L&rsquo;entreprise proc\u00e9dait, le plus souvent, au paiement des contraventions sans divulguer le nom de l&rsquo;auteur de l&rsquo;infraction. Ni l&#8217;employeur, ni le salari\u00e9 n&rsquo;encouraient le risque d&rsquo;un retrait de points sur leur permis de conduire.<\/p>\n<p>Depuis le 1er Janvier 2017, l&#8217;employeur a d\u00e9sormais l&rsquo;<strong>obligation de divulguer<\/strong>, aupr\u00e8s des autorit\u00e9s, l&rsquo;identit\u00e9 du salari\u00e9 ayant commis une<strong> infraction routi\u00e8re<\/strong> avec un v\u00e9hicule appartenant \u00e0 l&rsquo;entreprise ou lou\u00e9 par cette derni\u00e8re, qu&rsquo;il s&rsquo;agisse d&rsquo;un v\u00e9hicule de service ou d&rsquo;un v\u00e9hicule de fonction, et ce, quelle que soit la nature du d\u00e9placement (trajet, mission, etc).<\/p>\n<p class=\"p1\"><span class=\"s1\">Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, fait le point. <\/span><\/p>\n<h2>Les infractions routi\u00e8res vis\u00e9es<\/h2>\n<p>Les infractions routi\u00e8res vis\u00e9es par l&rsquo;obligation de d\u00e9nonciation sont celles commises avec un v\u00e9hicule appartenant \u00e0 une personne morale (ou lou\u00e9 par elle), et qui ont \u00e9t\u00e9 constat\u00e9es par un appareil de contr\u00f4le automatique (radars et autres cam\u00e9ras de surveillance). Cela concerne :<\/p>\n<ul>\n<li>l&rsquo;oubli du port de la ceinture de s\u00e9curit\u00e9,<\/li>\n<li>l&rsquo;usage d&rsquo;un t\u00e9l\u00e9phone portable tenu en main,<\/li>\n<li>l&rsquo;exc\u00e8s de vitesse,<\/li>\n<li>l&rsquo;usage de voies et chauss\u00e9es r\u00e9serv\u00e9es \u00e0 certaines cat\u00e9gories de v\u00e9hicules,<\/li>\n<li>l&rsquo;arr\u00eat, le stationnement ou la circulation sur les bandes d&rsquo;arr\u00eat d&rsquo;urgence,<\/li>\n<li>le non-respect des distances de s\u00e9curit\u00e9,<\/li>\n<li>le franchissement et le chevauchement des lignes continues,<\/li>\n<li>le d\u00e9passement des vitesses maximales autoris\u00e9es,<\/li>\n<li>le non-respect des r\u00e8gles de d\u00e9passements,<\/li>\n<li>l&rsquo;engagement dans un espace r\u00e9serv\u00e9,<\/li>\n<li>le non-respect des signalisations imposant l&rsquo;arr\u00eat d&rsquo;un v\u00e9hicule (un stop par exemple),<\/li>\n<li>l&rsquo;absence de souscription \u00e0 une assurance,<\/li>\n<li>s&rsquo;agissant des v\u00e9hicules \u00e0 deux roues, le manquement \u00e0 l&rsquo;obligation du port d&rsquo;un casque.<\/li>\n<\/ul>\n<h2>Quelle proc\u00e9dure doit suivre l&#8217;employeur ?<\/h2>\n<p>L&#8217;employeur doit, dans un <strong>d\u00e9lai de 45 jours<\/strong> \u00e0 compter de l&rsquo;envoi ou de la remise de l&rsquo;avis de contravention, r\u00e9v\u00e9ler aux autorit\u00e9s l&rsquo;identit\u00e9 personnelle, l&rsquo;adresse et les r\u00e9f\u00e9rences du permis de conduire du salari\u00e9, auteur de l&rsquo;infraction, par LRAR ou par la voie \u00e9lectronique. (<span class=\"s1\">formulaire en ligne sur le site de l&rsquo;Agence Nationale du Traitement Automatis\u00e9 des Infractions\u00a0: <a href=\"https:\/\/www.antai.fr\/\"><span class=\"s2\">https:\/\/www.antai.fr\/<\/span><\/a>).<\/span><\/p>\n<h2>La responsabilit\u00e9 p\u00e9nale du chef d&rsquo;entreprise<\/h2>\n<p>Le chef d&rsquo;entreprise (personne physique) qui s&rsquo;abstient de d\u00e9noncer le conducteur fautif encourt le risque d&rsquo;une responsabilit\u00e9 p\u00e9nale et sera personnellement redevable d\u2019une amende pouvant aller jusqu&rsquo;\u00e0 <strong>750 \u20ac<\/strong>, qui ne peut \u00eatre prise en charge par l&rsquo;entreprise.<\/p>\n<p>Il devra, en plus, s&rsquo;acquitter du paiement de l&rsquo;amende due au titre de l&rsquo;infraction routi\u00e8re commise par le salari\u00e9. En outre, la soci\u00e9t\u00e9 (personne morale) risque une amende qui peut aller jusqu&rsquo;\u00e0 <strong>3 750<\/strong> <strong>\u20ac<\/strong>.<\/p>\n<div class=\"encadre-style\"> Il existe, n\u00e9anmoins, trois exceptions \u00e0 cette obligation. L\u2019employeur n\u2019est pas tenu de d\u00e9noncer si le v\u00e9hicule a \u00e9t\u00e9 vol\u00e9, la plaque d&rsquo;immatriculation\u00a0 usurp\u00e9e, et en cas de force majeure. <\/div>\n<p>Ainsi, l\u2019employeur doit toujours d\u00e9noncer son salari\u00e9. Celui peut toujours contester l&rsquo;avis de contravention en d\u00e9montrant qu&rsquo;il n&rsquo;\u00e9tait pas l&rsquo;auteur de l&rsquo;infraction.
