Le Minist\u00e8re du Travail a voulu, gr\u00e2ce \u00e0 cet outil, simplifier l\u2019acc\u00e8s et l\u2019usage du droit du travail. L\u2019objectif est de faciliter la gestion des relations entre les employeurs et les salari\u00e9s.<\/p>\n<p>D\u00e9mission, licenciement, type de contrat, heures suppl\u00e9mentaires, remboursement des frais, il n\u2019est pas toujours facile de s\u2019y retrouver ! La l\u00e9gislation, complexe, n\u2019est pas toujours tr\u00e8s claire pour expliquer les droits et obligations des chefs d\u2019entreprise et des salari\u00e9s.<\/p>\n<p>Le code du travail num\u00e9rique est l\u00e0 pour pallier ces difficult\u00e9s. Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France pr\u00e9sente le Code du travail num\u00e9rique.<\/p>\n<h2><strong>Historique<\/strong><\/h2>\n<p>Le d\u00e9veloppement d\u2019un code du travail num\u00e9rique \u00e9tait inscrit dans les <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000035607388\">Ordonnances Travail du 22 septembre 2017<\/a>. Cet engagement se voulait <em>\u201cun exercice de d\u00e9mocratie\u201d <\/em>pour \u201c<em>rendre accessible le droit \u00e0 tous\u201d.<\/em> Il proc\u00e8de de la m\u00eame logique que les mesures du \u201cchoc de simplification\u201d (2014) ou de la Loi pour un \u00c9tat au Service d\u2019une Soci\u00e9t\u00e9 de Confiance (Loi ESSOC de 2018).<\/p>\n<h2><strong>Le Code du travail en cause<\/strong><\/h2>\n<p>Le Code du travail r\u00e8gle et d\u00e9finit les diff\u00e9rentes situations entre l&#8217;employeur et le salari\u00e9. Il compte, selon les \u00e9ditions, de 3 000 \u00e0 4 000 pages, 11 000 articles. Il contient plus de 30 000 textes l\u00e9gislatifs et r\u00e8glementaires, qui \u00e9clairent la loi. Le code comprend aussi la reproduction des principales jurisprudences. Et les pages finales sont d\u00e9di\u00e9es aux correspondances entre les anciens et les nouveaux textes.<\/p>\n<p>Or, les exemples cit\u00e9s ne sont pas tous pertinents pour \u00e9clairer le lecteur sur son propre cas. Certaines r\u00e8gles sont difficiles \u00e0 comprendre pour ceux-l\u00e0 m\u00eames pour qui le code est \u00e9crit. Et le nombre de renvois d\u2019un article \u00e0 un autre ne facilite pas une lecture fluide et facilement compr\u00e9hensible. Un travail de simplification \u00e9tait donc n\u00e9cessaire, dans un langage qui ne soit pas r\u00e9serv\u00e9 aux sp\u00e9cialistes.<\/p>\n<h2><strong>A qui s\u2019adresse le Code du travail num\u00e9rique ?<\/strong><\/h2>\n<p><a href=\"https:\/\/code.travail.gouv.fr\">Le Code du travail num\u00e9rique<\/a> s\u2019adresse \u00e0 tous ! C\u2019est une plate-forme gratuite, qui permet de simplifier l\u2019acc\u00e8s et l\u2019usage du droit g\u00e9rant les relations entre employeurs et salari\u00e9s, <strong>dans un \u201cfran\u00e7ais courant\u201d et \u201cfacile \u00e0 comprendre\u201d.<\/strong><\/p>\n<p><em>C<\/em>e service digital a donc \u00e9t\u00e9 pens\u00e9 <strong>prioritairement<\/strong> pour les chefs d\u2019entreprise des TPE\/PME et les salari\u00e9s. Car celles-ci ne disposent que rarement d\u2019un service juridique en interne ou d\u2019un repr\u00e9sentant syndical capable de r\u00e9pondre \u00e0 leurs questions.<\/p>\n<p><strong>\u00c0 noter que les justiciables pourront se fonder sur les r\u00e9ponses fournies par le code du travail num\u00e9rique pour se pr\u00e9valoir de leur bonne foi devant un juge.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h2><strong>Comment ce Code du travail se pr\u00e9sente-t-il ?<\/strong><\/h2>\n<p>L\u2019objectif \u00e9tait de pr\u00e9senter un code du travail num\u00e9rique clair, accessible et compr\u00e9hensible, r\u00e9pondant <em>\u201caux questions concr<\/em><em>\u00e8<\/em><em>tes que se posent les chefs d<\/em><em>\u2019<\/em><em>entreprise des TPE\/PME et les salari\u00e9s\u201d.<\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<h2><strong>9 th\u00e8mes<\/strong><\/h2>\n<p><a href=\"https:\/\/code.travail.gouv.fr\">Le Code du travail num\u00e9rique<\/a> est accessible par la recherche d\u2019un mot cl\u00e9, et par de nombreuses<strong> fiches organis\u00e9es autour de 9 th\u00e8mes. <\/strong><\/p>\n<p>Les fiches ont \u00e9t\u00e9 pens\u00e9es pour r\u00e9pondre aux besoins des besoins des utilisateurs. Plus de 2 500 r\u00e9ponses aux 50 questions les plus fr\u00e9quentes :<\/p>\n<ul>\n<li>Embauche et contrat de travail,<\/li>\n<li>Salaire et r\u00e9mun\u00e9ration,<\/li>\n<li>Temps de travail,<\/li>\n<li>Cong\u00e9s et repos,<\/li>\n<li>Emploi et formation,<\/li>\n<li>Sant\u00e9, s\u00e9curit\u00e9 et conditions de travail,<\/li>\n<li>Repr\u00e9sentation du personnel et convention collective,<\/li>\n<li>D\u00e9part de l\u2019entreprise,<\/li>\n<li>Conflits au travail et contr\u00f4le de la r\u00e9glementation.<\/li>\n<\/ul>\n<h2><strong>Bo\u00eete \u00e0 outils<\/strong><\/h2>\n<p>La plate-forme donne aussi acc\u00e8s \u00e0 une <strong>bo\u00eete \u00e0 outils, pleine de solutions pratiques<\/strong> qui comprend<\/p>\n<ul>\n<li>une trentaine de mod\u00e8les de documents \u00e0 t\u00e9l\u00e9charger. (Certificat de travail, convocation \u00e0 un entretien pr\u00e9alable, re\u00e7u pour solde de tout compte, etc.)<\/li>\n<li>des simulateurs :\n<ul>\n<li>d\u2019indemnit\u00e9 de licenciement,<\/li>\n<li>de pr\u00e9avis de d\u00e9mission, ou de licenciement<\/li>\n<li>d\u2019estimation du salaire brut\/net,<\/li>\n<li>d\u2019indemnit\u00e9 de pr\u00e9carit\u00e9<\/li>\n<li>d\u2019heures pour recherche d\u2019emploi<\/li>\n<li>de calcul de ses droits,<\/li>\n<li>du co\u00fbt d\u2019embauche,<\/li>\n<li>de gratification d\u2019un stagiaire,<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><strong>Questions sp\u00e9cifiques<\/strong><\/h2>\n<p>Le Code r\u00e9pond aussi \u00e0 des <strong>questions sp\u00e9cifiques<\/strong> propres \u00e0 de nombreuses Conventions Collectives. Il met enfin en lien avec des applications d\u00e9j\u00e0 d\u00e9velopp\u00e9es comme <a href=\"https:\/\/www.moncompteformation.gouv.fr\/espace-prive\/html\/#\/\">\u00ab\u00a0Mon compte Formation\u00a0\u00bb<\/a>, ou des dossiers pr\u00e9par\u00e9s par diff\u00e9rents minist\u00e8res ou services consulaires ou gouvernementaux.<\/p>\n<p>En tapant le nom ou le num\u00e9ro SIRET de son entreprise, on acc\u00e8de directement \u00e0 la Convention Collective de son secteur d\u2019activit\u00e9. (60 branches professionnelles \u00e0 ce jour). Les \u00e9volutions \u00e0 venir du site int\u00e8greront les accords de branche manquants, et certains accords d\u2019entreprises importants.<\/p>\n<p>Enfin, actualit\u00e9 oblige, la plateforme dispose d\u2019un dossier tr\u00e8s complet sur le t\u00e9l\u00e9travail et le Covid-19. \u00a0Toutes les informations utiles y sont pr\u00e9sentes au travers de fiches, d\u2019infographies, de mod\u00e8les de documents, et des protocoles sanitaires.<\/p>\n<p>Certains de ces documents existaient d\u00e9j\u00e0 sur les sites officiels <a href=\"https:\/\/travail-emploi.gouv.fr\/\">travail-emploi.gouv.fr<\/a> ou <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/services-en-ligne-et-formulaires\">service-public.fr<\/a>, ou encore\u00a0la plateforme des solutions digitales pour les entreprises d\u00e9velopp\u00e9e par les Chambres de Commerce.
