Quand s\u2019applique-t-elle ? Quelles sont les exon\u00e9rations possibles ? Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, revient sur la taxe d\u2019am\u00e9nagement.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Un imp\u00f4t local<\/strong><\/h3>\n<p>La taxe d\u2019am\u00e9nagement (TA) existe depuis 2012. C\u2019est un <strong>imp\u00f4<\/strong><strong>t local<\/strong><strong>, qui <\/strong>sert principalement \u00e0 financer des \u00e9quipements publics (r\u00e9seaux, voiries) indispensables aux futures constructions et am\u00e9nagements. Elle peut aussi servir aux investissements n\u00e9cessaires pour prot\u00e9ger le milieu naturel, la biodiversit\u00e9 et lutter contre le r\u00e9chauffement climatique. La taxe peut \u00e9galement \u00eatre utilis\u00e9e pour transformer en espaces naturels des terrains abandonn\u00e9s ou en friche.<\/p>\n<p>Elle sert \u00e0 financer la r\u00e9alisation des objectifs des Sch\u00e9mas de Coh\u00e9rences Territoriales (SCOT). Elle finance \u00e9galement le Conseil d&rsquo;Architecture, d&rsquo;Urbanisme et de l&rsquo;Environnement (CAUE).<\/p>\n<p>La TA remplace la taxe locale d&rsquo;\u00e9quipement (TLE) et la taxe d\u00e9partementale des espaces naturels sensibles (TDENS). Elle est per\u00e7ue, <strong>l\u2019ann\u00e9e de l\u2019op\u00e9ration taxable,<\/strong> par la <strong>commune<\/strong>, le <strong>d\u00e9partement<\/strong> et, en Ile-de-France seulement, par la <strong>r\u00e9<\/strong><strong>gion<\/strong><strong>.<\/strong><\/p>\n<p>Elle est due par les particuliers comme par les entreprises. (Voir aussi notre article <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/taxe-dhabitation\/\" target=\"_self\" rel=\"noopener\">La taxe d\u2019habitation<\/a>).<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Pour quels travaux ?<\/strong><\/h3>\n<p>Les <strong>op\u00e9rations de construction<\/strong>, de <strong>reconstruction<\/strong> ou d\u2019<strong>agrandissement de b\u00e2timents <\/strong>sont redevables de la taxe d\u2019am\u00e9nagement. De m\u00eame que l\u2019am\u00e9nagement ou l\u2019installation d\u2019un parking ext\u00e9rieur, d\u2019une piscine, d\u2019une \u00e9olienne, d\u2019emplacements de camping\u2026 Le changement de destination d&rsquo;un local exon\u00e9r\u00e9 en un local soumis \u00e0 la taxe (par exemple, transformer un local agricole en un logement) est \u00e9galement redevable de la taxe.<\/p>\n<p>D\u2019une fa\u00e7on g\u00e9n\u00e9rale, tous les travaux qui n\u00e9cessitent l&rsquo;obtention d\u2019une autorisation d\u2019urbanisme (permis de construire, permis d\u2019am\u00e9nager, autorisation pr\u00e9alable) sont redevables de la taxe. En cas de construction ou d&rsquo;am\u00e9nagement sans autorisation, ou en\u00a0 cas d\u2019infraction \u00e0 l&rsquo;autorisation accord\u00e9e, il faudra \u00e9galement s\u2019acquitter de la taxe.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Quelles surfaces de construction<\/strong><strong> ?<\/strong><\/h3>\n<p>Toute cr\u00e9ation de surface de plancher close et couverte, \u00a0<strong>y compris les combles et les caves<\/strong>, dont la superficie est sup\u00e9rieure \u00e0 5 m\u00b2<sup>\u00a0<\/sup>et dont la hauteur de plafond \u00e9gale ou d\u00e9passe 1,80 m\u00e8tre.<\/p>\n<p>La surface taxable se calcule \u00e0 partir de la somme des <strong>surfaces de plancher<\/strong> <strong>de chaque niveau, <\/strong>calcul\u00e9 \u00e0 partir du <strong>nu int\u00e9rieur des fa\u00e7<\/strong><strong>ades<\/strong>, sans prise en compte<\/p>\n<ul>\n<li>de l\u2019\u00e9paisseur des murs tourn\u00e9s vers l\u2019ext\u00e9rieur,<\/li>\n<li>des vides et des tr\u00e9mies (les espaces r\u00e9serv\u00e9s sur un plancher pour installer les escalier, chemin\u00e9e,\u00a0 ascenseur, etc.).<\/li>\n<\/ul>\n<p>Les abris de jardin (m\u00eame d\u00e9montables) ou toute autre annexe construite \u00e0 l\u2019ext\u00e9rieur d\u2019une maison entrent aussi dans le champ de la taxe d&rsquo;am\u00e9nagement.<\/p>\n<p>Les constructions non couvertes comme les terrasses, ou ouvertes sur l\u2019ext\u00e9rieur comme les pergolas et les tonnelles, sont exclues de la surface taxable.<\/p>\n<p>Certains am\u00e9nagements comme les piscines, bien qu&rsquo;exclus de la surface taxable, sont soumis, <strong>de fa\u00e7on forfaitaire<\/strong>, \u00e0 la taxe d&rsquo;am\u00e9nagement.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Quel est le taux de la taxe ?<\/strong><\/h3>\n<p>Le taux global de la taxe repr\u00e9sente la somme des taux communaux et d\u00e9partementaux, auquel il faut rajouter le taux r\u00e9gional en Ile de France.<\/p>\n<p>La part communale varie entre 1 % \u00e0 5 %. Il peut n\u00e9anmoins atteindre 20 % dans certains secteurs, quand l\u2019am\u00e9nagement d\u2019\u00e9quipements publics g\u00e9n\u00e9raux entra\u00een\u00e9s par les nouvelles constructions l\u2019exige.<\/p>\n<p>Le taux d\u00e9partemental est le m\u00eame pour tout le d\u00e9partement, et ne d\u00e9passe pas 2,5 % (taux maximum).<\/p>\n<p>En Ile de France, l<strong>e taux de la part r\u00e9<\/strong><strong>gionale<\/strong> (fix\u00e9 par le Conseil r\u00e9gional) peut diff\u00e9rer d&rsquo;un d\u00e9partement \u00e0 l\u2019autre, dans la limite de 1\u00a0%.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Calcul<\/strong><strong> de la taxe d&rsquo;am\u00e9nagement<\/strong><\/h3>\n<p>Le montant de la taxe d\u2019am\u00e9nagement est le produit de la <strong>surface taxable <\/strong>de la construction cr\u00e9\u00e9e par la <strong>valeur annuelle <\/strong>par <strong>m\u00b2<\/strong>, qu\u2019il faut ensuite multiplier par la somme des <strong>taux vot\u00e9s par les collectivit\u00e9s<\/strong><strong> territoriale<\/strong><strong>s<\/strong> concern\u00e9es.<\/p>\n<p><strong>Pour l\u2019ann\u00e9e 2026 <\/strong>:<br \/>\n\u2022\u00a0<strong>hors \u00cele-de-France<\/strong>, la valeur annuelle par m<sup>2<\/sup> est de <strong>892 euros<\/strong>,<br \/>\n\u2022 <strong>en \u00cele-de-France<\/strong>, la valeur annuelle par m<sup>2<\/sup> est de <strong>1 011 euros<\/strong>.<\/p>\n<p>(En 2025, la valeur annuelle par m\u00b2 \u00e9tait de 930 \u20ac en province et de 1 054 \u20ac en \u00cele-de-France. (contre 914 et 1 036 \u20ac en 2024, et 886 et 1004 \u20ac en 2023).<\/p>\n<p>La taxe de certains travaux d&rsquo;am\u00e9nagement (piscine, place de parking, places de camping,\u2026) se calcule selon d&rsquo;autres formules (forfaitaire, \u00e0 l\u2019unit\u00e9, etc.), sur lesquelles s\u2019appliquent les taux communal, d\u00e9partemental (et r\u00e9gional le cas \u00e9ch\u00e9ant). Ainsi,<\/p>\n<ul>\n<li>une piscine sera tax\u00e9e forfaitairement \u00e0 250 \u20ac par <strong>m\u00b2<\/strong>,<\/li>\n<li>l\u2019\u00e9olienne de plus de 12 m\u00e8tres 3 000 \u20ac l\u2019unit\u00e9,<\/li>\n<li>une aire de stationnement ext\u00e9rieure entre 2 500 et 5 000 \u20ac,<\/li>\n<li>un emplacement de tente, de caravane et r\u00e9sidence mobile de loisirs sur un terrain de camping ou une aire naturelle de camping 3 000 \u20ac par emplacement.<\/li>\n<\/ul>\n<p>Le Minist\u00e8re charg\u00e9 de l\u2019urbanisme propose une <a href=\"https:\/\/www.ecologie.gouv.fr\/sites\/default\/files\/Fiche%20d%E2%80%99aide%20pour%20le%20calcul%20de%20la%20surface%20de%20plancher.pdf\">fiche d&rsquo;aide au calcul de la taxe d&rsquo;am\u00e9nagement (TA)<\/a><\/p>\n<p>Le Minist\u00e8re de la transition \u00e9cologique et de la coh\u00e9sion des territoires a \u00e9labor\u00e9 un <a href=\"https:\/\/www.ecologie.gouv.fr\/\">simulateur de la taxe d&rsquo;am\u00e9nagement<\/a> permettant de calculer le montant de la taxe.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Qui paye la taxe et quand ?<\/strong><\/h3>\n<p>Le b\u00e9n\u00e9ficiaire de l\u2019autorisation d\u2019urbanisme, du transfert d&rsquo;une autorisation, ou le\u00a0 responsable d&rsquo;une construction ill\u00e9gale est redevable de la taxe, exigible, selon les cas, \u00e0 l\u2019une des dates suivantes :<\/p>\n<ul>\n<li>d\u00e9livrance du permis de construire ou d\u2019am\u00e9nager,<\/li>\n<li>d\u00e9livrance du permis modificatif,<\/li>\n<li>origine d&rsquo;un permis tacite de construire ou d\u2019am\u00e9nager,<\/li>\n<li>d\u00e9cision de non-opposition \u00e0 une d\u00e9claration pr\u00e9alable,<\/li>\n<li>proc\u00e8s-verbal constatant l&rsquo;ach\u00e8vement des constructions r\u00e9alis\u00e9es sans autorisation (ou en infraction).<\/li>\n<\/ul>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>R\u00e9ductions et exon\u00e9rations possibles<\/strong><\/h3>\n<p>Certaines constructions ouvrent droit \u00e0 un abattement de 50\u00a0%. Il s\u2019agit \u00a0notamment des\u00a0:<\/p>\n<ul>\n<li>100 premiers m\u00b2\u00a0d&rsquo;un local et ses annexes \u00e0 usage d&rsquo;habitation principale,<\/li>\n<li>locaux \u00e0 usage d&rsquo;habitation et d&rsquo;h\u00e9bergement <strong>aid<\/strong><strong>\u00e9s<\/strong>. Un logement ou h\u00e9bergement social financ\u00e9 par un pr\u00eat locatif aid\u00e9 de l&rsquo;\u00c9tat (PLUS, PSLA, PLS, et LLT et LES dans les DOM) peut \u00eatre exon\u00e9r\u00e9 de tout ou partie de la taxe selon les d\u00e9cisions prises par les collectivit\u00e9s territoriales,<\/li>\n<li>locaux \u00e0 usage industriel ou artisanal et leurs annexes,<\/li>\n<li>entrep\u00f4ts et hangars non ouverts au public faisant l&rsquo;objet d&rsquo;une exploitation commerciale,<\/li>\n<li>parcs de stationnement couverts faisant l&rsquo;objet d&rsquo;une exploitation commerciale.<\/li>\n<\/ul>\n<p>Le Code de l\u2019urbanisme pr\u00e9voit \u00e9galement des exon\u00e9rations, notamment pour les \u00a0am\u00e9nagements suivants\u00a0:<\/p>\n<ul>\n<li>petits abris de jardin ou toute autre construction d&rsquo;une superficie inf\u00e9rieure ou \u00e9gale \u00e0 5 m\u00b2\u00a0non soumis \u00e0 d\u00e9claration pr\u00e9alable ou \u00e0 permis de construire,<\/li>\n<li>reconstruction \u00e0 l&rsquo;identique d&rsquo;un b\u00e2timent d\u00e9truit depuis moins de 10 ans \u00e0 la suite d&rsquo;un sinistre,<\/li>\n<li>constructions et am\u00e9nagements prescrits par un plan de pr\u00e9vention des risques sous certaines conditions.<\/li>\n<\/ul>\n<p>Enfin, les collectivit\u00e9s locales, sur d\u00e9lib\u00e9ration, peuvent d\u00e9cider de certaines exon\u00e9rations (facultatives), par exemple :<\/p>\n<ul>\n<li>les abris de jardin, pigeonniers et colombiers, d&rsquo;une superficie sup\u00e9rieure \u00e0 5 m\u00b2 et inf\u00e9rieure ou \u00e9gale \u00e0 20 m\u00b2, soumis \u00e0 autorisation pr\u00e9alable,<\/li>\n<li>des surfaces de constructions sup\u00e9rieures \u00e0 100 m\u00b2\u00a0pour la r\u00e9sidence principale financ\u00e9e par un <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/pret-a-taux-zero\/\" target=\"_self\" rel=\"noopener\">pr\u00eat \u00e0 taux z\u00e9ro<\/a>.<\/li>\n<li>les immeubles class\u00e9s monument historique ou inscrits \u00e0 l&rsquo;inventaire suppl\u00e9mentaire,<\/li>\n<li>les commerces de d\u00e9tail dont la surface de vente est inf\u00e9rieure \u00e0 400 m\u00b2,<\/li>\n<li>des maison de sant\u00e9,<\/li>\n<li>etc.<\/li>\n<\/ul>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>D\u00e9claration et paiement de la taxe d&rsquo;am\u00e9nagement<\/strong><\/h3>\n<p>La d\u00e9claration des \u00e9l\u00e9ments n\u00e9cessaires au calcul de la taxe se fait \u00e0 l&rsquo;occasion du d\u00e9p\u00f4t du permis de construire, d&rsquo;am\u00e9nagement ou de la d\u00e9claration pr\u00e9alable.<\/p>\n<p>Pour les demandes d\u2019autorisations d\u2019urbanisme d\u00e9pos\u00e9es depuis le 1er septembre 2022, la Direction d\u00e9partementale ou r\u00e9gionale des Finances publiques \u00e9tablit la taxe, et l\u2019adresse au redevable dans les 90 jours suivant l\u2019ach\u00e8vement des travaux.<\/p>\n<p>Lorsque le montant de la taxe d\u00e9passe<strong> 1 500\u00a0\u20ac<\/strong>, il est possible de la r\u00e9gler en deux fois, 90 jours et 9 mois apr\u00e8s l\u2019ach\u00e8vement des travaux.<\/p>\n<p>La taxe d\u2019am\u00e9nagement des demandes d\u00e9pos\u00e9es avant le 1er septembre 2022 reste \u00e9tablie par la Direction d\u00e9partementale des territoires (DDT) ou la Direction r\u00e9gionale et interd\u00e9partementale de l\u2019environnement, de l\u2019am\u00e9nagement et des transports (DRIEAT) en \u00cele-de-France.<\/p>\n<p>Cet article vous a int\u00e9ress\u00e9 ?
