Elle a en effet \u00e9t\u00e9 adopt\u00e9e en vue de :<\/p>\n<ul>\n<li>promouvoir la construction de nouveaux logements,<\/li>\n<li>faciliter la mobilit\u00e9 dans le parc social,<\/li>\n<li>et de lutter contre l\u2019habitat indigne.<\/li>\n<\/ul>\n<p>C\u2019est dans ce cadre qu\u2019a \u00e9t\u00e9 introduit ce nouveau droit de reprise au profit du bailleur d\u2019un local commercial. Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, vous en dit plus.<\/p>\n<p>&nbsp;<\/p>\n<h4>Le statut des baux commerciaux<\/h4>\n<p><strong>Le statut des <a href=\"https:\/\/valoxy.org\/blog\/bail-commercial-2\/\">baux commerciaux<\/a>, et plus particuli\u00e8rement l\u2019article L.145-4 alin\u00e9a 3 du Code de commerce permet au bailleur d\u2019un local commercial de donner cong\u00e9 \u00e0 son locataire soit \u00e0 l\u2019expiration d\u2019une p\u00e9riode triennale, soit \u00e0 la fin de bail, dans les cas suivants :<\/strong><\/p>\n<ul>\n<li>Construire, reconstruire ou sur\u00e9lever l\u2019immeuble existant ;<\/li>\n<li>R\u00e9affecter le local d\u2019habitation accessoire \u00e0 cet usage ;<\/li>\n<li>Ex\u00e9cuter des travaux prescrits ou autoris\u00e9s dans le cadre d\u2019une op\u00e9ration de restauration immobili\u00e8re ;<\/li>\n<li>D\u00e9molir l\u2019immeuble dans le cadre d\u2019un projet de renouvellement urbain.<\/li>\n<\/ul>\n<h4>Nouveaux droits gr\u00e2ce \u00e0 la loi Elan<\/h4>\n<p>La \u00ab loi Elan \u00bb cr\u00e9\u00e9e un nouveau droit de reprise au profit du bailleur d\u2019un local commercial. Elle permet de donner cong\u00e9 \u00e0 l\u2019expiration d\u2019une p\u00e9riode triennale, pour transformer \u00e0 usage principal d\u2019habitation un immeuble commercial existant, par reconstruction, r\u00e9novation ou r\u00e9habilitation.<\/p>\n<p><strong>Jusqu\u2019\u00e0 pr\u00e9sent, le droit de reprise \u00e9tait limit\u00e9 aux seuls locaux d\u2019habitation lou\u00e9s comme accessoires de locaux commerciaux. Il\u00a0 permet dor\u00e9navant la transformation de locaux commerciaux en locaux d\u2019habitation.<\/strong><\/p>\n<p>En pratique, le bailleur ne dispose plus d\u00e9sormais seulement d&rsquo;un droit de reprise partielle du seul local d&rsquo;habitation accessoire non utilis\u00e9 comme tel en r\u00e9alit\u00e9. Il dispose aussi d&rsquo;un droit de reprise portant sur le local commercial lui-m\u00eame pour le transformer en local d&rsquo;habitation \u00e0 titre principal.<\/p>\n<h4>Rappel<\/h4>\n<p>Rappelons que dans tous les cas, le cong\u00e9 donn\u00e9 par le bailleur doit respecter les formes et les d\u00e9lais mentionn\u00e9s \u00e0 l\u2019article L145-9 du Code de commerce. Le cong\u00e9 doit ainsi :<\/p>\n<ul>\n<li>Etre donn\u00e9 six mois avant l\u2019\u00e9ch\u00e9ance de la p\u00e9riode triennale ou de la fin du bail\u00a0;<\/li>\n<li>Etre signifi\u00e9 par acte extrajudiciaire\u00a0;<\/li>\n<li>Pr\u00e9ciser les motifs pour lesquels il est donn\u00e9\u00a0;<\/li>\n<li>Indiquer que le locataire a la facult\u00e9 de saisir le Tribunal avant l\u2019expiration d\u2019un d\u00e9lai de 2 ans \u00e0 compter de la date \u00e0 laquelle le cong\u00e9 a \u00e9t\u00e9 donn\u00e9 s\u2019il entend contester le cong\u00e9 ou demander le versement d\u2019une indemnit\u00e9 d\u2019\u00e9viction.<\/li>\n<\/ul>\n<p>Les bailleurs peuvent \u00e9voquer ce nouveau motif de r\u00e9siliation triennale depuis le 25 novembre 2018, date d&rsquo;entr\u00e9e en vigueur de la loi.<\/p>\n<p>Cette mesure permet ainsi aux bailleurs de reprendre plus facilement et rapidement leur bien afin d&rsquo;y effectuer les travaux de transformation de bureaux en logement d\u2019habitation. Elle vise ainsi &#8211; tr\u00e8s partiellement il est vrai &#8211; \u00e0 faire face \u00e0 la crise du logement, en favorisant la mutation de locaux commerciaux en logements.<\/p>\n<p>&nbsp;<\/p>\n<p>Cet article vous a plu ?
