Il se substitue aux d\u00e9l\u00e9gu\u00e9s du personnel (DP) pour communiquer aux organes de direction les requ\u00eates des salari\u00e9s. Quelle est la mission exacte du CSE et comment le mettre en place dans votre entreprise\u00a0?<\/p>\n<p>Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, donne la marche \u00e0 suivre dans cet article.<\/p>\n<h2>La mission du Comit\u00e9 Social Economique<\/h2>\n<p>Le Comit\u00e9 Social Economique (CSE) est n\u00e9 des \u201cordonnances Macron\u201d d\u2019Ao\u00fbt 2017, dont les d\u00e9crets d\u2019application ont \u00e9t\u00e9 publi\u00e9s le 30 d\u00e9cembre 2017. Il vise \u00e0 remplacer les d\u00e9l\u00e9gu\u00e9s du personnel (DP) dans toutes les entreprises de plus de 10 salari\u00e9s. Dans les entreprises de 50 salari\u00e9s et plus, le CSE va plus loin\u00a0: il se dote de la personnalit\u00e9 juridique\u00a0; il remplace les d\u00e9l\u00e9gu\u00e9s du personnel (DP), mais aussi le Comit\u00e9 d\u2019Entreprise (CE) et le Comit\u00e9 d\u2019Hygi\u00e8ne, de S\u00e9curit\u00e9 et des Conditions de Travail (CHSCT). Ainsi le CSE vient-il en quelque sorte prolonger la volont\u00e9 simplificatrice du l\u00e9gislateur en ce qui concerne les instances repr\u00e9sentatives du personnel, initi\u00e9e en 1993 par la cr\u00e9ation de la D\u00e9l\u00e9gation Unique du Personnel (DUP).<\/p>\n<p>Cependant, le r\u00f4le du Comit\u00e9 Social Economique (CSE) n\u2019est pas exactement le m\u00eame selon l\u2019effectif de l\u2019entreprise.<\/p>\n<ul>\n<li>Dans les entreprises de 10 \u00e0 49 salari\u00e9s, le CSE a pour objectif de pr\u00e9senter \u00e0 l\u2019employeur les requ\u00eates et sollicitations des salari\u00e9s, qu\u2019elles soient collectives ou individuelles (salaires, application du Code du travail&#8230;). Le CSE doit aussi promouvoir la sant\u00e9, la s\u00e9curit\u00e9 et les bonnes conditions de travail dans l\u2019entreprise.<\/li>\n<li>Dans les entreprises de 50 salari\u00e9s ou plus, outre ces m\u00eames missions, le CSE doit \u00e9galement assurer la prise en compte des requ\u00eates et des int\u00e9r\u00eats des salari\u00e9s dans les d\u00e9cisions li\u00e9es \u00e0 la gestion et \u00e0 la strat\u00e9gie de l\u2019entreprise, \u00e0 l\u2019organisation du travail et \u00e0 la formation professionnelle. Plus qu\u2019un rapporteur comme c\u2019est le cas dans les entreprises de moins de 50 salari\u00e9s, le CSE devient ici interm\u00e9diaire et n\u00e9gociateur.<\/li>\n<\/ul>\n<p><strong>Voir notre article : <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/la-representation-syndicale-en-entreprise\/\" target=\"_self\" rel=\"noopener\">La repr\u00e9sentation syndicale en entreprise<\/a><\/strong><\/p>\n<p>&nbsp;<\/p>\n<h2>Le droit d\u2019alerte dispara\u00eet dans les petites entreprises\u00a0!<\/h2>\n<p>Avec l\u2019ordonnance Macron, seuls les CSE ayant la personnalit\u00e9 juridique peuvent se saisir du droit d\u2019alerte. En cons\u00e9quence, <strong>celui-ci dispara\u00eet pour les entreprises de moins de 50 salari\u00e9s<\/strong>. Il est maintenu pour les entreprises de 50 salari\u00e9s ou plus. (Voir notre article <a href=\"https:\/\/valoxy.org\/blog\/procedure-dalerte\/\">La proc\u00e9dure d\u2019alerte dans les entreprises : comment pr\u00e9venir les difficult\u00e9s ?<\/a>)<\/p>\n<h2><\/h2>\n<h2>Comment cr\u00e9er le Comit\u00e9 Social Economique dans votre entreprise ?<\/h2>\n<p>En tant qu\u2019employeur, vous devez organiser des \u00e9lections de constitution du Comit\u00e9 Social \u00c9conomique selon les conditions de vote des membres du comit\u00e9 d\u2019entreprise. Les \u00e9lections doivent avoir lieu pendant le temps de travail, \u00e0 bulletin secret (papier ou voie \u00e9lectronique).<\/p>\n<p>Le Comit\u00e9 Social et Economique pouvait donc \u00eatre mis en place d\u00e8s le 1er Janvier 2018, au terme des mandats des DP, du CE, de la DUP et\/ou du CHSCT, et en tout \u00e9tat de cause, il devra l\u2019\u00eatre avant le 31 d\u00e9cembre 2019.<\/p>\n<p>&nbsp;<\/p>\n<h3>Personnes \u00e9ligibles au Comit\u00e9 Social \u00c9conomique<\/h3>\n<p>Les personnes \u00e9ligibles au CSE doivent avoir un an d\u2019anciennet\u00e9 au minimum dans l\u2019entreprise et ne pr\u00e9senter aucun lien de parent\u00e9 avec l\u2019employeur. Une liste doit \u00eatre pr\u00e9sent\u00e9e pour chaque cat\u00e9gorie de personnel (salari\u00e9, cadre, ouvrier&#8230;). Le premier tour doit obligatoirement \u00eatre effectu\u00e9 sous l\u2019\u00e9tiquette d\u2019un syndicat, et l\u2019\u00e9quilibre homme-femme doit \u00eatre respect\u00e9 proportionnellement \u00e0 celui qui pr\u00e9vaut dans l\u2019entreprise.<\/p>\n<p>Un second tour est organis\u00e9 dans les cas suivants\u00a0:<\/p>\n<ul>\n<li>quand le nombre de votants est inf\u00e9rieur \u00e0 50\u00a0% des \u00e9lecteurs inscrits sur la liste<\/li>\n<li>quand il reste des si\u00e8ges \u00e0 pourvoir apr\u00e8s le premier tour<\/li>\n<\/ul>\n<h3>Modalit\u00e9s de vote<\/h3>\n<p>Les salari\u00e9s votent pour une liste et non pour un ou plusieurs candidats isol\u00e9s.
