Depuis plusieurs ann\u00e9es en effet, les partenaires sociaux de la branche n\u00e9gocient pour uniformiser leurs pratiques r\u00e9gionales. Ils sont parvenus \u00e0 un accord de branche le 7 f\u00e9vrier 2022. Toutes les entreprises de la branche ont l\u2019obligation de souscrire \u00e0 des garanties frais de sant\u00e9, incapacit\u00e9, invalidit\u00e9 et d\u00e9c\u00e8s au moins \u00e9gales aux dispositions sign\u00e9es par les partenaires sociaux.<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, d\u00e9taille dans cet article ces nouvelles obligations de pr\u00e9voyance et sant\u00e9 dans la m\u00e9tallurgie.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Le r\u00e9gime de pr\u00e9voyance\u00a0<\/strong><\/h2>\n<p>L\u2019accord de branche fixe\u00a0:<\/p>\n<ul>\n<li>Des garanties conventionnelles\u00a0;<\/li>\n<li>Des garanties optionnelles\u00a0;<\/li>\n<li>Les taux de cotisations et leur r\u00e9partition entre les parts salariale et patronale.<\/li>\n<\/ul>\n<p>Tous les salari\u00e9s (cadres et non-cadres) doivent \u00eatre couverts par une garantie qui couvre \u00e0 la fois un capital d\u00e9c\u00e8s, une rente d\u2019\u00e9ducation, l\u2019incapacit\u00e9 temporaire et l\u2019incapacit\u00e9 permanente professionnelle.<\/p>\n<p>La diff\u00e9rence se fait au niveau des prestations. <em>Par exemple,<\/em> un cadre b\u00e9n\u00e9ficiera d\u2019un capital d\u00e9c\u00e8s \u00e9gal \u00e0 200% du salaire annuel brut alors qu\u2019un non-cadre b\u00e9n\u00e9ficiera d\u2019un capital d\u00e9c\u00e8s \u00e9gal \u00e0 100%.<\/p>\n<p>Les taux d\u2019appel (selon les taux fournis par l\u2019UIMM) sont \u00e9galement diff\u00e9rents en fonction des coll\u00e8ges\u00a0:<\/p>\n<ul>\n<li>Pour les cadres\u00a0:\n<ul>\n<li>1,021% sur la tranche 1<\/li>\n<li>1,743% sur la tranche 2<\/li>\n<\/ul>\n<\/li>\n<li>Pour les non-cadres\u00a0:\n<ul>\n<li>1,849% sur la tranche 1<\/li>\n<li>1,849% sur la tranche 2<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4><strong>Attention\u00a0!<\/strong><\/h4>\n<p>Si, du fait de l\u2019absence de garantie de pr\u00e9voyance obligatoire dans la soci\u00e9t\u00e9, le salari\u00e9 ne per\u00e7oit pas les prestations auxquelles il aurait pu pr\u00e9tendre en vertu du r\u00e9gime conventionnel, le juge peut condamner l\u2019employeur \u00e0 indemniser le salari\u00e9 \u00e0 hauteur des prestations non per\u00e7ues.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Le r\u00e9gime frais de sant\u00e9 (mutuelle)<\/strong><\/h2>\n<p>L\u2019accord de branche fixe\u00a0:<\/p>\n<ul>\n<li>Des garanties conventionnelles\u00a0;<\/li>\n<li>Des garanties additionnelles\u00a0;<\/li>\n<li>Les taux de cotisations.<\/li>\n<\/ul>\n<p>Il n\u2019y a pas de distinction entre les cadres et les non-cadres.<\/p>\n<p>En revanche, il y a une distinction entre les d\u00e9partements. En effet, l\u2019accord diff\u00e9rencie 3 zones tarifaires (basse, moyenne et haute) pour les cotisations \u201csant\u00e9\u201d. Chaque zone se voit appliquer un taux diff\u00e9rent pour la cotisation contractuelle.<\/p>\n<p>L\u2019accord pr\u00e9voit aussi la possibilit\u00e9 pour l\u2019employeur d\u2019ouvrir des structures de cotisations diff\u00e9rentes\u00a0:<\/p>\n<ul>\n<li>Salari\u00e9 seul, o\u00f9 l\u2019adh\u00e9sion du conjoint et des enfants est facultative\u00a0;<\/li>\n<li>Salari\u00e9 seul ou Famille ;<\/li>\n<li>Salari\u00e9 seul ou Duo ou Famille ;<\/li>\n<li>Famille ;<\/li>\n<li>Salari\u00e9 et enfant(s), o\u00f9 l\u2019adh\u00e9sion du conjoint est facultative.<\/li>\n<\/ul>\n<p>L\u2019entreprise a \u00e9galement la possibilit\u00e9 de souscrire des options \u00e0 titre facultatif ou obligatoire (2 options possibles)\u00a0:<\/p>\n<ul>\n<li>Base conventionnelle + Option 1 ou 2 \u00e0 titre facultatif\u00a0;<\/li>\n<li>Base conventionnelle avec Option 1 obligatoire + option 2 facultative ;<\/li>\n<li>Base conventionnelle avec Option 2 obligatoire.<\/li>\n<\/ul>\n<p>Les taux sont diff\u00e9rents en fonction de la structure choisie et de la mise en place ou non des options.<\/p>\n<p>Enfin, les partenaires sociaux ont pr\u00e9vu la possibilit\u00e9 pour le salari\u00e9 de b\u00e9n\u00e9ficier d\u2019une dispense de mutuelle s\u2019il entre dans un des cas pr\u00e9vus par l\u2019accord.<\/p>\n<h4><strong>Attention\u00a0!<\/strong><\/h4>\n<p>En l\u2019absence de contrat frais de sant\u00e9 obligatoire, le salari\u00e9 peut r\u00e9clamer le remboursement des frais de sant\u00e9 qu&rsquo;il aurait assur\u00e9. De plus, en cas de contr\u00f4le URSSAF, l\u2019entreprise peut subir un redressement.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Le label C\u0153ur Industrie<\/strong><\/h2>\n<p>Afin d\u2019aider les entreprises dans leur choix d\u2019un assureur, la branche a cr\u00e9\u00e9 une marque\u00a0: \u00ab\u00a0C\u0153ur industrie\u00a0\u00bb.<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-full wp-image-62427\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2022\/12\/image1-1.png\" alt=\"\" width=\"283\" height=\"101\" \/><\/p>\n<p>Ce logo permet d\u2019identifier rapidement les organismes assureurs dont l\u2019offre est labellis\u00e9e par le r\u00e9gime de branche.
