Qu\u2019est-ce qui pousse un salari\u00e9 \u00e0 l\u2019abandon de poste, sans se soucier de pr\u00e9venir ses coll\u00e8gues ou ses sup\u00e9rieurs de son absence ?<\/p>\n<p>Que faire en cas d\u2019abandon de poste ? Doit-on licencier le salari\u00e9 ? Que dit le Code du Travail ? Que pr\u00e9voit la loi ?\u00a0 \u00a0Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, revient dans cet article sur le traitement de l\u2019abandon de poste.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Qu\u2019est-ce que l\u2019abandon de poste ?<\/strong><\/h2>\n<p>Le code du Travail consid\u00e8re qu\u2019un salari\u00e9 qui quitte son poste <strong>sans autorisation,<\/strong> ou qui ne revient plus au travail\u00a0sans avoir justifi\u00e9 &#8211; de quelque mani\u00e8re que ce soit &#8211; son absence, <strong>a abandonn\u00e9 son poste de travail<\/strong>.<\/p>\n<p>L&rsquo;abandon de poste se manifeste par le comportement du salari\u00e9 qui quitte son poste de travail sans autorisation de l\u2019employeur, ou qui s&rsquo;absente de mani\u00e8re prolong\u00e9e ou r\u00e9p\u00e9t\u00e9e sans justificatif pendant ses heures de travail. <strong>Attention !<\/strong> Il n&rsquo;y a pas abandon de poste, alors m\u00eame que le salari\u00e9 quitte son poste de travail sans autorisation de l\u2019employeur, pour les motifs suivants :<\/p>\n<ul>\n<li>consultation d&rsquo;un m\u00e9decin justifi\u00e9e par son \u00e9tat de sant\u00e9,<\/li>\n<li>d\u00e9c\u00e8s d&rsquo;un proche,<\/li>\n<li>et en cas de <a href=\"https:\/\/valoxy.org\/blog\/droit-de-retrait\/\">droit de retrait<\/a>.<\/li>\n<\/ul>\n<p>Le bon sens aurait voulu que cet abandon soit consid\u00e9r\u00e9 comme une d\u00e9mission. Mais, jusqu\u2019\u00e0 pr\u00e9sent, l\u2019employeur n\u2019avait d\u2019autre choix que d\u2019utiliser la proc\u00e9dure de <strong>licenciement pour faute grave<\/strong>. (Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/6-modeles-de-lettres-de-licenciement-decret-2017-1820\/\">Les 6 mod\u00e8les de lettre de licenciement<\/a>).<\/p>\n<p>La loi pr\u00e9voit dor\u00e9navant une proc\u00e9dure sp\u00e9cifique, qui pourra aboutir \u00e0 une pr\u00e9somption de d\u00e9mission.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014<\/span><strong>La loi du 21 d\u00e9cembre 2022<\/strong><\/h2>\n<p>Aux termes de la <a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046771781\">loi du 21 d\u00e9cembre 2022<\/a>, le salari\u00e9 s\u2019expose en effet, en cas d\u2019abandon de poste, \u00e0 une mise\u00a0en demeure de la part de l\u2019employeur, qui entra\u00eene sa d\u00e9mission, s\u2019il n\u2019y r\u00e9pond pas. Cette mise en demeure demande au salari\u00e9 :<\/p>\n<ul>\n<li>de justifier son absence,<\/li>\n<li>et de reprendre son poste dans un certain d\u00e9lai, qui ne pourra pas \u00eatre inf\u00e9rieur \u00e0\u00a0<strong>15 jours calendaires<\/strong>. Et<em> \u00ab\u00a0ce d\u00e9lai commence \u00e0 courir \u00e0 compter de la premi\u00e8re pr\u00e9sentation de la mise en demeure adress\u00e9e par lettre recommand\u00e9e ou lettre remise en main propre contre d\u00e9charge\u00a0\u00bb,<\/em> pr\u00e9cise le d\u00e9cret.<\/li>\n<\/ul>\n<p>A d\u00e9faut de r\u00e9ponse dans ce d\u00e9lai, le salari\u00e9 <strong>sera pr\u00e9sum\u00e9 avoir d\u00e9missionn\u00e9<\/strong>.<\/p>\n<p>La loi cr\u00e9e l\u2019article R.1237-13 du code du travail qui stipule que <em>\u00ab\u00a0lorsque l\u2019employeur constate que le salari\u00e9 a abandonn\u00e9 volontairement son poste,<strong>\u00a0<\/strong>il peut, par lettre recommand\u00e9e ou par lettre remise en main propre contre d\u00e9charge, mettre en demeure le salari\u00e9 de reprendre son poste\u00a0\u00bb<\/em>.<\/p>\n<p>L\u2019employeur a donc toujours la possibilit\u00e9 de proc\u00e9der \u00e0 un licenciement pour faute grave en cas d\u2019abandon de poste.<\/p>\n<p>Le d\u00e9cret d\u2019application n\u00b0 2023-275 du 17 avril 2023 sur la mise en \u0153uvre de la pr\u00e9somption de d\u00e9mission en cas d&rsquo;abandon de poste volontaire du salari\u00e9 a \u00e9t\u00e9 publi\u00e9 au JO, et permet \u00e0 cette nouvelle proc\u00e9dure d\u2019entrer en vigueur.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014<\/span><strong>Cons\u00e9quences pour le salari\u00e9<\/strong><\/h2>\n<p>Jusqu\u2019\u00e0 pr\u00e9sent, dans le cas d\u2019un licenciement pour faute suite \u00e0 un abandon de poste,\u00a0le salari\u00e9 obtient des droits aupr\u00e8s de P\u00f4le emploi, y compris le paiement de ses <a href=\"https:\/\/valoxy.org\/blog\/les-conges-payes\/\">cong\u00e9s pay\u00e9s<\/a>. En somme, l\u2019abandon de poste \u00e9tait une mani\u00e8re de quitter son employeur tout en b\u00e9n\u00e9ficiant des indemnit\u00e9s ch\u00f4mage\u2026.<\/p>\n<p>Le salari\u00e9 ne per\u00e7oit pas de salaire, et son absence suspend son contrat de travail.<\/p>\n<p>Avec la nouvelle loi, le salari\u00e9 qui ne reprendrait pas son travail \u00e0 l\u2019issue des 15 jours suivant la r\u00e9ception de la mise en demeure de l\u2019employeur sera pr\u00e9sum\u00e9 avoir d\u00e9missionn\u00e9. Cela le privera de son droit \u00e0 l\u2019indemnisation ch\u00f4mage.<\/p>\n<p>Cependant, cette pr\u00e9somption de d\u00e9mission est une \u201cpr\u00e9somption simple\u201d, et le salari\u00e9 garde la facult\u00e9 de la contester devant le conseil de <a href=\"https:\/\/valoxy.org\/blog\/les-prudhommes\/\">prud\u2019hommes<\/a>.
