Qu\u2019en est-il de la r\u00e9mun\u00e9ration lors du cong\u00e9 maternit\u00e9, cette p\u00e9riode pr\u00e9c\u00e9dant et suivant la naissance ?<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, revient dans cet article sur les conditions n\u00e9cessaires \u00e0 la r\u00e9mun\u00e9ration lors du cong\u00e9 maternit\u00e9.<\/p>\n<h3>Rappel :<\/h3>\n<ul>\n<li>Le cong\u00e9 de maternit\u00e9 pour les salari\u00e9es du priv\u00e9 est de 16 semaines. (26 \u00e0 partir du 3<span class=\"s1\"><sup>e<\/sup><\/span> enfant).<\/li>\n<li>Les professions lib\u00e9rales (m\u00e9decins, infirmi\u00e8res, sages-femmes) ou les avocates b\u00e9n\u00e9ficient des m\u00eames droits que les salari\u00e9es.<\/li>\n<li><span style=\"font-size: revert; color: initial; font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">Les travailleuses ind\u00e9pendantes b\u00e9n\u00e9ficient, elles aussi, d&rsquo;un cong\u00e9 maternit\u00e9 aussi long que celui des salari\u00e9es, \u00e9quivalent \u00e0 112 jours indemnis\u00e9s. (depuis <a style=\"font-size: revert; font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\" href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000038514527\/\"><span class=\"s1\">un d\u00e9cret<\/span><\/a> du 27 Mai 2019 visant \u00e0 am\u00e9liorer la protection sociale au titre de la maladie et de la maternit\u00e9 des <b style=\"font-size: revert; color: initial; font-family: -apple-system, BlinkMacSystemFont, 'Segoe UI', Roboto, Oxygen-Sans, Ubuntu, Cantarell, 'Helvetica Neue', sans-serif;\">travailleurs ind\u00e9pendants. <\/b>A<\/span>vant la mise en place de cette mesure, les travailleuses ind\u00e9pendantes n\u2019avaient droit qu\u2019\u00e0 deux semaines pr\u00e9natales et quatre post accouchement. Soit 44 jours d\u2019arr\u00eat maximum.<\/li>\n<\/ul>\n<div class=\"encadre-style\">Pendant leur cong\u00e9 maternit\u00e9, les femmes enceintes salari\u00e9es peuvent b\u00e9n\u00e9ficier de prestations appel\u00e9es indemnit\u00e9s journali\u00e8res. Et ce, sous r\u00e9serve de remplir les conditions requises (dur\u00e9e d\u2019affiliation minimale, nombre d\u2019heures de travail effectu\u00e9es, montant des cotisations pay\u00e9es\u2026).<\/div>\n<h2><strong>Conditions d\u2019obtention des indemnit\u00e9s journali\u00e8res\u00a0:<\/strong><\/h2>\n<p>Afin de percevoir les indemnit\u00e9s journali\u00e8res, la salari\u00e9e doit pouvoir\u00a0:<\/p>\n<ul>\n<li>Justifier d\u2019\u00eatre immatricul\u00e9e \u00e0 la S\u00e9curit\u00e9 sociale depuis un minimum de 6 mois au moment de l\u2019accouchement.\u00a0 Il s&rsquo;agit d&rsquo;un changement op\u00e9r\u00e9 en Ao\u00fbt 2023. Auparavant, la dur\u00e9e d&rsquo;affiliation requise \u00e9tait de 10 mois.<\/li>\n<li>Arr\u00eater de travailler pendant au moins 8 semaines (lors de son cong\u00e9 maternit\u00e9).<\/li>\n<\/ul>\n<p>En fonction de l\u2019emploi qu\u2019elle occupe au moment de la grossesse, la salari\u00e9e doit aussi justifier d\u2019un certain nombre d\u2019heures travaill\u00e9es, ou d\u2019un montant cotis\u00e9 minimum :<\/p>\n<ul>\n<li>Il faut avoir travaill\u00e9 au moins 150 heures au cours des trois mois pr\u00e9c\u00e9dant le cong\u00e9 maternit\u00e9.<\/li>\n<li>Si ce n\u2019est pas le cas, il faut avoir travaill\u00e9 un minimum de 600 heures dans l\u2019ann\u00e9e pr\u00e9c\u00e9dant la grossesse (en cas de contrat d\u2019int\u00e9rim, contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e, d\u2019emploi saisonnier, \u2026).<\/li>\n<li>Avoir cotis\u00e9 1015 fois le Smic horaire (soit <span class=\"s2\"><b>11 439,05 \u20ac<\/b><\/span> en 2023) lors des six mois pr\u00e9c\u00e9dant le cong\u00e9 maternit\u00e9, ou avoir cotis\u00e9 2030 fois le SMIC horaire (soit 22 878,10 \u20ac en 2023) lors des douze mois pr\u00e9c\u00e9dant le cong\u00e9 maternit\u00e9.<\/li>\n<\/ul>\n<h2><strong>Montant des indemnit\u00e9s journali\u00e8res\u00a0:<\/strong><\/h2>\n<p>Le calcul des indemnit\u00e9s journali\u00e8res est parfois complexe. Cependant, l\u2019Assurance Maladie a un mis en place un <a href=\"https:\/\/www.ameli.fr\/simulateur\">simulateur<\/a> afin de pouvoir conna\u00eetre \u00e0 l\u2019avance le montant des indemnit\u00e9s.<\/p>\n<p>Le calcul se base sur les trois derniers mois de salaire pr\u00e9c\u00e9dant le cong\u00e9 maternit\u00e9. Le calcul peut aussi se faire sur les douze derniers mois en cas de contrat int\u00e9rimaire, CDD ou d&rsquo;activit\u00e9 saisonni\u00e8re.\u00a0 Et la S\u00e9curit\u00e9 sociale a d\u00e9fini un plafond (3 377 \u20ac en 2019).<\/p>\n<p>En fonction de l\u2019activit\u00e9 et de la fr\u00e9quence des paiements de salaire, on peut prendre en compte les six ou les douze derniers salaires. De m\u00eame si le paiement de salaire est hebdomadaire ou bihebdomadaire.\u00a0 Lorsque la salari\u00e9e est en activit\u00e9 saisonni\u00e8re, on peut \u00e9galement calculer l\u2019indemnit\u00e9 sur les salaires de l\u2019ann\u00e9e compl\u00e8te. (Article R 323-4 du Code de la S\u00e9curit\u00e9 sociale)<\/p>\n<p>Par cons\u00e9quent, pour calculer le montant de l\u2019indemnit\u00e9 journali\u00e8re\u00a0:<\/p>\n<ul>\n<li>Dans le cas o\u00f9 l\u2019on prend en compte les trois derniers mois de salaire, on divise le total des salaires bruts par 91,25<\/li>\n<li>Si les paiements sont hebdomadaires ou bihebdomadaires, on prend le total des six ou derniers salaires bruts et on divise le total par 84.<\/li>\n<li>Enfin, s\u2019il s\u2019agit d\u2019une activit\u00e9 saisonni\u00e8re, on prend l\u2019ensemble des salaires de l\u2019ann\u00e9e que l\u2019on divise par 365.<\/li>\n<\/ul>\n<p>Une fois le montant journalier obtenu, la Caisse d\u2019Assurance Maladie applique\u00a0 (Article R331-5 du Code de la S\u00e9curit\u00e9 sociale) une d\u00e9duction forfaitaire de 21 %. Le calcul de l\u2019indemnit\u00e9 est ensuite diminu\u00e9 des 6,7% de la CSG et CRDS.<\/p>\n<p>Le minimum des indemnit\u00e9s journali\u00e8res est de 9,53 \u20ac en 2019, tandis que le maximum est de 87,71 \u20ac. De plus, en fonction de la Convention collective, l\u2019employeur peut verser un compl\u00e9ment pour maintenir un certain niveau de salaire, ou \u00e9ventuellement la totalit\u00e9 du salaire.<\/p>\n<h2><strong>Cas de la g\u00e9rante majoritaire\u00a0:<\/strong><\/h2>\n<p>Dans le cas o\u00f9 une femme ne serait pas salari\u00e9e mais g\u00e9rante d\u2019une soci\u00e9t\u00e9, elle b\u00e9n\u00e9ficie des m\u00eames droits que toute autre femme enceinte. A la condition qu\u2019elle ne soit pas majoritaire de sa soci\u00e9t\u00e9.<\/p>\n<p>Si la g\u00e9rante est majoritaire, des diff\u00e9rences s\u2019appliquent\u00a0:<\/p>\n<ul>\n<li>Elle va avoir le droit \u00e0 une allocation forfaitaire de repos maternel de 3 377 \u20ac (depuis le 1<sup>er<\/sup> janvier 2019), vers\u00e9e en deux fois : une premi\u00e8re moiti\u00e9 \u00e0 la fin du septi\u00e8me mois de grossesse, et le solde lorsque l\u2019enfant est n\u00e9. A noter que pour une adoption, le montant est de 1 688,50 \u20ac.<\/li>\n<li>La prise en charge des frais m\u00e9dicaux est effectu\u00e9e par la SSI. (S\u00e9curit\u00e9 Sociale des Ind\u00e9pendants). Et ce, si l\u2019\u00e9tablissement s\u00e9lectionn\u00e9 est conventionn\u00e9 ET agr\u00e9\u00e9.<\/li>\n<li>En ce qui concerne les indemnit\u00e9s forfaitaires, leur montant est de 55,51 \u20ac par jour.
