Tout comme la rupture conventionnelle individuelle, la RCC permet de mettre fin \u00e0 plusieurs contrats de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e de mani\u00e8re amiable. Le Minist\u00e8re du Travail a \u00e9dit\u00e9 une s\u00e9rie de <a href=\"http:\/\/travail-emploi.gouv.fr\/ministere\/documentation-et-publications-officielles\/guides\/QR-RCC\">\u00ab\u00a0Questions-R\u00e9ponses\u00a0\u00bb sur ce th\u00e8me<\/a>.<\/p>\n<p class=\"p1\"><span class=\"s1\">Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, reprend ici les grandes lignes de ce dispositif.<\/span><\/p>\n<h4><strong><u>Quel est le champ d\u2019application de la rupture conventionnelle collective\u00a0?<\/u><\/strong><\/h4>\n<p>Le but de la RCC est d\u2019encadrer des d\u00e9parts volontaires. Il ne s\u2019agit ici ni de d\u00e9missions, ni de licenciements. Le principe repose sur la r\u00e9daction d\u2019un accord collectif sign\u00e9 entre l\u2019employeur et les organisations syndicales (voire les salari\u00e9s eux-m\u00eames &#8211; en fonction de la taille de l\u2019entreprise) et d\u2019un accord individuel avec chaque salari\u00e9 volontaire. Le r\u00e9gime de la RCC est donc totalement d\u00e9connect\u00e9 de celui de la rupture conventionnelle individuelle ou de celui du licenciement \u00e9conomique.<\/p>\n<h4><strong><u>U<\/u><\/strong><strong><u>n motif \u00e9conomique doit-il justifier la RCC ?<\/u><\/strong><\/h4>\n<p>Non. L\u2019accord peut d\u2019ailleurs pr\u00e9voir un nombre de d\u00e9parts volontaires sup\u00e9rieur au nombre d\u2019emplois supprim\u00e9s, et recruter de nouveaux salari\u00e9s sur les postes vacants.<\/p>\n<p>Pour atteindre l\u2019objectif fix\u00e9 de suppression d\u2019emplois, <strong>l\u2019accord doit exclure tout licenciement<\/strong>. Autrement dit, l\u2019accord doit <u>proposer<\/u> aux salari\u00e9s d\u2019opter librement pour le d\u00e9part volontaire, ou le maintien dans l\u2019emploi. La DIRECCTE (Direction R\u00e9gionale des Entreprises, de la Concurrence, de la Consommation, du Travail et de l\u2019Emploi) v\u00e9rifiera ce point pour chaque demande de validation d\u2019accord. De plus, la dur\u00e9e de la RCC doit se limiter dans le temps. Cela d\u00e9termine le d\u00e9lai en-de\u00e7\u00e0 duquel on ne pourra engager des licenciements pour motif \u00e9conomique.<\/p>\n<p>S\u2019il est reconnu qu\u2019en r\u00e9alit\u00e9 l\u2019employeur a proc\u00e9d\u00e9 \u00e0 une RCC pour contourner l\u2019obligation de mettre en place un Plan de Sauvegarde pour l\u2019Emploi (PSE), il pourrait \u00eatre condamn\u00e9 \u00e0 la nullit\u00e9 des licenciements et \u00e0 une amende de 3.750 euros par salari\u00e9 licenci\u00e9. L&rsquo;entreprise ne peut donc pas utiliser la rupture conventionnelle collective dans un contexte \u00e9conomique ne permettant pas le maintien dans l\u2019emploi des salari\u00e9s qui ne seraient pas volontaires \u00e0 un d\u00e9part.<\/p>\n<h4><strong><u>Peut on r\u00e9server la RCC \u00e0 certains types de postes ?<\/u><\/strong><\/h4>\n<p>Un accord de rupture conventionnelle collective peut d\u00e9finir des types d\u2019activit\u00e9s ou de postes sur lesquels l&rsquo;entreprise envisage les d\u00e9parts volontaires. Cela permet \u00e0 l\u2019entreprise utilisant ce dispositif d\u2019anticiper ses besoins de comp\u00e9tences li\u00e9s aux \u00e9volutions \u00e9conomiques ou technologiques.<\/p>\n<p>Un accord de ce type devra cependant d\u00e9finir de mani\u00e8re objective les r\u00e8gles d\u00e9terminant les salari\u00e9s \u00e9ligibles. Les crit\u00e8res de s\u00e9lection devront tenir compte de la viabilit\u00e9 du projet professionnel du salari\u00e9 volontaire au d\u00e9part. Parmi ces crit\u00e8res, on retiendra par exemple une offre d\u2019emploi s\u00e9rieuse, un projet de reprise ou de cr\u00e9ation d\u2019entreprise, etc.<\/p>\n<h4><strong><u>L\u2019entreprise peut-elle proc\u00e9<\/u><\/strong><strong><u>der \u00e0 des embauches apr\u00e8s une RCC\u00a0?<\/u><\/strong><\/h4>\n<p>Le motif \u00e9conomique n\u2019existant pas dans le cadre d\u2019une rupture conventionnelle collective, les postes devenus vacants qui n&rsquo;ont pas \u00e9t\u00e9 supprim\u00e9s peuvent faire l\u2019objet d\u2019embauches. De m\u00eame, la priorit\u00e9 de r\u00e9embauchage en cas de d\u00e9part volontaire n\u2019existe pas.<\/p>\n<h4><strong><u>Quelles cons\u00e9quences pour les salari\u00e9s volontaires \u00e0 un d\u00e9part\u00a0dans le cadre de la RCC\u00a0?<\/u><\/strong><\/h4>\n<p>Les articles L.5421-1 et L.5422-1 du Code du Travail ont \u00e9t\u00e9 modifi\u00e9s. Cela permet ainsi \u00e0 ces salari\u00e9s de b\u00e9n\u00e9ficier de l\u2019assurance ch\u00f4mage.<\/p>\n<p>Les indemnit\u00e9s vers\u00e9es dans le cadre de la RCC b\u00e9n\u00e9ficient d\u2019une exon\u00e9ration totale d\u2019imp\u00f4t sur le revenu, et d\u2019une exon\u00e9ration partielle de cotisations sociales et de CSG\/CRDS.<\/p>\n<h4><strong><u>Modalit\u00e9s de conclusion de l\u2019<\/u><\/strong><strong><u>accord (page 12 du livret \u00ab\u00a0questions r\u00e9ponses\u00a0\u00bb du Minist\u00e8re)<\/u><\/strong><\/h4>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-full wp-image-22247\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2018\/05\/capture-1.png\" alt=\"\" width=\"365\" height=\"541\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2018\/05\/capture-1.png 365w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2018\/05\/capture-1-202x300.png 202w\" sizes=\"(max-width: 365px) 100vw, 365px\" \/>Pi\u00e8ces \u00e0 produire dans le cadre d\u2019une demande de validation\u00a0:<\/p>\n<ul>\n<li>L\u2019accord de rupture conventionnelle collective,<\/li>\n<li>Les informations permettant de v\u00e9rifier la r\u00e9gularit\u00e9 des conditions de la conclusion de l\u2019accord de RCC,<\/li>\n<li>Les informations relatives \u00e0 l\u2019information du CSE (ou le proc\u00e8s-verbal de carence de CSE).<\/li>\n<\/ul>\n<p>L&rsquo;entreprise enverra le dossier complet \u00e0 la DIRECCTE. Celle-ci dispose de 15 jours \u00e0 compter de la date de r\u00e9ception pour donner une r\u00e9ponse. En cas de refus de validation, on pourra n\u00e9gocier un nouvel accord en tenant compte des \u00e9l\u00e9ments ayant motiv\u00e9 le refus.
