Outre l\u2019impact psychologique pour l\u2019\u00e9quipe, des obligations juridiques, l\u00e9gales et sociales incombent \u00e0 l\u2019employeur.<\/p>\n<p>Rupture du contrat, solde de tout compte, \u00e9pargne salariale, b\u00e9n\u00e9ficiaires, d\u00e9clarations diverses, Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, aborde le sujet sous tous ses aspects.<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Fin du contrat de travail<\/strong><\/h2>\n<p>Le d\u00e9c\u00e8s d\u2019un salari\u00e9 entra\u00eene la rupture de son contrat de travail. C\u2019est un cas de force majeure. La date de rupture \u00e9tant celle notifi\u00e9e dans l\u2019acte de d\u00e9c\u00e8s, il faut donc se procurer le certificat de d\u00e9c\u00e8s au plus vite. L\u2019employeur peut le demander \u00e0 la famille (conjoint, enfant, parent, etc.), \u00e0 un proche, voire \u00e0 un travailleur social si le salari\u00e9 est isol\u00e9. L\u2019entreprise pourra alors proc\u00e9der \u00e0 l\u2019\u00e9tablissement :<\/p>\n<ul>\n<li>de la derni\u00e8re fiche de paie,<\/li>\n<li>du solde de tout compte,<\/li>\n<li>de l\u2019attestation de salaire destin\u00e9e \u00e0 P\u00f4le emploi, qui interviendra notamment dans l&rsquo;\u00e9valuation du capital d\u00e9c\u00e8s vers\u00e9 par la S\u00e9curit\u00e9 sociale,<\/li>\n<li>du <a href=\"https:\/\/valoxy.org\/blog\/certificat-de-travail-definition-contenu\/\">certificat de travail<\/a>,<\/li>\n<li>et \u00e0 la radiation du salari\u00e9 du registre de l\u2019entreprise.<\/li>\n<\/ul>\n<p>Attention ! D\u00e8s la rupture du contrat, tous les montants dus par l&#8217;employeur en raison du travail du salari\u00e9 d\u00e9funt deviennent imm\u00e9diatement exigibles. (Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/rupture-contrat-travail-documents-a-remettre-au-salarie-04022014avla1\/\">Les documents \u00e0 remettre au salari\u00e9 lorsque son contrat de travail se termine<\/a>)<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Que comprend le solde de tout compte ?<\/strong><\/h2>\n<p>Il n\u2019y a pas d\u2019indemnit\u00e9 de rupture en cas de d\u00e9c\u00e8s, mais le solde de tout compte comprend tous les salaires et primes non encore vers\u00e9s :<\/p>\n<ul>\n<li>les primes dues, qu\u2019elles soient pr\u00e9vues par le contrat de travail ou la <a href=\"https:\/\/valoxy.org\/blog\/convention-collective-applicable-entreprise-22102014avaltlodela\/\">Convention collective<\/a>,<\/li>\n<li>l\u2019indemnit\u00e9 compensatrice de <a href=\"https:\/\/valoxy.org\/blog\/indemnite-conges-payes\/\">cong\u00e9s pay\u00e9s<\/a>,<\/li>\n<li>l\u2019indemnit\u00e9 correspondant aux droits acquis en mati\u00e8re de contrepartie obligatoire de repos, (RTT, etc.)<\/li>\n<li>le salaire du mois en cours restant d\u00fb,<\/li>\n<\/ul>\n<p>Lorsqu\u2019une proc\u00e9dure de licenciement ou de rupture conventionnelle \u00e9tait en cours au moment du d\u00e9c\u00e8s, l\u2019employeur doit verser l\u2019indemnit\u00e9 de licenciement ou l\u2019indemnit\u00e9 sp\u00e9cifique de rupture conventionnelle, m\u00eame si le d\u00e9c\u00e8s a lieu pendant la p\u00e9riode de pr\u00e9avis.<\/p>\n<p>En cas de clause de non-concurrence, le d\u00e9c\u00e8s y met fin automatiquement. Aucune indemnit\u00e9 n\u2019est donc \u00e0 payer \u00e0 ce titre.<\/p>\n<p>Enfin, il est important de v\u00e9rifier qu\u2019il n\u2019existe pas d\u2019avance sur r\u00e9mun\u00e9ration (de type paiement anticip\u00e9 d\u2019une prime) ou d\u2019avance sur frais. Il sera en effet difficile de proc\u00e9der par la suite \u00e0 une r\u00e9gularisation\u2026<\/p>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>A qui verser le solde de tout compte d\u2019un salari\u00e9 d\u00e9c\u00e9d\u00e9 ?<\/strong><\/h2>\n<p>Le solde de tout compte d\u2019un salari\u00e9 d\u00e9c\u00e9d\u00e9 ne peut \u00eatre pay\u00e9 sur le compte bancaire du salari\u00e9. Aussi ne faut-il pas oublier de passer le mode de r\u00e8glement \u201cpar ch\u00e8que\u201d dans le logiciel de paie !<\/p>\n<p>Les montants dus au salari\u00e9 sont vers\u00e9s au notaire en charge de la succession. Ils seront inscrits sur la DSN (d\u00e9claration sociale nominative). En l\u2019absence de notaire, l\u2019employeur peut remettre directement cette somme aux ayants droit, \u00e0 la condition qu\u2019ils prouvent leur qualit\u00e9 d\u2019h\u00e9ritier :<\/p>\n<ul>\n<li>avec une attestation sign\u00e9e par tous les h\u00e9ritiers pour une succession d\u2019un montant inf\u00e9rieur \u00e0 5 000 \u20ac,<\/li>\n<li>avec un certificat d\u2019h\u00e9r\u00e9dit\u00e9 ou un acte de notori\u00e9t\u00e9 confirmant leur qualit\u00e9 d\u2019h\u00e9ritier pour une succession d\u2019un montant sup\u00e9rieur ou \u00e9gal \u00e0 5 000 \u20ac.<\/li>\n<\/ul>\n<h2><span style=\"color: #c1d72e;\">\u2014 <\/span><strong>Les autres versements<\/strong><\/h2>\n<h4><strong>Aide financi\u00e8re suite au d\u00e9c\u00e8s d&rsquo;un salari\u00e9<\/strong><\/h4>\n<p>Un accord collectif, un usage ou un engagement unilat\u00e9ral (document \u00e9crit de l&#8217;employeur accordant un avantage aux salari\u00e9s) peut pr\u00e9voir une aide financi\u00e8re de l\u2019entreprise aux ayants droit.<\/p>\n<h4><strong>Liquidation de l\u2019\u00e9pargne salariale<\/strong><\/h4>\n<p>L\u2019employeur doit avertir les ayants droit, le cas \u00e9ch\u00e9ant, de l\u2019existence d\u2019une <a href=\"https:\/\/valoxy.org\/blog\/lepargne-salariale-fonctionnement-et-perspectives-2018-2019\/\">\u00e9pargne salariale<\/a> (participation aux r\u00e9sultats de l&rsquo;entreprise, r\u00e9serve sp\u00e9ciale ou plan d&rsquo;\u00e9pargne d\u2019entreprise\u2026). Ceux-ci peuvent en demander le d\u00e9blocage anticip\u00e9 dans un d\u00e9lai de 6 mois \u00e0 compter du jour du d\u00e9c\u00e8s. Le d\u00e9c\u00e8s du salari\u00e9 fait en effet partie des motifs de liquidation anticip\u00e9e.<\/p>\n<p>L\u2019employeur doit donc fournir un \u00e9tat r\u00e9capitulatif de l\u2019\u00e9pargne salariale au notaire charg\u00e9 de la succession.<\/p>\n<h3><strong>Radier le salari\u00e9 des diff\u00e9rents organismes<\/strong><\/h3>\n<p><strong>L\u2019entreprise a la responsabilit\u00e9 de proc\u00e9der \u00e0 la radiation du salari\u00e9 d\u00e9c\u00e9d\u00e9 aupr\u00e8s des diff\u00e9rents organismes de protection sociale<\/strong>, P\u00f4le emploi, Urssaf, compl\u00e9mentaire sant\u00e9, pr\u00e9voyance, caisses de retraite, ainsi qu&rsquo;\u00e0 la M\u00e9decine du travail, \u00e0 la date mentionn\u00e9e sur l\u2019acte de d\u00e9c\u00e8s.<\/p>\n<p>La radiation se fait en informant l\u2019organisme par mail, ou sur son portail d\u00e9di\u00e9, ou au travers de la DSN.<\/p>\n<h3><strong>Compl\u00e9mentaire sant\u00e9<\/strong><\/h3>\n<h4>Frais d&rsquo;obs\u00e8ques<\/h4>\n<p>Les contrats de <a href=\"https:\/\/valoxy.org\/blog\/acteurs-complementaire-sante\/\">compl\u00e9mentaire sant\u00e9<\/a> incluent souvent un remboursement \u201cfrais d\u2019obs\u00e8ques\u201d en cas de d\u00e9c\u00e8s d\u2019un salari\u00e9. Il est donc important de pr\u00e9venir l\u2019organisme au plus t\u00f4t.<\/p>\n<h4>Compl\u00e9mentaire Sant\u00e9<\/h4>\n<p>Les ayants droit d\u2019un salari\u00e9 d\u00e9c\u00e9d\u00e9 peuvent b\u00e9n\u00e9ficier du<span class=\"\"> maintien du b\u00e9n\u00e9fice de la compl\u00e9mentaire sant\u00e9.<\/span>\u00a0<strong>(c\u2019est \u00e0 dire du maintien des droits \u00e0 la mutuelle de l\u2019entreprise)<\/strong> \u00e0 condition d\u2019avoir \u00e9t\u00e9 inscrits au contrat de groupe avant le d\u00e9c\u00e8s.<\/p>\n<div class=\"\">\n<p><span class=\"\" style=\"color: #010102;\"><span class=\"\" style=\"color: #010102;\"><span class=\"\">C<\/span><span class=\"\">\u2019<\/span><span class=\"\">est la <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000000709057\">loi 89-1009 du 31 D\u00e9cembre 1989<\/a> <\/span><\/span><\/span><span class=\"\" style=\"color: #010102;\"><span class=\"\">(dite \u201cLoi \u00c9vin), modifi\u00e9e par la loi 2013-504 du 14 Juin 2013 (<a class=\"\" href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000027563147\">Article 4<\/a>), qui a renforc\u00e9 cette garantie. <\/span><\/span><span class=\"\" style=\"color: #010102;\"><span class=\"\" style=\"color: #010102;\"><span class=\"\">On ne parle pas dans ce cas d\u2019une portabilit\u00e9\u00a0<\/span><span class=\"\">\u201c<\/span><span class=\"\">classique\u00a0\u00bb, mais de \u00ab\u00a0maintien de couverture Loi \u00c9VIN\u201d, ou de\u00a0<\/span><span class=\"\">\u201c<\/span><span class=\"\">Loi \u00c9vin Mutuelle<\/span><span class=\"\">\u201d<\/span><span class=\"\">.\u00a0<\/span><\/span><\/span><\/p>\n<div class=\"\"><span class=\"\">L\u2019extension au profit des ayants droit de l&rsquo;assur\u00e9 d\u00e9c\u00e9d\u00e9 est garantie pendant une dur\u00e9e minimale de douze mois \u00e0 compter du d\u00e9c\u00e8s, sous r\u00e9serve que les int\u00e9ress\u00e9s en fassent la demande dans les six mois suivant le d\u00e9c\u00e8s.<\/span><span class=\"\">\u00a0<\/span><\/div>\n<div class=\"\"><span class=\"\" style=\"color: #010102;\"><span class=\"\">Les tarifs applicables peuvent \u00eatre sup\u00e9rieurs aux tarifs globaux (<\/span><\/span><span class=\"\">c\u2019est \u00e0 dire part salariale PLUS part patronale<\/span><span class=\"\" style=\"color: #010102;\"><span class=\"\">) applicables aux salari\u00e9s actifs de la mani\u00e8re suivante :<\/span><\/span><\/div>\n<ul class=\"\">\n<li class=\"\"><span class=\"\">la 1\u00e8re ann\u00e9e, les tarifs sont \u00e9gaux aux tarifs applicables aux salari\u00e9s actifs,\u00a0<\/span><\/li>\n<li class=\"\"><span class=\"\">la 2\u00e8me ann\u00e9e, les tarifs peuvent aller jusqu\u2019\u00e0 125% des tarifs applicables aux salari\u00e9s actifs,\u00a0<\/span><\/li>\n<li class=\"\"><span class=\"\">et la 3\u00e8me ann\u00e9e, les tarifs peuvent aller jusqu\u2019\u00e0 150% des tarifs applicables aux salari\u00e9s actifs.<\/span><\/li>\n<\/ul>\n<div class=\"\"><span class=\"\" style=\"color: #010102;\"><span class=\"\">\u00c0<\/span><\/span><span class=\"\">\u00a0l<\/span><span class=\"\">\u2019<\/span><span class=\"\">issue de ces 3\u00a0<\/span><span class=\"\">ann\u00e9es de plafonnement, l\u2019organisme assureur est libre d\u2019appliquer les tarifs qu\u2019il souhaite. Il est donc recommand\u00e9 d\u2019utiliser cette p\u00e9riode pour \u00e9tudier les offres du march\u00e9 correspondant aux situations personnelles et familiales.\u00a0<\/span><\/div>\n<\/div>\n<h3><strong>La pr\u00e9voyance (Assurance-d\u00e9c<\/strong><strong>\u00e8<\/strong><strong>s)<\/strong><\/h3>\n<p>Les contrats de <a href=\"https:\/\/valoxy.org\/blog\/la-prevoyance-individuelle\/\">pr\u00e9voyance<\/a> compl\u00e9mentaire pr\u00e9voient parfois, en cas de d\u00e9c\u00e8s, de faire b\u00e9n\u00e9ficier les ayants droit :<\/p>\n<ul>\n<li>de la prise en charge des frais d\u2019obs\u00e8ques,<\/li>\n<li>d\u2019un capital ou d\u2019une rente vers\u00e9e au conjoint du salari\u00e9<\/li>\n<li>d\u2019une rente d\u2019\u00e9ducation pour les enfants mineurs.<\/li>\n<\/ul>\n<p>Tout salari\u00e9 a la possibilit\u00e9 de d\u00e9signer ses ayants droit \u00e0 l\u2019organisme de pr\u00e9voyance. Si ce n\u2019est pas fait, les ayants droit seront ceux d\u00e9finis dans le contrat.<\/p>\n<p>Il est donc important pour l\u2019employeur (ou son gestionnaire de paie, DRH, etc.) de monter un dossier de d\u00e9claration de d\u00e9c\u00e8s aupr\u00e8s des organismes de pr\u00e9voyance, qui demanderont &#8211; en g\u00e9n\u00e9ral &#8211; les pi\u00e8ces suivantes :<\/p>\n<ul>\n<li>l\u2019acte de d\u00e9c\u00e8s du salari\u00e9.<\/li>\n<li>l\u2019identit\u00e9 des ayants droit.<\/li>\n<li>en fonction du contrat, les salaires des X derniers mois pr\u00e9c\u00e9dant le d\u00e9c\u00e8s<\/li>\n<\/ul>\n<p>Ces prestations peuvent \u00e9galement \u00eatre accord\u00e9es dans le cadre de la portabilit\u00e9 si le salari\u00e9 avait quitt\u00e9 son employeur depuis moins de 12 mois et s\u2019il \u00e9tait indemnis\u00e9 par P\u00f4le emploi au moment du d\u00e9c\u00e8s.<\/p>\n<h3><strong>Informer les \u00e9ventuels cr\u00e9anciers du d\u00e9c\u00e8s d&rsquo;un salari\u00e9<\/strong><\/h3>\n<p>En cas de saisie ou cession sur r\u00e9mun\u00e9ration, ou d\u2019un paiement direct de pension alimentaire, l\u2019employeur doit informer (par email ou par courrier) le cr\u00e9ancier (Administration fiscale, personne physique, etc.) du d\u00e9c\u00e8s du salari\u00e9, et met fin \u00e0 la saisie.<\/p>\n<h3><strong>En cas de d\u00e9c<\/strong><strong>\u00e8<\/strong><strong>s sur le lieu de travail<\/strong><\/h3>\n<p>Lorsque le d\u00e9c\u00e8s survient sur le lieu de travail, qu\u2019il s\u2019agisse d\u2019un accident, d\u2019un probl\u00e8me de sant\u00e9 (malaise, crise cardiaque, \u2026), voire d\u2019un suicide, l\u2019employeur doit le d\u00e9clarer \u00e0 la CPAM dans les 48h. C\u2019est la CPAM qui statuera sur la reconnaissance \u00e9ventuelle d\u2019un <a href=\"https:\/\/valoxy.org\/blog\/declarer-accident-travail\/\">accident du travail<\/a>, apr\u00e8s instruction du dossier.<\/p>\n<p>L\u2019employeur doit \u00e9galement informer le <a href=\"https:\/\/valoxy.org\/blog\/le-cse-la-nouvelle-instance-du-dialogue-social\/\">CSE (Comit\u00e9 Social \u00c9conomique)<\/a>.<\/p>\n<p>Cet article vous a int\u00e9ress\u00e9 ?
