Avouons-le ! Entre l\u2019avis d\u2019arr\u00eat de travail (Cerfa n\u00b010170*06), le certificat initial AT\/MP (Cerfa 11138*06) et le certificat m\u00e9dical de prolongation AT\/MP (Cerfa n\u00b011138*03), \u00a0\u00e9tablis par les professionnels de sant\u00e9, il y avait parfois de quoi s\u2019embrouiller.<\/p>\n<p>Projet plusieurs fois report\u00e9, la fusion des formulaires prescrivant les arr\u00eats de travail maladie et AT\/MP est enfin sur les rails ! Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, et gestionnaire de paie pour de nombreuses entreprises, vous en dit plus.<\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Une mesure de simplification<\/strong><\/h2>\n<p>Le site <a href=\"http:\/\/ameli.fr\">ameli.fr<\/a> a annonc\u00e9 le 19 Avril la fusion de la partie \u201carr\u00eat de travail\u201d de ces formulaires. L\u2019avis d\u2019arr\u00eat de travail unique pour toutes les prescriptions d\u2019arr\u00eat de travail devient r\u00e9alit\u00e9. M\u00eame si les d\u00e9crets ne sont toujours pas sortis !<\/p>\n<p>Annonc\u00e9s d\u00e8s 2019\u00a0 dans un paquet de mesures de simplification, et par la Loi de financement de la S\u00e9curit\u00e9 sociale pour 2021, cette fusion devrait simplifier la prescription des arr\u00eats de travail &#8211; et leur suivi &#8211; pour les professionnels de sant\u00e9. Et rendre les d\u00e9marches plus lisibles pour les employeurs et les salari\u00e9s.<\/p>\n<p><strong>Si l\u2019arr\u00eat initial est li\u00e9 \u00e0 un accident du travail ou une maladie professionnelle<\/strong>, la prolongation se fait uniquement sur l\u2019avis d\u2019arr\u00eat de travail. Cela \u00e9vitera les erreurs du choix du mod\u00e8le de formulaire \u00e0 utiliser, source r\u00e9currente de probl\u00e8mes d\u2019indemnisation pour les patients et de r\u00e9daction de duplicata pour les m\u00e9decins.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Qu\u2019est-ce que cela change pour l\u2019employeur ?<\/strong><\/h2>\n<p><strong><span style=\"color: #c1d72e;\">\u203a <\/span>Arr\u00eat de travail (initial ou prolongation)<\/strong><\/p>\n<p>L\u2019employeur ne recevra plus qu\u2019un seul mod\u00e8le de document Cerfa, qu\u2019il s\u2019agisse d\u2019un arr\u00eat maladie, maternit\u00e9, accident du travail (AT) ou maladie professionnelle (MP). L\u2019avis d\u2019arr\u00eat de travail devient le support unique pour toutes les prescriptions d\u2019arr\u00eat de travail. Le type d\u2019arr\u00eat est pr\u00e9cis\u00e9 (sous la forme d\u2019une case coch\u00e9e) directement sur le formulaire. Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/declarer-accident-travail\/\">Comment d\u00e9clarer un accident du travail ?<\/a><\/p>\n<p>Le document permet \u00e9galement :<\/p>\n<ul>\n<li>la possibilit\u00e9 de prescrire un cong\u00e9 de deuil parental et<\/li>\n<li>permet au m\u00e9decin prescripteur d\u2019indiquer explicitement s\u2019il autorise son patient \u00e0 exercer une activit\u00e9 pendant son arr\u00eat de travail et, le cas \u00e9ch\u00e9ant, la nature de celle-ci.<\/li>\n<\/ul>\n<p><strong><span style=\"color: #c1d72e;\">\u203a <\/span>R\u00e8gles et obligations<\/strong><\/p>\n<p>Les r\u00e8gles et obligations de transmission du volet destin\u00e9 \u00e0 l\u2019employeur ne changent pas.<\/p>\n<p><strong><span style=\"color: #c1d72e;\">\u203a <\/span>Reconnaissance AT\/MP<\/strong><\/p>\n<p>Les certificats m\u00e9dicaux relatifs \u00e0 la reconnaissance et au suivi AT\/MP ne porteront plus de prescription d\u2019arr\u00eat de travail. Ils ne seront donc plus adress\u00e9s \u00e0 l\u2019employeur par le salari\u00e9.<\/p>\n<p>Les certificats m\u00e9dicaux (certificats m\u00e9dicaux initiaux, de rechute ou de nouvelles l\u00e9sions) relatifs aux AT\/MP faisant l\u2019objet d\u2019une investigation par les services de la caisse primaire resteront accessibles durant la p\u00e9riode contradictoire pr\u00e9c\u00e9dant la d\u00e9cision de prise en charge ou de rejet du sinistre.<\/p>\n<p><strong><span style=\"color: #c1d72e;\">\u203a <\/span>Pr\u00e9cisions suppl\u00e9mentaires<\/strong><\/p>\n<p>Le nouveau document Cerfa int\u00e8gre <strong>diverses pr\u00e9cisions<\/strong> en cas d\u2019exercice simultan\u00e9 par l\u2019assur\u00e9 de plusieurs activit\u00e9s professionnelles. Il int\u00e8gre dor\u00e9navant deux nouveaux choix, Elu local, et Artiste auteur,<\/p>\n<p>en plus des activit\u00e9s d\u00e9j\u00e0 existantes sur le document pr\u00e9c\u00e9dent :<\/p>\n<ul>\n<li>Activit\u00e9 salari\u00e9e<\/li>\n<li>Fonctionnaire<\/li>\n<li>Profession ind\u00e9pendante<\/li>\n<li>Activit\u00e9 non salari\u00e9e agricole<\/li>\n<li>Sans emploi<img fetchpriority=\"high\" decoding=\"async\" class=\"size-medium wp-image-61434 aligncenter\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2022\/05\/formulaire-1-1-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2022\/05\/formulaire-1-1-300x200.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2022\/05\/formulaire-1-1.jpg 640w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/li>\n<\/ul>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Qu\u2019est-ce qui ne change pas pour l\u2019employeur ?<\/strong><\/h2>\n<p>Les r\u00e8gles de d\u00e9claration et d\u2019instruction ne changent pas :<\/p>\n<p>En cas d\u2019accident du travail,<\/p>\n<ul>\n<li>le salari\u00e9 doit pr\u00e9venir son employeur dans les 24 heures qui suivent l\u2019AT.<\/li>\n<li>l\u2019employeur doit d\u00e9clarer l\u2019AT \u00e0 la caisse d\u2019assurance maladie dont d\u00e9pend le salari\u00e9 dans les 48 heures qui suivent l\u2019AT.<\/li>\n<\/ul>\n<p>En cas d\u2019investigations par la caisse, le certificat m\u00e9dical initial est mis \u00e0 disposition sur <a href=\"https:\/\/questionnaires-risquepro.ameli.fr\/login\">le questionnaire risques professionnels<\/a>.<\/p>\n<p>Dans le cas d&rsquo;une rechute ou d&rsquo;une nouvelle(s) l\u00e9sion(s), le certificat m\u00e9dical est syst\u00e9matiquement transmis \u00e0 l\u2019employeur afin que ce dernier puisse \u00e9mettre d\u2019\u00e9ventuelles r\u00e9serves.<\/p>\n<p>En dehors des cas relatifs aux accidents de travail et maladie professionnelles, l\u2019assur\u00e9 doit toujours adresser le volet de l\u2019avis d\u2019arr\u00eat de travail dans un d\u00e9lai de 48h.<\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Mise en place<\/strong><\/h2>\n<p>La mise en place du nouveau formulaire d&rsquo;arr\u00eat de travail unique se fait progressivement, au fur et \u00e0 mesure de l\u2019utilisation des nouveaux documents par les professionnels de sant\u00e9.
