Ce cong\u00e9 fait suite \u00e0 une naissance ou une adoption, et interrompt ou r\u00e9duit l\u2019activit\u00e9 professionnelle du salari\u00e9.<\/p>\n<p>Quelles sont les conditions de ce cong\u00e9 ? Quelle est sa dur\u00e9e ? Quel impact a-t-il sur le contrat de travail ? Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, r\u00e9pond \u00e0 ces questions.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Objectifs du cong\u00e9 parental d&rsquo;\u00e9ducation<\/strong><\/h2>\n<p><span class=\"exergue\">Le <strong>cong\u00e9 parental d&rsquo;\u00e9ducation <\/strong>est un cong\u00e9 accord\u00e9 \u00e0 un parent suite \u00e0 la naissance ou l\u2019adoption d\u2019un enfant. Il a<\/span> clairement pour but d\u2019inciter l\u2019autre parent (le p\u00e8re, le plus souvent) \u00e0 prendre aussi un cong\u00e9 et d&rsquo;am\u00e9liorer ainsi la r\u00e9partition des responsabilit\u00e9s au sein des couples. Il permet enfin de favoriser le retour des femmes vers l\u2019emploi.<\/p>\n<p>Attention, il n\u2019est pas possible pour les parents de prendre leurs cong\u00e9s en m\u00eame temps. C\u2019est chacun son tour !<\/p>\n<p><span style=\"text-decoration: underline;\">Remarque<\/span> : les 2 parents peuvent prendre le cong\u00e9 parental en m\u00eame temps <b><span style=\"text-decoration: underline;\">uniquement <\/span><\/b>s\u2019ils r\u00e9duisent <b><span style=\"text-decoration: underline;\">tous les deux<\/span><\/b> leurs activit\u00e9s professionnelles.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Conditions<\/strong><\/h2>\n<p>Tous les salari\u00e9s du secteur priv\u00e9 ayant au moins un an d\u2019anciennet\u00e9 \u00e0 la date de naissance de l\u2019enfant, ou, en cas d\u2019adoption, \u00e0 sa date d&rsquo;arriv\u00e9e au foyer, peuvent pr\u00e9tendre au cong\u00e9 parental d\u2019\u00e9ducation.<\/p>\n<p>Les employ\u00e9s \u00e0 domicile doivent d\u00e9pendre de la convention collective nationale des particuliers employeurs et de l&#8217;emploi \u00e0 domicile pour en b\u00e9n\u00e9ficier.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Dur\u00e9e<\/strong><\/h2>\n<p>La dur\u00e9e initiale du cong\u00e9 parental d\u2019\u00e9ducation est au maximum d\u2019une ann\u00e9e. Le cong\u00e9 peut ensuite se renouveler en fonction du nombre d\u2019enfants arriv\u00e9s simultan\u00e9ment au foyer, qu\u2019il s\u2019agisse de naissance(s), ou d\u2019adoption d\u2019enfant(s) de moins de trois ans :<\/p>\n<ul>\n<li>Deux renouvellements du cong\u00e9 possibles en cas d\u2019arriv\u00e9e au foyer d\u2019un enfant, la date de fin de cong\u00e9 ne pouvant d\u00e9passer la date du 3\u00e8me anniversaire de l\u2019enfant, (ou de son arriv\u00e9e au foyer).<\/li>\n<li>Deux renouvellements du cong\u00e9 possibles en cas d\u2019arriv\u00e9e au foyer de 2 enfants, la date de fin de cong\u00e9 ne pouvant d\u00e9passer la date d\u2019entr\u00e9e \u00e0 l\u2019\u00e9cole maternelle des enfants. (ou de leur arriv\u00e9e au foyer en cas d\u2019adoptions).<\/li>\n<li>Cinq renouvellements du cong\u00e9 possibles en cas d\u2019arriv\u00e9e au foyer de trois enfants et plus, la date de fin de cong\u00e9 ne pouvant d\u00e9passer la date du 6\u00e8me anniversaire des enfants.<\/li>\n<\/ul>\n<p>Chaque p\u00e9riode de renouvellement peut avoir une dur\u00e9e diff\u00e9rente.<\/p>\n<p>En cas d\u2019adoption simultan\u00e9e d\u2019un ou de plusieurs enfants de 3 \u00e0 16 ans, la dur\u00e9e maximale du cong\u00e9 parental d\u2019\u00e9ducation est d\u2019un an, non renouvelable. La date de fin de cong\u00e9 se situera donc au plus tard un an apr\u00e8s l\u2019arriv\u00e9e de l\u2019enfant (ou des enfants) au foyer.<\/p>\n<p>Le cong\u00e9 parental d\u2019\u00e9ducation peut \u00eatre prolong\u00e9 d&rsquo;une ann\u00e9e suppl\u00e9mentaire maximum. Et ce, en cas de maladie, d&rsquo;accident ou de handicap grave de l\u2019enfant. Un certificat m\u00e9dical attestera de la gravit\u00e9 de la maladie ou de l\u2019accident. Il indiquera \u00e9galement la n\u00e9cessit\u00e9 d\u2019une pr\u00e9sence aupr\u00e8s de lui, et pendant combien de temps.<\/p>\n<p>La perception par la famille de <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F14809\">l&rsquo;allocation d&rsquo;\u00e9ducation de l&rsquo;enfant handicap\u00e9 (AEEH)<\/a> atteste de la gravit\u00e9 du handicap.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Comment demander le cong\u00e9 \u00e0 l\u2019employeur ?<\/strong><\/h2>\n<p>L&#8217;employeur ne peut pas refuser une demande de cong\u00e9 parental d\u2019\u00e9ducation. Aussi s\u2019agit-il plus d\u2019une \u201cinformation\u201d \u00e0 l\u2019employeur que d\u2019une v\u00e9ritable \u201cdemande\u201d. En cas de refus de l&#8217;employeur, le salari\u00e9 peut saisir le <a href=\"https:\/\/valoxy.org\/blog\/les-prudhommes\/\">le Conseil de prud\u2019hommes (CPH)<\/a>.<\/p>\n<h3><strong>Demande initiale<\/strong><\/h3>\n<p>Le salari\u00e9 doit informer l\u2019employeur en indiquant la date de d\u00e9but du cong\u00e9 parental, et sa dur\u00e9e, par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception (LRAR) ou par lettre remise en main propre contre d\u00e9charge (r\u00e9c\u00e9piss\u00e9).<\/p>\n<p>Lorsque le cong\u00e9 parental suit imm\u00e9diatement le <a href=\"https:\/\/valoxy.org\/blog\/la-remuneration-du-conge-maternite\/\">cong\u00e9 de maternit\u00e9<\/a> ou d\u2019adoption, le salari\u00e9 doit informer l&#8217;employeur au moins <strong>1 mois<\/strong> avant la fin de du cong\u00e9 de maternit\u00e9 ou adoption. Dans les autres cas, il informera l\u2019employeur au moins <strong>2 mois<\/strong> avant le d\u00e9but du cong\u00e9.<\/p>\n<h3><strong>Prolongation ou modification<\/strong><\/h3>\n<p>Le salari\u00e9 a la possibilit\u00e9 de prolonger (renouveler) son cong\u00e9 ou le transformer en temps partiel. Il doit en informer l&#8217;employeur au moins <strong>1 mois<\/strong> avant la fin du cong\u00e9 initial.<\/p>\n<p>L\u00e0 encore, l\u2019employeur ne peut s\u2019y opposer, et le salari\u00e9 peut saisir le <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2360\"><u>conseil de prud&rsquo;hommes (CPH)<\/u><\/a> en cas de refus.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Situation du salari\u00e9 pendant le cong\u00e9<\/strong><\/h2>\n<h3><strong>Cons<\/strong><strong>\u00e9quences sur le contrat de travail<\/strong><\/h3>\n<p>Le contrat de travail du salari\u00e9 est <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F21050\"><u>suspendu<\/u><\/a> pendant toute la dur\u00e9e du cong\u00e9 parental d\u2019\u00e9ducation. Le salari\u00e9 conserve le b\u00e9n\u00e9fice de tous ses avantages acquis. Cependant, les avantages li\u00e9s \u00e0 sa pr\u00e9sence dans l\u2019entreprise, tels que le <a href=\"https:\/\/valoxy.org\/blog\/le-titre-restaurant\/\">titre-restaurant<\/a>, ne sont pas maintenus.<\/p>\n<p>Le cong\u00e9 parental d&rsquo;\u00e9ducation<strong> \u00e0 temps complet\u00a0<\/strong>est pris en compte pour moiti\u00e9 dans la d\u00e9termination des droits que le salari\u00e9 tient de son anciennet\u00e9. (A<span class=\"s2\">rticle L. 1225-54 du code du travail). <\/span>La loi <span class=\"s2\">DDADUE du 19 Juillet 2023 confirme<\/span><span class=\"s2\"> cela. Par ailleurs, la loi a ajout\u00e9 un deuxi\u00e8me alin\u00e9a \u00e0 l&rsquo;article L. 1225-54 du Code du travail pr\u00e9cisant que<\/span><span class=\"s2\">\u00a0le cong\u00e9 parental <strong>\u00e0 temps partiel<\/strong> est assimil\u00e9 dans sa totalit\u00e9 \u00e0 du temps de travail effectif pour la d\u00e9termination des droits li\u00e9s \u00e0 l\u2019anciennet\u00e9 du salari\u00e9.<\/span><\/p>\n<p><span class=\"s2\">Par ailleurs, <strong>l&rsquo;<\/strong><b>appr\u00e9ciation de la condition d\u2019un an d\u2019anciennet\u00e9 se fait d\u00e9sormais \u00e0 la date de demande du cong\u00e9.<\/b> (et non plus \u00ab\u00a0<em>\u00e0 la date de naissance de l\u2019enfant <\/em><i>ou de l\u2019arriv\u00e9e au foyer d\u2019un enfant qui n\u2019a pas encore atteint l\u2019\u00e2ge de la fin de l\u2019obligation scolaire\u00a0\u00bb.<\/i> (Article L. 1225-47 du Code du travail modifi\u00e9 par la loi DDADUE du 19 Juillet 2023)<\/span><\/p>\n<h3><strong>Activit<\/strong><strong>\u00e9 professionnelle<\/strong><\/h3>\n<p>Le salari\u00e9 ne peut exercer aucune autre activit\u00e9 professionnelle pendant son cong\u00e9 parental, \u00e0 l&rsquo;exception de celle d&rsquo;assistant(e) maternel(le).<\/p>\n<p>Il peut demander \u00e0 effectuer un bilan de comp\u00e9tences. Ce bilan ne sera pas r\u00e9mun\u00e9r\u00e9, puisqu\u2019il ne sera pas effectu\u00e9 <strong>sur son temps de travail.<\/strong><\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>R\u00e9mun\u00e9ration<\/strong><\/h2>\n<p>Sauf dispositions conventionnelles, le salari\u00e9 ne re\u00e7oit pas de r\u00e9mun\u00e9ration pendant son cong\u00e9 parental, puisque c\u2019est une p\u00e9riode non travaill\u00e9e. (Son contrat de travail a \u00e9t\u00e9 suspendu)<\/p>\n<p>Par contre, la CAF peut lui verser, sous conditions de ressources, <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F2552\"><u>l&rsquo;allocation de base<\/u><\/a> de la prestation d&rsquo;accueil du jeune enfant (Paje).\u00a0En compl\u00e9ment de cette allocation, le salari\u00e9 peut aussi percevoir la <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F32485\"><u>prestation partag\u00e9e d&rsquo;\u00e9ducation de l&rsquo;enfant (PreParE)<\/u><\/a>, dont la dur\u00e9e de versement est li\u00e9e au nombre d&rsquo;enfants \u00e0 charge et \u00e0 la situation familiale. Aujourd&rsquo;hui, cette r\u00e9mun\u00e9ration globale repr\u00e9sente environ 406 \u20ac mensuels, loin des 950 \u20ac du cong\u00e9 maladie, et loin aussi des 80% du salaire brut pr\u00e9conis\u00e9 par la Commission europ\u00e9enne&#8230; (Voir notre article sur le projet gouvernemental d&rsquo;un \u00ab\u00a0<a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/projet-de-conge-familial\/\" target=\"_self\" rel=\"noopener\">cong\u00e9 familial<\/a>\u00ab\u00a0).<\/p>\n<p>Dans le cas o\u00f9 le salari\u00e9 souhaiterait faire garder son enfant, le compl\u00e9ment de libre choix de mode de garde (Cmg), remplacerait les prestations pr\u00e9c\u00e9dentes.<\/p>\n<p>La CAF a mis au point une <span class=\"s1\"><a href=\"https:\/\/wwwd.caf.fr\/wps\/portal\/caffr\/aidesetservices\/lesservicesenligne\/estimervosdroits\/lapaje\/!ut\/p\/z1\/04_Sj9CPykssy0xPLMnMz0vMAfIjo8zi_RzNHD2MDYwMAgICDQwCjYN9A8x9nA0NPAz0wwkpiAJKG-AAjiD9UWAlcBM8LN2cDAJDLE28vI09jYGKoArwmFGQG2GQ6aioCAAUvki6\/dz\/d5\/L0lDU0NTSUtVSkNncFJBISEvb0VvUUFBSVFKQUFNVWdnR0dRWkRncENsd1FBIS80SkNpaXUyTWQxRUp4U1pDZ21wSi9aN19OQTZBSDMwMjBIT1RDMFEzOU1MMU1BMUc2NC9aNl9OQTZBSDMwMjBIT1RDMFEzOU1MMU1BMUdRMi9ub3JtYWwvZnJta0NuYWZBY3Rpb24vcmVpbml0aWFsaXNlcg!!\/\">simulation de ces aides<\/a><\/span> sur son site.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Rupture anticip\u00e9e et fin du cong\u00e9 parental<\/strong><\/h2>\n<p>Le cong\u00e9 parental d\u2019\u00e9ducation peut s&rsquo;arr\u00eater de mani\u00e8re anticip\u00e9e en cas d&rsquo;accord entre le salari\u00e9 et l\u2019employeur.<\/p>\n<p>L&rsquo;accord pr\u00e9alable de l&#8217;employeur n&rsquo;est cependant pas n\u00e9cessaire en cas de\u00a0:<\/p>\n<ul>\n<li>d\u00e9c\u00e8s de l\u2019enfant,<\/li>\n<li>diminution importante des ressources du m\u00e9nage.<\/li>\n<\/ul>\n<p>Le salari\u00e9 doit alors adresser \u00e0 l&#8217;employeur une lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception (LRAR), au moins <strong>1 mois<\/strong> avant la date \u00e0 laquelle il d\u00e9sire reprendre son activit\u00e9.<\/p>\n<p>Apr\u00e8s le cong\u00e9, l\u2019employeur a l&rsquo;obligation de r\u00e9int\u00e9grer le salari\u00e9 dans son pr\u00e9c\u00e9dent emploi (ou un emploi similaire). La r\u00e9int\u00e9gration s&rsquo;accompagne d&rsquo;une r\u00e9mun\u00e9ration au moins \u00e9quivalente.<\/p>\n<p>Il a droit \u00e0 un <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F32040\"><u>entretien professionnel<\/u><\/a>.<\/p>\n<p>Cet article vous a int\u00e9ress\u00e9 ?
