Parmi les mesures \u00e9dict\u00e9es figure la cr\u00e9ation d\u2019un nouveau type de bail d\u2019habitation qui facilite la mobilit\u00e9 professionnelle \u00a0: le bail \u00ab\u00a0mobilit\u00e9\u00a0\u00bb.<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, rappelle dans cet article les caract\u00e9ristiques et les principaux atouts de cette mesure.<\/p>\n<h2>Un nouveau type de bail<\/h2>\n<p><strong>La loi \u00ab\u00a0Elan\u00a0\u00bb instaure un nouveau type de bail, dit \u201cmobilit\u00e9 de courte dur\u00e9e\u201d, afin de soutenir l\u2019offre locative et de r\u00e9sorber la fuite des locations vers les plateformes de location saisonni\u00e8re.<\/strong><\/p>\n<p>Ce bail vise les locataires en mobilit\u00e9 professionnelle (formation professionnelle, contrat d\u2019apprentissage, stage, engagement volontaire dans le cadre d\u2019un service civique, mutation professionnelle, mission temporaire). Ce nouveau type de contrat de location concerne donc \u00e9galement les jeunes actifs et les \u00e9tudiants. Le motif de mobilit\u00e9 professionnelle doit \u00eatre sp\u00e9cifi\u00e9 dans le bail. Le locataire doit fournir un justificatif \u00e0 la signature du contrat de location.<\/p>\n<p>En revanche, le bailleur peut \u00eatre une SCI ou une soci\u00e9t\u00e9 commerciale, un particulier propri\u00e9taire ou un investisseur.<\/p>\n<h2>Les modalit\u00e9s de conclusion et de r\u00e9siliation de ce bail<\/h2>\n<p>Les modalit\u00e9s de conclusion et de r\u00e9siliation de ce bail sont plus souples que celles d\u2019un bail de location classique\u00a0:<\/p>\n<ul>\n<li>Sont vis\u00e9es les locations de logements meubl\u00e9s.<\/li>\n<\/ul>\n<p>Il est ainsi possible pour un propri\u00e9taire de mettre en location sa r\u00e9sidence principale pour quelques temps. Aucune d\u00e9claration pr\u00e9alable ou d\u2019autorisation administrative n\u2019est n\u00e9cessaire. En revanche, le logement doit r\u00e9pondre aux r\u00e8gles de d\u00e9cence. Un logement n\u2019est pas d\u00e9cent si la s\u00e9curit\u00e9 et la sant\u00e9 des locataires ne sont pas assur\u00e9es et si les \u00e9quipements essentiels ne sont pas fournis (cuisine, eau chaude et froide\u2026)<\/p>\n<ul>\n<li>Sa dur\u00e9e peut \u00eatre fix\u00e9e de 1 \u00e0 10 mois<\/li>\n<li>Il se conclut sans d\u00e9p\u00f4t de garantie<\/li>\n<\/ul>\n<p>Cependant, et avant la signature du bail \u201cmobilit\u00e9\u201d, le propri\u00e9taire peut exiger la caution d&rsquo;un tiers (appel\u00e9e \u00abcaution solidaire \u00bb). La loi Elan supprime, sur ce point, l\u2019obligation pour le garant de recopier la mention manuscrite sur l\u2019acte de caution. Une signature du garant sur l\u2019acte de caution est suffisante.<\/p>\n<ul>\n<li>Les charges aff\u00e9rentes \u00e0 la location sont vers\u00e9es de mani\u00e8re forfaitaire sans possibilit\u00e9 de r\u00e9gularisation. Le contrat fixe le montant des charges et leur p\u00e9riodicit\u00e9.<\/li>\n<li>Seul le locataire peut le r\u00e9silier, \u00e0 tout moment, moyennant un pr\u00e9avis d\u2019un mois, et sans motif. Le bailleur ne peut donner cong\u00e9 au locataire avant la fin du bail, sauf s\u2019il consid\u00e8re que le locataire ne respecte pas les clauses du bail (non versement du loyer ou des charges locatives par exemple)<\/li>\n<li>En cas de colocation pr\u00e9vue au contrat, <strong>aucune clause de solidarit\u00e9<\/strong> n\u2019est applicable.<\/li>\n<\/ul>\n<h4><strong>Doivent \u00eatre annex\u00e9s au bail \u201cmobilit\u00e9\u201d les \u00e9l\u00e9ments suivants\u00a0:<\/strong><\/h4>\n<ul>\n<li>l\u2019\u00e9tat des lieux\u00a0;<\/li>\n<li>l\u2019inventaire des \u00e9quipements mis \u00e0 la disposition du locataire dans le logement meubl\u00e9\u00a0;<\/li>\n<li>l\u2019attestation d\u2019assurance contre les risques locatifs\u00a0;<\/li>\n<li>les d\u00e9crets n\u00b087-713 du 26 ao\u00fbt 1987 et n\u00b087-712 fixant la liste des charges r\u00e9cup\u00e9rables et la liste des r\u00e9parations locatives\u00a0;<\/li>\n<li>les diagnostics techniques regroup\u00e9s dans le dossier de diagnostic technique (DDT)\u00a0; il comprend l\u2019\u00e9tat des risques naturels et technologiques, le diagnostic de performance \u00e9nerg\u00e9tique (DPE), le contrat des risques d\u2019exposition au plomb (CREP) et l\u2019\u00e9tat de l\u2019installation int\u00e9rieure d\u2019\u00e9lectricit\u00e9 et de gaz.<\/li>\n<\/ul>\n<p>Les revenus issus du bail \u201cmobilit\u00e9\u201d sont imposables dans la cat\u00e9gorie des b\u00e9n\u00e9fices industriels et commerciaux (BIC).
