La jurisprudence de p<span class=\"s1\">lusieurs<\/span> arr\u00eats de la Cour de cassation rendus le 13 septembre 2023 appellent \u00e0 la mise en conformit\u00e9 du droit fran\u00e7ais avec le droit europ\u00e9en sur la prise en compte de ces p\u00e9riodes.<\/p>\n<p>Ces arr\u00eats marquent la volont\u00e9 de la Cour de <em>\u00ab garantir une meilleure effectivit\u00e9 des droits des salari\u00e9s \u00e0 leurs cong\u00e9s pay\u00e9s \u00bb. <\/em><span class=\"s1\">Ce revirement de jurisprudence va avoir des <\/span>cons\u00e9quences importantes pour les entreprises, en fixant de nouvelles r\u00e8gles pour l\u2019acquisition des cong\u00e9s.<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, reprend dans cet article les principaux points de cette nouvelle jurisprudence.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Droits \u00e0 cong\u00e9s et maladie non professionnelle<\/strong><\/h3>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020826#:~:text=Version%20en%20vigueur%20depuis%20le%2010%20ao%C3%BBt%202016,-Modifi%C3%A9%20par%20LOI&amp;text=Le%20salari%C3%A9%20a%20droit%20%C3%A0,peut%20exc%C3%A9der%20trente%20jours%20ouvrables.\">Les articles L. 3143-3 et suivants du code du travail<\/a> posent le principe qu\u2019un salari\u00e9 atteint d\u2019une maladie non professionnelle, ou victime d&rsquo;un accident non professionnel n\u2019acquiert pas de jours de cong\u00e9 pay\u00e9 pendant le temps de son arr\u00eat de travail.\u00a0 Certaines conventions ou accords d\u2019entreprises pouvaient cependant accorder des droits \u00e0 cong\u00e9s pendant ces p\u00e9riodes d\u2019arr\u00eat. Le droit de l\u2019Union europ\u00e9enne, au contraire, affirme que l\u2019absence du salari\u00e9 en raison de son \u00e9tat de sant\u00e9 ne doit <strong>pas avoir d<\/strong><strong>\u2019<\/strong><strong>impact<\/strong><strong>\u00a0<\/strong>sur <a href=\"https:\/\/valoxy.org\/blog\/conges-payes\/\">le calcul de ses droits \u00e0 cong\u00e9s<\/a>. La Cour de Justice de l\u2019Union europ\u00e9enne (CJUE) ne fait aucune distinction, en ce qui concerne la p\u00e9riode de r\u00e9f\u00e9rence, entre les travailleurs qui sont absents pour maladie et ceux qui ont effectivement travaill\u00e9.<\/p>\n<p class=\"p1\">Jusqu\u2019\u00e0 pr\u00e9sent, la Cour de cassation appliquait le droit fran\u00e7ais. Mais le 13 septembre 2023, elle a op\u00e9r\u00e9 un revirement de jurisprudence, en suivant la position de la CJUE. Elle s\u2019appuie pour cela sur l\u2019article 31\u00a72 de la Charte des droits fondamentaux de l\u2019Union europ\u00e9enne relatif au droit au repos, et \u00e9carte les dispositions du droit fran\u00e7ais qui ne sont pas conformes au droit de l\u2019Union europ\u00e9enne. <em>\u00ab\u00a0Le droit au cong\u00e9 annuel pay\u00e9 <\/em><em>conf<\/em><em>\u00e9r\u00e9 par cette directive \u00e0 tous les travailleurs ne peut \u00eatre subordonn\u00e9 par un Etat membre \u00e0 l<\/em><em>\u2019<\/em><em>obligation d<\/em><em>\u2019<\/em><em>avoir effectivement travaill\u00e9 pendant la p\u00e9riode de r\u00e9f\u00e9rence \u00e9tablie par ledit Etat\u00a0\u00bb. (D\u00e9cision de la CJUE du 20\/01\/2009)<\/em><\/p>\n<p class=\"p1\">Cette d\u00e9cision aura un impact tr\u00e8s important pour les entreprises, puisque la Cour de cassation admet d\u00e9sormais que les salari\u00e9s qui sont en arr\u00eat de travail pour maladie non professionnelle continuent d\u2019acqu\u00e9rir des jours de cong\u00e9s.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Droits \u00e0 cong\u00e9s et <\/strong><strong>accident du travail<\/strong><\/h3>\n<p>Dans le droit fran\u00e7ais, l\u2019indemnit\u00e9 compensatrice de cong\u00e9 pay\u00e9 en cas d\u2019<a href=\"https:\/\/valoxy.org\/blog\/declarer-accident-travail\/\">accident du travail<\/a> ou de maladie professionnelle se limite \u00e0 une seule ann\u00e9e de suspension du contrat de travail. Le droit de l\u2019Union europ\u00e9enne, au contraire, fait b\u00e9n\u00e9ficier le salari\u00e9 d\u2019un droit \u00e0 cong\u00e9 pay\u00e9 qui couvre l\u2019int\u00e9gralit\u00e9 de son arr\u00eat de travail.<\/p>\n<p>Comme dans le cas pr\u00e9c\u00e9dent, la Cour de cassation, s\u2019appuyant sur l\u2019article 31\u00a72 de la Charte des droits fondamentaux de l\u2019Union europ\u00e9enne relatif au droit au repos, \u00e9carte les dispositions du droit fran\u00e7ais non conformes au droit de l\u2019Union europ\u00e9enne. Elle juge ainsi qu\u2019en cas d\u2019accident du travail ou de maladie professionnelle, l\u2019indemnit\u00e9 compensatrice de cong\u00e9 pay\u00e9 ne peut \u00eatre limit\u00e9e \u00e0 un an.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Droits \u00e0 CP <\/strong><strong>et cong\u00e9 <\/strong><strong>parental d<\/strong><strong>\u2019\u00e9ducation<\/strong><\/h3>\n<p>La d\u00e9cision de b\u00e9n\u00e9ficier du <a href=\"https:\/\/valoxy.org\/blog\/le-conge-parental-deducation\/\">cong\u00e9 parental d\u2019\u00e9ducation<\/a> s\u2019impose \u00e0 l\u2019employeur. Pour cette raison, la jurisprudence fran\u00e7aise refusait jusqu\u2019\u00e0 pr\u00e9sent aux salari\u00e9s le b\u00e9n\u00e9fice d\u2019une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s \u00e0 l\u2019issue de leur cong\u00e9 parental.<\/p>\n<p>Cette r\u00e8gle est contraire au droit social europ\u00e9en sur les cong\u00e9s pay\u00e9s et \u00e0 l\u2019accord-cadre sur le cong\u00e9 parental figurant en annexe de la directive europ\u00e9enne du 8 mars 2010.<\/p>\n<p>La Cour de Cassation juge d\u00e9sormais qu\u2019un salari\u00e9 peut b\u00e9n\u00e9ficier de l\u2019indemnit\u00e9 compensatrice des cong\u00e9s pay\u00e9s non pris du fait de son cong\u00e9 parental. Les cong\u00e9s pay\u00e9s acquis au d\u00e9but de celui-ci doivent donc se reporter apr\u00e8s la reprise du travail.<\/p>\n<p class=\"p1\">Ce revirement de jurisprudence venant bouleverser les pratiques entra\u00eene plusieurs questions, et notamment la question suivante :<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">\n<h4><b>A partir de quand appliquer cette mesure\u00a0?<span class=\"Apple-converted-space\">\u00a0<\/span><\/b><\/h4>\n<\/li>\n<\/ul>\n<p class=\"p3\">Il convient d\u2019appliquer cette jurisprudence d\u00e8s maintenant. Un employeur ne peut donc pas refuser au salari\u00e9 en arr\u00eat maladie l\u2019acquisition de ses cong\u00e9s sous pr\u00e9texte que le Code du travail ne pr\u00e9voit pas (encore) cette r\u00e8gle. Dans une telle situation, si le salari\u00e9 saisissait une juridiction, il est fort probable que l\u2019employeur n\u2019ait pas gain de cause.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p class=\"p1\">Pour les ann\u00e9es ant\u00e9rieures, il est sans doute pr\u00e9f\u00e9rable de r\u00e9gulariser. Il est \u00e9galement possible d\u2019attendre que le salari\u00e9 demande \u00e0 r\u00e9gulariser sa situation.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<ul>\n<li>\n<h4><b>Sur quelles bases calculer le droit \u00e0 cong\u00e9s ?<\/b><\/h4>\n<\/li>\n<\/ul>\n<p>La directive europ\u00e9enne ne porte cependant que sur une base de droits \u00e0 cong\u00e9s de 4 semaines par an, et non pas cinq. Il faudra donc encore attendre une d\u00e9cision du Conseil constitutionnel, qui devra d\u00e9cider (principe d&rsquo;\u00e9galit\u00e9) si la r\u00e9f\u00e9rence doit s&rsquo;appuyer &#8211; ou non &#8211; sur les cinq semaines du Code du travail. Et un co\u00fbt toujours sup\u00e9rieur pour les entreprises.<\/p>\n<ul>\n<li>\n<h4>Accumulation des cong\u00e9s non pris<\/h4>\n<\/li>\n<\/ul>\n<p>Un salari\u00e9 qui aura accumul\u00e9 des jours de cong\u00e9 pendant son cong\u00e9 maladie (p\u00e9riode de r\u00e9f\u00e9rence entre le 1<sup>er<\/sup> juin et le 31 mai) aura 15 mois pour les prendre, faute de quoi ces jours seront perdus.<\/p>\n<p>Cet article sur les droits \u00e0 cong\u00e9s pay\u00e9s vous a int\u00e9ress\u00e9 ?
