Formul\u00e9es dans la d\u00e9claration elle-m\u00eame, ou dans un courrier annexe, celles-ci ne peuvent cependant porter que \u201csur les circonstances de temps et de lieu de l\u2019accident, ou sur l\u2019existence d\u2019une cause totalement \u00e9trang\u00e8re au travail\u201d. <\/span><\/p>\n<p class=\"p5\"><span class=\"s2\">Jusqu\u2019au 30 Novembre 2019, <\/span><span class=\"s1\">l\u2019employeur disposait d\u2019un d\u00e9lai de deux mois apr\u00e8s notification de la CPAM pour contester l\u2019accident. A<\/span><span class=\"s2\"> partir du 1er D\u00e9cembre 2019, la contestation d\u2019un accident du travail (AT) devra imp\u00e9rativement \u00eatre faite dans les 10 jours francs suivant l\u2019accident. <\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, revient sur ce changement important de la l\u00e9gislation.<\/span><\/p>\n<h4 class=\"p6\"><span class=\"s1\"><b>La d\u00e9claration<\/b><\/span><\/h4>\n<p class=\"p7\"><span class=\"s1\">Le salari\u00e9 victime d\u2019un accident du travail (AT) doit en informer l\u2019employeur <\/span><\/p>\n<ul>\n<li class=\"p7\"><span class=\"s1\">de fa\u00e7on directe ou indirecte (au travers d\u2019une tierce personne) <\/span><\/li>\n<li class=\"p7\"><span class=\"s1\">dans les 24 heures, <\/span><\/li>\n<li class=\"p7\"><span class=\"s1\">par \u00e9crit, en Lettre Recommand\u00e9e avec Accus\u00e9 de R\u00e9ception (LRAR) <\/span><\/li>\n<li class=\"p7\"><span class=\"s1\">ou par oral, sauf en cas de force majeure.<\/span><\/li>\n<\/ul>\n<p class=\"p7\"><span class=\"s1\">L\u2019employeur d\u2019un salari\u00e9 victime d\u2019un accident du travail doit d\u00e9clarer l\u2019accident \u00e0 la Caisse d\u2019Assurance Maladie (CPAM). Il le fait dans un d\u00e9lai de 48 heures \u00e0 compter du moment o\u00f9 il en a \u00e9t\u00e9 inform\u00e9.<\/span><\/p>\n<p class=\"p9\"><span class=\"s1\">Attention : ces 48 heures sont exprim\u00e9es en jours ouvr\u00e9s, c\u2019est \u00e0 dire hors dimanches et jours f\u00e9ri\u00e9s. Un employeur qui a \u00e9t\u00e9 inform\u00e9 d&rsquo;un accident le vendredi a jusqu\u2019au lundi suivant pour le d\u00e9clarer.<\/span><\/p>\n<h4 class=\"p11\"><span class=\"s2\"><b>La forme de la d\u00e9claration<\/b><\/span><\/h4>\n<p class=\"p7\"><span class=\"s1\">La d\u00e9claration sera faite au travers du <a href=\"https:\/\/www.ameli.fr\/sites\/default\/files\/formulaires\/128\/s6200_homol_ix_17_rempl.pdf\"><span class=\"s3\">formulaire (Cerfa n\u00b014463*02),<\/span><\/a> \u00e0 t\u00e9l\u00e9charger. Elle<span class=\"Apple-converted-space\">\u00a0\u00a0<\/span>sera adress\u00e9e en 3 exemplaires \u00e0 la CPAM dont d\u00e9pend le salari\u00e9. L\u2019employeur fournira au salari\u00e9 une feuille d\u2019accident du travail qui permettra \u00e0 ce dernier de b\u00e9n\u00e9ficier de la prise en charge des soins m\u00e9dicaux li\u00e9s \u00e0 l\u2019accident.<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">En cas d\u2019arr\u00eat de travail, la d\u00e9claration d\u2019accident sera accompagn\u00e9e d\u2019une attestation de salaire <a href=\"https:\/\/www.ameli.fr\/sites\/default\/files\/formualires\/88\/s6202.pdf\"><span class=\"s3\">(formulaire Cerfa 11137*03)<\/span><\/a>.<\/span><\/p>\n<p class=\"p7\"><span class=\"s1\"><i>La d\u00e9claration d\u2019accident de travail peut aussi \u00eatre faite <\/i><span class=\"s3\"><i>directement en ligne<\/i><\/span><i>, sur le site Net-Entreprises.fr, le groupement d\u2019int\u00e9r\u00eat public (GIP) de la modernisation des d\u00e9clarations sociales.<\/i><\/span><\/p>\n<h4 class=\"p12\"><span class=\"s1\"><b>Les d\u00e9lais de notification de l\u2019accident<\/b><\/span><\/h4>\n<p class=\"p7\"><span class=\"s1\">Le service \u00abAccidents du Travail\u00bb de la CPAM a 30 jours pour contester le caract\u00e8re professionnel de l\u2019accident. Pass\u00e9 ce d\u00e9lai, l\u2019accident est consid\u00e9r\u00e9 comme reconnu d\u2019origine professionnelle.<\/span><\/p>\n<h4 class=\"p11\"><span class=\"s2\"><b>La contestation de l\u2019accident<\/b><\/span><\/h4>\n<p class=\"p7\"><span class=\"s1\">De son c\u00f4t\u00e9, l\u2019employeur peut exprimer des r\u00e9serves sur l\u2019origine de l\u2019accident et son caract\u00e8re professionnel. <b>Cela ne le dispense pas cependant d\u2019\u00e9tablir la d\u00e9claration. <\/b><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">Jusqu\u2019\u00e0 pr\u00e9sent, l\u2019employeur disposait d\u2019un d\u00e9lai de deux mois apr\u00e8s notification de la CPAM pour contester l\u2019accident. Il pouvait \u00e9galement exprimer ses r\u00e9serves directement sur la d\u00e9claration. <\/span><\/p>\n<p class=\"p14\"><span class=\"s1\"><b>C\u2019est ce d\u00e9lai qui est profond\u00e9ment modifi\u00e9. En effet, \u00e0 partir du 1er D\u00e9cembre 2019,<span class=\"Apple-converted-space\">\u00a0 <\/span>l\u2019employeur doit imp\u00e9rativement contester l\u2019accident du travail dans les 10 jours francs suivant l\u2019accident.<\/b><\/span><\/p>\n<p class=\"p7\"><span class=\"s1\">Ce d\u00e9lai s\u2019entend \u00e0 partir de :<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li15\"><span class=\"s2\">La date \u00e0 laquelle l\u2019employeur a effectu\u00e9 la d\u00e9claration d\u2019accident du travail,<\/span><\/li>\n<li class=\"li15\"><span class=\"s2\">La date \u00e0 laquelle l\u2019employeur a re\u00e7u le double de la d\u00e9claration d\u2019accident du travail lorsque cette d\u00e9claration a \u00e9t\u00e9 faite par la victime ou ses repr\u00e9sentants.<\/span><\/li>\n<\/ul>\n<h4 class=\"p17\"><span class=\"s1\"><b>Qu\u2019est-ce qu\u2019un d\u00e9lai en \u00ab\u00a0jours francs\u00a0\u00bb ?<\/b><\/span><\/h4>\n<p class=\"p18\"><span class=\"s1\">Ce d\u00e9lai ne comprend ni le jour de \u00ab l\u2019\u00e9v\u00e8nement \u00bb, ni le jour de l\u2019\u00e9ch\u00e9ance. Il d\u00e9bute donc le lendemain du jour de \u00ab l\u2019\u00e9v\u00e8nement \u00bb, et se termine le dernier jour (du d\u00e9lai) \u00e0 minuit. Si le dernier jour (du d\u00e9lai) tombe un samedi, un dimanche ou un jour f\u00e9ri\u00e9, il est alors report\u00e9 au premier jour ouvrable suivant. <\/span><\/p>\n<p class=\"p18\"><span class=\"s1\">Exemples :<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li19\"><span class=\"s2\">La date de d\u00e9claration d\u2019accident du travail est le mardi 3 d\u00e9cembre 2019 \u00e0 16h : le d\u00e9lai d\u00e9bute le mercredi 4 d\u00e9cembre 2019 \u00e0 0h et se termine le vendredi 13 d\u00e9cembre \u00e0 minuit. La contestation de l\u2019accident devra \u00eatre re\u00e7ue jusqu\u2019au vendredi 13 d\u00e9cembre \u00e0 minuit.<\/span><\/li>\n<li class=\"li19\"><span class=\"s2\">La date de d\u00e9claration d\u2019accident du travail est le mercredi 4 d\u00e9cembre 2019 \u00e0 16h : le d\u00e9lai d\u00e9bute le jeudi 5 d\u00e9cembre 2019 \u00e0 0h et se termine le samedi 14 d\u00e9cembre \u00e0 minuit. Ce dernier jour \u00e9tant un samedi, il est report\u00e9 au lundi 16 d\u00e9cembre. La contestation de l\u2019accident devra donc \u00eatre re\u00e7ue avant le lundi 16 d\u00e9cembre \u00e0 minuit.<\/span><\/li>\n<\/ul>\n<h4 class=\"p22\"><span class=\"s1\"><b>Les motifs de la contestation de l\u2019accident<\/b><\/span><\/h4>\n<p class=\"p5\"><span class=\"s1\">La c<\/span><span class=\"s2\">ontestation d\u2019un accident du travail ne peut \u00eatre <\/span><span class=\"s1\">fond\u00e9e que sur l&rsquo;absence de lien entre le travail du salari\u00e9 et l&rsquo;accident. Ainsi, lorsque l\u2019accident :<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li5\"><span class=\"s1\">n\u2019a pas de caract\u00e8re soudain (impr\u00e9vu),<\/span><\/li>\n<li class=\"li5\"><span class=\"s1\">n&rsquo;a aucune relation avec le travail<\/span><\/li>\n<li class=\"li5\"><span class=\"s1\">n&rsquo;est pas intervenu sur le lieu de travail (ou de mission) du salari\u00e9 <\/span><\/li>\n<li class=\"li5\"><span class=\"s1\">n&rsquo;a pas eu lieu pendant les horaires de travail,<\/span><\/li>\n<\/ul>\n<p class=\"p5\"><span class=\"s1\">le \u201cfait accidentel\u201d et son \u201ccaract\u00e8re professionnel\u201d ne peuvent \u00eatre retenus. De m\u00eame s\u2019il n\u2019y a pas de t\u00e9moin, pas de blessure, ou que celle-ci n\u2019a pas de lien avec l\u2019accident d\u00e9crit.<\/span><\/p>\n<p class=\"p5\"><span class=\"s1\">L<\/span><span class=\"s2\">a contestation doit \u00eatre motiv\u00e9e. Un arr\u00eat de la Cour de cassation pr\u00e9cise d\u2019ailleurs que les r\u00e9serves ne peuvent porter <i>\u00ab que sur les circonstances de temps et de lieu de celui-ci ou sur l&rsquo;existence d&rsquo;une cause totalement \u00e9trang\u00e8re au travail \u00bb<\/i>. <\/span><\/p>\n<h4 class=\"p6\"><span class=\"s1\"><b>Enqu\u00eate<\/b><\/span><\/h4>\n<p class=\"p4\"><span class=\"s1\">Lorsque l\u2019employeur a \u00e9mis des r\u00e9serves motiv\u00e9es, ou lorsque la CPAM l&rsquo;estime n\u00e9cessaire, un questionnaire sur les circonstances ou la cause de l&rsquo;accident ou de la maladie est envoy\u00e9e par la caisse avant sa d\u00e9cision.
