>\n<li>La proc\u00e9dure \u00e0 observer en cas de rupture du contrat (par l\u2019employeur et le salari\u00e9),<\/li>\n<li>Les conventions et accords collectifs applicables,<\/li>\n<li>Les r\u00e9gimes obligatoires de protection sociale compl\u00e9mentaire,<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>\n<h4><strong>Informations compl\u00e9mentaires \u00e0 donner avant leur d\u00e9part aux salari\u00e9s envoy\u00e9s \u00e0 l\u2019\u00e9tranger plus de quatre semaines cons\u00e9<\/strong><strong>cutives<\/strong><strong> :<\/strong><\/h4>\n<ul>\n<li>Les pays dans lesquels s\u2019effectue le travail \u00e0 l\u2019\u00e9tranger, et la dur\u00e9e pr\u00e9vue,<\/li>\n<li>La devise servant au paiement de la r\u00e9mun\u00e9ration,<\/li>\n<li>Le cas \u00e9ch\u00e9ant, les avantages en esp\u00e8ces et en nature li\u00e9s aux t\u00e2ches concern\u00e9es,<\/li>\n<li>Les renseignements aff\u00e9rents \u00e0 un rapatriement \u00e9ventuel, et ses conditions.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>\n<h4><strong>Informations compl\u00e9mentaires \u00e0 donner avant leur d\u00e9part aux travailleurs d\u00e9tach\u00e9s dans le cadre d<\/strong><strong>\u2019<\/strong><strong>une prestation de services dans un autre \u00c9tat de l<\/strong><strong>\u2019<\/strong><strong>Union europ\u00e9enne :<\/strong><\/h4>\n<ul>\n<li>La r\u00e9mun\u00e9ration \u00e0 laquelle ils ont droit en vertu du droit applicable de l\u2019Etat d\u2019accueil,<\/li>\n<li>Les allocations propres au d\u00e9tachement (s\u2019il y a lieu), et les modalit\u00e9s de remboursement des d\u00e9penses de voyage, de logement et de nourriture,<\/li>\n<li>L\u2019adresse du site internet national mis en place par l\u2019\u00c9tat d\u2019accueil.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Cet article vous a int\u00e9ress\u00e9 ?
