﻿{"id":61997,"date":"2022-08-31T08:30:05","date_gmt":"2022-08-31T06:30:05","guid":{"rendered":"https:\/\/valoxy.org\/blog\/?p=61997"},"modified":"2024-06-13T15:33:18","modified_gmt":"2024-06-13T13:33:18","slug":"modifications-du-reglement-interieur-au-1er-septembre-2022","status":"publish","type":"post","link":"https:\/\/valoxy.org\/blog\/modifications-du-reglement-interieur-au-1er-septembre-2022\/","title":{"rendered":"Modifications du r\u00e8glement int\u00e9rieur"},"content":{"rendered":"<p>Il est n\u00e9cessaire d&rsquo;apporter, avant le 1er Septembre 2022,\u00a0 des modifications au <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/le-reglement-interieur\/\" target=\"_self\" rel=\"noopener\">r\u00e8glement int\u00e9rieur<\/a> et \u00e0 l&rsquo;affichage obligatoire de l&rsquo;entreprise. En effet, les lois n\u00b0 2022-401 et 400 du 21 mars 2022 visent respectivement \u00e0 am\u00e9liorer la protection des lanceurs d&rsquo;alerte, et \u00e0 renforcer le r\u00f4le du d\u00e9fenseur des droits en mati\u00e8re de signalement d\u2019alerte. Elle ont, de fait, entra\u00een\u00e9 une modification de certains articles du Code du Travail et du Code P\u00e9nal.<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, d\u00e9taille dans cet article les modifications du r\u00e8glement int\u00e9rieur et de l&rsquo;affichage obligatoire que ces lois entra\u00eenent.<\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span>Objectif recherch\u00e9<\/h2>\n<p>L&rsquo;objectif de ces nouvelles lois est double. Il s&rsquo;agit \u00e0 la fois :<\/p>\n<ul style=\"font-weight: 400;\">\n<li style=\"font-weight: 300;\">de renforcer la protection des lanceurs d\u2019alerte en corrigeant certains limites de la loi de 2016 (a),<\/li>\n<li style=\"font-weight: 300;\">et de transposer en droit fran\u00e7ais la directive europ\u00e9enne 2019\/1937 du 23 octobre 2019 sur la protection des personnes qui signalent des violations du droit de l\u2019Union \u00e0 une institution ou un organe communautaire.<\/li>\n<\/ul>\n<p>La loi n\u00b0 2022-401 du 21 mars 2022 vise \u00e0 am\u00e9liorer la protection des lanceurs d\u2019alerte. Elle apporte en effet une modification \u00e0 la liste des motifs de discrimination interdits dans le Code du Travail et le Code p\u00e9nal en y int\u00e9grant les <a href=\"https:\/\/valoxy.org\/blog\/le-lanceur-dalerte\/\">lanceurs d\u2019alerte<\/a>.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span>Existence d&rsquo;un dispositif de protection<\/h2>\n<p>L\u2019article 4 de la loi pr\u00e9voit que le r\u00e8glement int\u00e9rieur de l&rsquo;entreprise doit, <strong>\u00e0 partir du 1er Septembre<\/strong>, rappeler l&rsquo;existence\u00a0du dispositif de protection des lanceurs d\u2019alerte.<\/p>\n<p>Par ailleurs, l\u2019article 255-1 du Code P\u00e9nal, modifi\u00e9 par la loi, fait partie des articles que l\u2019entreprise doit afficher ou diffuser \u201cpar tout moyen\u201d aux salari\u00e9s. Il faut donc mettre \u00e0 jour cette information et compl\u00e9ter ou amender le panneau d\u2019affichage de l\u2019entreprise. (Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/laffichage-obligatoire-dans-les-entreprises\/\">L\u2019affichage obligatoire dans les entreprises<\/a>).<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span>Conditions de la protection<\/h2>\n<p>L&rsquo;article 7 de la loi red\u00e9finit les conditions de la protection des personnes ayant subi ou refus\u00e9 de subir des faits de harc\u00e8lement moral ou sexuel, ou d\u00e9non\u00e7ant de tels faits.<\/p>\n<p>Les articles L 1152-2 et L 1153-2 du Code du travail d\u00e9finissent la protection des personnes ayant subi, ou refus\u00e9 de subir, ou ayant d\u00e9nonc\u00e9 :<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>d&rsquo;une part un harc\u00e8lement moral,<\/li>\n<li>et\/ou d&rsquo;autre part un harc\u00e8lement sexuel,<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>ont donc \u00e9t\u00e9 compl\u00e8tement r\u00e9\u00e9crits. Cela afin :<\/p>\n<ul>\n<li>d\u2019am\u00e9liorer la protection des lanceurs d&rsquo;alerte\u00a0de mani\u00e8re g\u00e9n\u00e9rale,<\/li>\n<li>de coordonner leur protection avec le r\u00e9gime de protection pr\u00e9vu dans le cadre sp\u00e9cifique de ces harc\u00e8lements.<\/li>\n<\/ul>\n<p>L&rsquo;article L 1153-3 du Code du travail, devenu redondant, est, lui, abrog\u00e9.<\/p>\n<p><strong>Le r<\/strong><strong>\u00e8<\/strong><strong>glement int\u00e9rieur de l&rsquo;entreprise doit donc mentionner la bonne version des articles du Code du Travail.<\/strong><\/p>\n<p>En cons\u00e9quence,<\/p>\n<ul>\n<li>dans les entreprises de 50 salari\u00e9s et plus, il est n\u00e9cessaire de mettre \u00e0 jour le r\u00e8glement int\u00e9rieur avant le 1er septembre 2022,<\/li>\n<li>dans toutes les entreprises, quel que soit l\u2019effectif, l&rsquo;affichage obligatoire doit mentionner la nouvelle version des articles du Code du Travail relatif au harc\u00e8lement.<\/li>\n<\/ul>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Rappel sur les modification du r\u00e8glement int\u00e9rieur<\/strong><\/h2>\n<div class=\"encadre-style\">La proc\u00e9dure de modification du r\u00e8glement int\u00e9rieur est identique \u00e0 celle pr\u00e9vue pour son \u00e9laboration :<\/p>\n<ul>\n<li>le\u00a0CSE doit \u00eatre consult\u00e9,<\/li>\n<li>le r\u00e8glement int\u00e9rieur doit \u00eatre transmis \u00e0 l\u2019inspection du travail et au greffe du conseil de prud\u2019hommes,<\/li>\n<li>il doit de nouveau \u00eatre communiqu\u00e9 \u201cpar tout moyen\u201d au personnel.<\/li>\n<\/ul>\n<p>En l\u2019absence de repr\u00e9sentants du personnel, l\u2019employeur peut proc\u00e9der unilat\u00e9ralement \u00e0 la modification du r\u00e8glement int\u00e9rieur. (Un proc\u00e8s-verbal de carence atteste de l\u2019absence de repr\u00e9sentants du personnel)<\/div>\n<p>(a) Le dispositif de protection des lanceurs d\u2019alerte \u00e9tait pr\u00e9vu par la loi du 9 d\u00e9cembre 2016.
