Les salari\u00e9s pourront en faire la demande, dans la limite de 10 000\u00a0\u20ac, d\u2019ici au 31 D\u00e9cembre 2022 au plus tard.<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, rappelle dans cet article ce qu\u2019est l\u2019\u00e9pargne salariale, et les conditions de ce d\u00e9blocage anticip\u00e9 de la participation et de l&rsquo;int\u00e9ressement.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>L\u2019\u00e9pargne salariale<\/strong><\/h2>\n<p>L&rsquo;\u00e9pargne salariale est un ensemble de dispositifs dont l&rsquo;objectif est<\/p>\n<ul>\n<li>de favoriser l\u2019\u00e9pargne financi\u00e8re des salari\u00e9s au travers d\u2019une \u00e9pargne collective dans l\u2019entreprise,<\/li>\n<li>d&rsquo;associer les salari\u00e9s aux r\u00e9sultats de leur entreprise. (Voir notre article <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/lepargne-salariale-et-le-partage-de-la-valeur\/\" target=\"_self\" rel=\"noopener\">L\u2019\u00e9pargne salariale et le partage de la valeur<\/a>).<\/li>\n<\/ul>\n<p>C\u2019est aussi un moyen de r\u00e9mun\u00e9ration suppl\u00e9mentaire, qui b\u00e9n\u00e9ficie d&rsquo;avantages fiscaux et sociaux. L\u2019\u00e9pargne salariale peut ainsi prendre la forme :<\/p>\n<ul>\n<li>d\u2019un PEE (Plan d\u2019\u00c9pargne Entreprise) pour une \u00e9pargne courte et relativement disponible,<\/li>\n<li>ou d\u2019un PERCO (Plan d\u2019\u00c9pargne Retraite Collectif), pour cr\u00e9er un compl\u00e9ment de retraite. (Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/le-nouveau-plan-depargne-retraite-per\/\">Le nouveau Plan d\u2019\u00c9pargne Retraite (PER)<\/a><\/li>\n<\/ul>\n<p>L\u2019\u00e9pargne salariale est aliment\u00e9e par les versements volontaires des salari\u00e9s, et par l\u2019abondement, c\u2019est \u00e0 dire une participation financi\u00e8re de l\u2019employeur vers\u00e9e en compl\u00e9ment des versements volontaires du salari\u00e9. Elle peut surtout recevoir les sommes issues de l\u2019int\u00e9ressement et de la participation. Cela en fait un outil complet de motivation et de fid\u00e9lisation des salari\u00e9s.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>L\u2019int\u00e9ressement, la performance collective<\/strong><\/h3>\n<p>Mis en place au travers d\u2019un accord d\u2019entreprise, l\u2019int\u00e9ressement fixe des crit\u00e8res quantitatifs ou qualitatifs \u00e0 atteindre collectivement. S\u2019ils sont atteints, ils g\u00e9n\u00e9reront une prime divisible entre l\u2019ensemble des salari\u00e9s de la structure.<\/p>\n<p><a href=\"https:\/\/valoxy.org\/blog\/comment-mettre-en-place-linteressement-dans-lentreprise\/\">La mise en place de l\u2019int\u00e9ressement dans l\u2019entreprise<\/a> est facultative, quel que soit l\u2019effectif.<\/p>\n<h3><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>La participation, un partage des b\u00e9n\u00e9fices<\/strong><\/h3>\n<p>La finalit\u00e9 de la\u00a0participation, obligatoire \u00e0 partir de 50 salari\u00e9s, est de partager le b\u00e9n\u00e9fice de l\u2019entreprise avec les salari\u00e9s, qu\u2019ils aient ou non r\u00e9alis\u00e9 leurs objectifs. D\u00e8s qu\u2019ils atteignent 5% des capitaux propres de l\u2019entreprise, une partie des b\u00e9n\u00e9fices doit \u00eatre redistribu\u00e9e aux salari\u00e9s, selon l\u2019accord collectif sign\u00e9.<\/p>\n<p>Au moment de leur versement, les montants d\u2019int\u00e9ressement et de participation seront affect\u00e9s dans un compte d\u2019\u00e9pargne salariale. Les sommes seront bloqu\u00e9es 5 ans, et exon\u00e9r\u00e9es d\u2019imp\u00f4t sur le revenu, mais supporteront les cotisations sociales (CSG, CRDS). Si le salari\u00e9 demande \u00e0 percevoir tout de suite l\u2019int\u00e9ressement et la participation, les montants vers\u00e9s seront soumis \u00e0 l\u2019imp\u00f4t sur le Revenu (IR).<\/p>\n<p>Les conditions de blocage de l\u2019\u00e9pargne salariale pr\u00e9voient des cas de sortie anticip\u00e9e, dont la liste s\u2019allonge au fil du temps. \u00c0 ce jour, la loi pr\u00e9voit dix motifs :<\/p>\n<ul>\n<li>La naissance,<\/li>\n<li>Le mariage ou pacs,<\/li>\n<li>Le divorce ou s\u00e9paration avec la garde d&rsquo;au moins un enfant,<\/li>\n<li>L\u2019invalidit\u00e9\u00a0ou d\u00e9c\u00e8s du salari\u00e9 ou de son conjoint,<\/li>\n<li><a href=\"https:\/\/valoxy.org\/blog\/pee-perco-deblocage-plan-epargne-entreprise-et-du-plan-depargne-pour-la-retraite-collectif-en-cas-de-surendettement-2\/\">Le d\u00e9blocage en cas de surendettement<\/a>,<\/li>\n<li><a href=\"https:\/\/valoxy.org\/blog\/pee-perco-deblocage-plan-epargne-entreprise\/\">Le d\u00e9blocage en cas de cr\u00e9ation ou reprise d\u2019une entreprise<\/a>,<\/li>\n<li>L\u2019acquisition de la r\u00e9sidence principale,<\/li>\n<li>Le changement de situation professionnelle (licenciement, cessation d&rsquo;activit\u00e9 d&rsquo;entrepreneur individuel, d\u00e9mission, etc.),<\/li>\n<li>La violence conjugale.<\/li>\n<\/ul>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Une possibilit\u00e9 de d\u00e9blocage\u00a0 exceptionnel de l\u2019\u00e9pargne salariale<\/strong><\/h2>\n<p>La commission des Affaires sociales du S\u00e9nat a introduit dans le projet \u201cpouvoir d\u2019achat\u201d un d\u00e9blocage exceptionnel anticip\u00e9 de l\u2019\u00e9pargne salariale. Les salari\u00e9s pourront en faire la demande d\u2019ici au 31 D\u00e9cembre 2022 au plus tard. Ainsi, tout salari\u00e9 qui le souhaite pourra d\u00e9bloquer sa participation ou son int\u00e9ressement :<\/p>\n<ul>\n<li>dans la limite de 10 000\u00a0\u20ac,<\/li>\n<li>sans que ce montant ne supporte l&rsquo;imp\u00f4t sur le revenu ni les cotisations sociales,<\/li>\n<li>et \u00e0 condition que la somme serve \u00e0 \u00ab\u00a0l&rsquo;acquisition de biens ou la fourniture de\u00a0services\u00bb, et ne soit pas \u00e9pargn\u00e9e ailleurs. Le salari\u00e9 tiendra \u201c\u00e0 la disposition de l&rsquo;administration fiscale\u201d les justificatifs attestant de l&rsquo;utilisation des montants ainsi d\u00e9bloqu\u00e9.<\/li>\n<\/ul>\n<p>Les sommes seront d\u00e9clar\u00e9es par l&rsquo;organisme gestionnaire, ou \u00e0 d\u00e9faut, par l\u2019employeur, \u00e0 l\u2019administration fiscale.<\/p>\n<p>Cependant, les montants plac\u00e9s dans un Plan d&rsquo;\u00e9pargne retraite collectif (Perco), ou dans des fonds solidaires ne peuvent en aucun cas \u00eatre d\u00e9bloqu\u00e9s pr\u00e9matur\u00e9ment.<\/p>\n<p>Il en va de m\u00eame pour l&rsquo;\u00e9pargne salariale investie en titres de l&rsquo;entreprise ou d&rsquo;une entreprise li\u00e9e. (sauf en cas d\u2019accord collectif pour lib\u00e9rer tout ou partie de cette \u00e9pargne).<\/p>\n<p>Les politiques, dans le but de donner un coup de pouce au pouvoir d\u2019achat, ont r\u00e9guli\u00e8rement utilis\u00e9 les d\u00e9blocages anticip\u00e9s de la participation et de l\u2019int\u00e9ressement. Ainsi de Jacques Chirac (en 1994, 1996 et 2004), de Nicolas Sarkozy (en 2008), et de Fran\u00e7ois Hollande en 2013.
