Chaque ann\u00e9e, tout salari\u00e9 a droit en effet \u00e0 des jours de cong\u00e9s pay\u00e9s. Et ce, quel que soit son type de contrat, sa dur\u00e9e du travail ou encore son anciennet\u00e9. Cependant, il existe des dispositions l\u00e9gales en mati\u00e8re de cong\u00e9s pay\u00e9s suppl\u00e9mentaires, notamment pour enfants \u00e0 charge. Dans quelles conditions un salari\u00e9 peut-il en b\u00e9n\u00e9ficier ?<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts-de-France, fait le point dans cet article sur les cong\u00e9s suppl\u00e9mentaires pour enfants \u00e0 charge.<\/p>\n<h3>Rappel<\/h3>\n<p>Un salari\u00e9 acquiert ainsi 2,5 jours ouvrables par mois travaill\u00e9 chez son employeur, ce qui repr\u00e9sente 5 semaines de cong\u00e9s pay\u00e9s (ou 30 jours ouvrables) pour une ann\u00e9e compl\u00e8te de travail. Pour rappel, la p\u00e9riode de r\u00e9f\u00e9rence d\u2019acquisition des cong\u00e9s court du 1<sup>er<\/sup> juin de l\u2019ann\u00e9e N au 31 mai de l\u2019ann\u00e9e N+1.<\/p>\n<h2><strong>La notion \u00ab\u00a0d\u2019enfant \u00e0 <\/strong><strong>charge\u00a0\u00bb<\/strong><\/h2>\n<p>Un enfant est consid\u00e9r\u00e9 \u201c\u00e0 charge\u201d s\u2019il vit au foyer et s\u2019il est \u00e2g\u00e9 de moins de 15 ans au 30 avril de l\u2019ann\u00e9e en cours. Il peut \u00e9galement s\u2019agir d\u2019un enfant en situation de handicap (sans condition d\u2019\u00e2ge) vivant au foyer.<\/p>\n<h2><strong>Salari\u00e9 \u00e2g\u00e9 de plus de 21 ans<\/strong><\/h2>\n<p>Un salari\u00e9 \u00e2g\u00e9 de plus de 21 ans au 30 avril de l\u2019ann\u00e9e pr\u00e9c\u00e9dant la fin de p\u00e9riode d\u2019acquisition des cong\u00e9s, et ayant un ou des enfants \u00e0 charge, b\u00e9n\u00e9ficie\u00a0de 2 jours de cong\u00e9s pay\u00e9s suppl\u00e9mentaires par enfant \u00e0 charge, <strong>dans la limite de 30 jours ouvrables de cong\u00e9s<\/strong> (cong\u00e9s annuels + suppl\u00e9mentaires).<\/p>\n<p>Le salari\u00e9 b\u00e9n\u00e9ficie \u00ab\u00a0de droit\u00a0\u00bb de cet avantage d\u00e8s qu&rsquo;il n&rsquo;a pas acquis la totalit\u00e9 de ses cong\u00e9s pay\u00e9s (c&rsquo;est \u00e0 dire 30 jours ouvrables). Et ce, quelle que soit la nature des absences qui ont occasionn\u00e9 ce cong\u00e9 \u00ab\u00a0incomplet\u00a0\u00bb, qu&rsquo;il s&rsquo;agisse d&rsquo;une embauche en cours d\u2019ann\u00e9e, d&rsquo;une absence maladie, d&rsquo;un cong\u00e9 sans solde, etc.<\/p>\n<p><strong>Ainsi, un salari\u00e9 ayant d\u00e9j\u00e0 acquis ses 30 jours ouvrables de cong\u00e9s pay\u00e9s ne pourra pas b\u00e9n\u00e9ficier des jours suppl\u00e9mentaires pour enfants \u00e0 charge.<\/strong><\/p>\n<h2><strong>Salari<\/strong><strong>\u00e9 \u00e2g\u00e9 de moins de 21 ans<\/strong><\/h2>\n<p>Un salari\u00e9 \u00e2g\u00e9 de moins de 21 ans au 30 avril de l\u2019ann\u00e9e pr\u00e9c\u00e9dant la fin de p\u00e9riode d\u2019acquisition des cong\u00e9s, et ayant un ou des enfants \u00e0 charge, b\u00e9n\u00e9ficie\u00a0:<\/p>\n<ul>\n<li>de 2 jours de cong\u00e9s pay\u00e9s suppl\u00e9mentaires par enfant \u00e0 charge,<\/li>\n<li>ou de 1 jour si les cong\u00e9s pay\u00e9s acquis ne d\u00e9passent pas 6 jours.<\/li>\n<\/ul>\n<p>De ce fait, le salari\u00e9 en question pourra b\u00e9n\u00e9ficier de plus de 30 jours de cong\u00e9s, si sa p\u00e9riode de r\u00e9f\u00e9rence a \u00e9t\u00e9 travaill\u00e9e en totalit\u00e9 (30 jours + les cong\u00e9s suppl\u00e9mentaires).<\/p>\n<h2><strong>Cas particulier du salari<\/strong><strong>\u00e9 \u00e2g\u00e9 de moins de 21 ans n\u2019ayant pas d\u2019enfant \u00e0 <\/strong><strong>charge <\/strong><\/h2>\n<p>Un salari\u00e9 \u00e2g\u00e9 de moins de 21 ans au 30 avril de l\u2019ann\u00e9e pr\u00e9c\u00e9dant la fin de p\u00e9riode d\u2019acquisition des cong\u00e9s, a droit, s\u2019il le demande, \u00e0 un cong\u00e9 de 30 jours ouvrables, m\u00eame s\u2019il n\u2019a pas travaill\u00e9 assez pour les acqu\u00e9rir. Cependant, les jours suppl\u00e9mentaires qui lui seront accord\u00e9s ne seront pas r\u00e9mun\u00e9r\u00e9s. Il s\u2019agira ici d\u2019une simple autorisation d\u2019absence.<\/p>\n<h2><strong>A quelle date les cong\u00e9<\/strong><strong>s suppl\u00e9mentaires doivent-ils \u00ea<\/strong><strong>tre attribu\u00e9s\u00a0?<\/strong><\/h2>\n<p>Les cong\u00e9s suppl\u00e9mentaires sont attribu\u00e9s \u00e0 la fin de la p\u00e9riode de r\u00e9f\u00e9rence des cong\u00e9s pay\u00e9s, c\u2019est-\u00e0-dire au 31 mai.<\/p>\n<h2><strong>Les cong\u00e9<\/strong><strong>s suppl\u00e9mentaires pr\u00e9vus par la convention collective sont-ils cumulables\u00a0?<\/strong><\/h2>\n<p>Si la convention collective applicable \u00e0 l\u2019entreprise pr\u00e9voit un droit \u00e0 cong\u00e9s suppl\u00e9mentaires pour enfants \u00e0 charge sup\u00e9rieur \u00e0 la loi, alors c\u2019est la convention qui s\u2019applique, mais les cong\u00e9s ne se cumulent pas. En revanche, si le droit \u00e0 cong\u00e9s suppl\u00e9mentaires pr\u00e9vu par la convention collective est inf\u00e9rieur \u00e0 la loi, c\u2019est la loi qui s\u2019applique (sans cumul \u00e9galement).<\/p>\n<p>Attention, si la convention collective \u00e9voque des cong\u00e9s suppl\u00e9mentaires pour enfants \u00e0 charge pour les m\u00e8res de famille, ces cong\u00e9s s\u2019appliquent \u00e9galement au p\u00e8re de famille, du fait du principe d\u2019\u00e9galit\u00e9.<\/p>\n<p>Toutefois, si la convention collective pr\u00e9voit par exemple des jours suppl\u00e9mentaires pour enfant malade, ceux-ci s\u2019ajoutent aux cong\u00e9s suppl\u00e9mentaires pour enfants \u00e0 charge pr\u00e9vus par la loi, car leur objet n\u2019est pas le m\u00eame.<\/p>\n<h2><strong>Limite de cette disposition d\u2019ordre l\u00e9gal<\/strong><\/h2>\n<p>Pour que l\u2019employeur puisse attribuer aux salari\u00e9s des jours de cong\u00e9s pay\u00e9s suppl\u00e9mentaires pour enfants \u00e0 charge, encore faut-il qu\u2019il connaisse la situation personnelle des salari\u00e9s.
