Cependant, la d\u00e9mission pour suivre son conjoint mut\u00e9 constituait une exception. (D\u00e9mission et allocation ch\u00f4mage)<\/p>\n<p>Depuis le 1er Novembre 2019, et dans le cadre de la derni\u00e8re r\u00e9forme de l\u2019assurance ch\u00f4mage, les salari\u00e9s d\u00e9missionnaires \u201cayant un projet de reconversion professionnelle, ou de cr\u00e9ation ou de reprise d\u2019entreprise\u201d peuvent \u00e9galement b\u00e9n\u00e9ficier de l\u2019assurance ch\u00f4mage.<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, d\u00e9taille dans cet articles les conditions de ce nouveau dispositif.<\/p>\n<h2><strong>Le principe<\/strong><\/h2>\n<p>Seules les personnes involontairement priv\u00e9es d\u2019emploi (licenciement, fin de CDD, rupture conventionnelle du CDI, rupture d\u2019un commun accord, rupture anticip\u00e9e d\u2019un CDD \u00e0 l\u2019initiative de l\u2019employeur, \u2026) peuvent normalement b\u00e9n\u00e9ficier des allocations ch\u00f4mage. A titre d\u00e9rogatoire, le salari\u00e9 d\u00e9missionnaire avait droit au ch\u00f4mage en cas de d\u00e9mission consid\u00e9r\u00e9e comme l\u00e9gitime (suivre son conjoint mut\u00e9 par exemple).<\/p>\n<p>A compter du <em>1er novembre 2019,<\/em> un salari\u00e9 d\u00e9missionnaire peut \u00e9galement pr\u00e9tendre aux allocations d\u2019assurance ch\u00f4mage, sous certaines conditions.<\/p>\n<p>Afin de b\u00e9n\u00e9ficier de ce dispositif, le demandeur doit\u00a0:<\/p>\n<ul>\n<li>Avoir \u00e9t\u00e9 salari\u00e9 durant les 5 ann\u00e9es pr\u00e9c\u00e9dentes, et de fa\u00e7on continue, chez un ou plusieurs employeurs. Cela correspond \u00e0 1300 jours travaill\u00e9s au cours des 60 mois pr\u00e9c\u00e9dant la fin du contrat de travail.<\/li>\n<li>Porter un projet de reconversion professionnelle ou un projet de cr\u00e9ation ou de reprise d\u2019entreprise.<\/li>\n<li>Avoir un projet ayant un caract\u00e8re \u00ab r\u00e9el et s\u00e9rieux \u00bb, attest\u00e9 par une commission paritaire interprofessionnelle r\u00e9gionale (CPIR).<\/li>\n<\/ul>\n<p>Attention, il convient de valider le projet avant de d\u00e9missionner ! (d\u00e9mission et allocation ch\u00f4mage ne vont pas \u00ab\u00a0naturellement\u00a0\u00bb de pair).<\/p>\n<h2><strong>Aide et conseils<\/strong><\/h2>\n<p>Le demandeur peut b\u00e9n\u00e9ficier d\u2019un service gratuit de conseil en \u00e9volution professionnelle (CEP). Celui-ci conseille le salari\u00e9, et l\u2019accompagne pour la mise en \u0153uvre de son projet. Ce conseil peut \u00eatre assur\u00e9 par\u00a0:<\/p>\n<ul>\n<li>P\u00f4le emploi,<\/li>\n<li>l\u2019Apec,<\/li>\n<li>les missions locales,<\/li>\n<li>les centres inter-institutionnels de bilan de comp\u00e9tences (CIBC)<\/li>\n<\/ul>\n<h2><strong>Formalisme<\/strong><\/h2>\n<p>A la fin des rendez-vous, le CEP remplit un document qui pr\u00e9sente le projet de reconversion. Celui-ci doit comprendre des informations d\u00e9finies par l\u2019arr\u00eat\u00e9 du 23\/10\/2019 \u00a0:<\/p>\n<p>&#8211; Le nom du conseiller CEP r\u00e9f\u00e9rent,<br \/>\n&#8211; La date de saisine du CEP par le salari\u00e9,<br \/>\n&#8211; Les diff\u00e9rentes d\u00e9marches entreprises (Bilan comp\u00e9tences, VAE\u2026),<br \/>\n&#8211; Les \u00e9l\u00e9ments motivant la reconversion professionnelle et t\u00e9moignant de la r\u00e9alit\u00e9 et du s\u00e9rieux de la d\u00e9marche,<br \/>\n&#8211; Les comp\u00e9tences du salari\u00e9 (savoir-faire, connaissances et qualit\u00e9s acquises qui pourront lui servir dans le m\u00e9tier envisag\u00e9, etc.),<br \/>\n&#8211; Les comp\u00e9tences restant \u00e0 acqu\u00e9rir,<br \/>\n&#8211; La connaissance du m\u00e9tier envisag\u00e9,<br \/>\n&#8211; Les d\u00e9marches effectu\u00e9es pour appr\u00e9hender \u00ab les tenants et les aboutissants de la future activit\u00e9 \u00bb,<br \/>\n&#8211; La formation envisag\u00e9e,<br \/>\n&#8211; Les perspectives d\u2019emploi \u00e0 l\u2019issue de la formation,<\/p>\n<p>Pour un projet de reprise ou de cr\u00e9ation d\u2019entreprise, il est n\u00e9cessaire \u00e9galement de fournir d\u2019autres \u00e9l\u00e9ments en plus de ceux cit\u00e9s ci-dessus. Il s\u2019agit par exemple de l\u2019analyse globale du march\u00e9 et de la concurrence, des besoins de financement, des moyens humains et techniques n\u00e9cessaires, \u2026<\/p>\n<p>Ce document est co-sign\u00e9 par le demandeur et la commission paritaire interprofessionnelle r\u00e9gionale (CPIR) \u00e0 qui il est envoy\u00e9.<\/p>\n<p>Le demandeur doit \u00e9galement adresser \u00e0 la commission la demande d\u2019attestation du caract\u00e8re r\u00e9el et s\u00e9rieux du projet, accompagn\u00e9e des pi\u00e8ces justificatives suivantes\u00a0:<\/p>\n<ul>\n<li>Une pr\u00e9sentation du programme, du calendrier et du montant des frais p\u00e9dagogiques,<\/li>\n<li>Une copie des dipl\u00f4mes, validation des acquis de l\u2019exp\u00e9rience professionnelle, ou tout document attestant que le demandeur dispose des niveaux de connaissance, de savoir-faire ou d\u2019exp\u00e9rience n\u00e9cessaires au suivi de la formation.<\/li>\n<\/ul>\n<h2><strong>Proc\u00e9dure<\/strong><\/h2>\n<p>Apr\u00e8s validation par la commission paritaire interprofessionnelle r\u00e9gionale (CPIR), le demandeur dispose de 6 mois pour d\u00e9missionner et s\u2019inscrire \u00e0 P\u00f4le emploi. Il recevra alors une indemnit\u00e9, et ce, sous le contr\u00f4le de P\u00f4le emploi.<\/p>\n<p>Au plus tard 6 mois apr\u00e8s l\u2019ouverture des droits, P\u00f4le emploi v\u00e9rifiera la r\u00e9alit\u00e9 de la mise en \u0153uvre du projet. Si celle-ci est r\u00e9elle, alors P\u00f4le emploi maintient l\u2019indemnit\u00e9. Dans le cas contraire, une suppression de l\u2019indemnit\u00e9 interviendra pendant 4 mois et le d\u00e9missionnaire sera radi\u00e9 de la liste des demandeurs d\u2019emploi pendant 4 mois.
