Il convient de les respecter. L\u2019employeur ne peut en effet choisir un candidat selon son physique, son sexe, sa religion, ou tout autre motif discriminatoire. De m\u00eame doit-il \u00eatre pertinent, lors des entretiens d\u2019embauche, dans ses crit\u00e8res de s\u00e9lection. Il doit respecter la vie priv\u00e9e des candidats.<\/span><\/p>\n<p class=\"p3\"><span class=\"s1\">Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France, fait le point sur cette \u00e9tape primordiale du recrutement.<\/span><\/p>\n<h2>Le respect des libert\u00e9s fondamentales<\/h2>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\" wp-image-18888 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/recherche4-1-300x300.jpg\" alt=\"embauche s\u00e9lection\" width=\"230\" height=\"230\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/recherche4-1-300x300.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/recherche4-1-150x150.jpg 150w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/recherche4-1-45x45.jpg 45w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/recherche4-1.jpg 750w\" sizes=\"(max-width: 230px) 100vw, 230px\" \/>L\u2019article L1132-1 du Code du travail dispose que \u00ab\u00a0<em>aucune personne ne peut \u00eatre \u00e9cart\u00e9e d&rsquo;une proc\u00e9dure de recrutement ou de l&rsquo;acc\u00e8s \u00e0 un stage ou \u00e0 une p\u00e9riode de formation en entreprise.<\/em><\/p>\n<p><em>Aucun salari\u00e9 ne peut \u00eatre sanctionn\u00e9, licenci\u00e9 ou faire l&rsquo;objet d&rsquo;une mesure discriminatoire, directe ou indirecte en raison de son origine, de son sexe, de ses m\u0153urs, de son orientation sexuelle, de son identit\u00e9 de genre, de son \u00e2ge, de sa situation de famille ou de sa grossesse, de ses caract\u00e9ristiques g\u00e9n\u00e9tiques, de la particuli\u00e8re vuln\u00e9rabilit\u00e9 r\u00e9sultant de sa situation \u00e9conomique, apparente ou connue de son auteur, de son appartenance ou de sa non appartenance, vraie ou suppos\u00e9e, \u00e0 une ethnie, une nation ou une pr\u00e9tendue race, de ses opinions politiques, de ses activit\u00e9s syndicales ou mutualistes, de ses convictions religieuses, de son apparence physique, de son nom de famille, de son lieu de r\u00e9sidence ou de sa domiciliation bancaire, ou en raison de son \u00e9tat de sant\u00e9, de sa perte d&rsquo;autonomie ou de son handicap, de sa capacit\u00e9 \u00e0 s&rsquo;exprimer dans une langue autre que le fran\u00e7ai<\/em>s\u00a0\u00bb.<\/p>\n<h4>Discrimination<\/h4>\n<p>Lors de la s\u00e9lection des candidats, toute question qui porterait sur l&rsquo;un de ces motifs serait <strong>discriminatoire<\/strong> et donc condamnable. Sont sanctionn\u00e9es tant les discriminations <strong>directes<\/strong>, que les discriminations <strong>indirectes<\/strong>. Il y a <strong>discrimination directe<\/strong>\u00a0lorsqu\u2019une \u00a0\u00bb <em>personne est trait\u00e9e de mani\u00e8re <strong>moins favorable<\/strong> qu&rsquo;une autre ne l&rsquo;est, ne l&rsquo;a \u00e9t\u00e9 ou ne l&rsquo;aura \u00e9t\u00e9 dans une<strong> situation comparable <\/strong><\/em>\u00a0\u00bb et ce, sur le fondement d&rsquo;un motif prohib\u00e9 \u00e0 savoir le sexe, la race, la religion etc.<\/p>\n<p>La <strong>discrimination indirecte<\/strong> est effective lorsqu&rsquo;une disposition, un crit\u00e8re ou une pratique, bien que <strong>neutre<\/strong> en apparence, est <strong>susceptible<\/strong> d\u2019entra\u00eener, pour l&rsquo;un des motifs discriminatoires \u00e9nonc\u00e9s pr\u00e9alablement, un<strong> d\u00e9savantage<\/strong> particulier pour des personnes par rapport \u00e0 d&rsquo;autres.<\/p>\n<p>La loi interdit ces deux types de discriminations. Ce principe (d&rsquo;interdiction des discriminations) conna\u00eet une <strong>exception<\/strong>, lorsque le traitement diff\u00e9renci\u00e9 r\u00e9pond \u00e0 une exigence professionnelle, essentielle et d\u00e9terminante, si l&rsquo;objectif est l\u00e9gitime, et l&rsquo;exigence proportionn\u00e9e. Il existe, ainsi une \u00a0\u00bb discrimination l\u00e9gale \u00ab\u00a0, notamment en ce qui concerne certains emplois dans l&rsquo;administration publique ou dans des \u00a0\u00bb activit\u00e9s participant \u00e0 l&rsquo;exercice de l&rsquo;autorit\u00e9 publique \u00ab\u00a0, qui exigent la nationalit\u00e9 fran\u00e7aise.<\/p>\n<p class=\"p1\"><span class=\"s1\">De m\u00eame sera-t-il l\u00e9gitime pour une \u00e9cole catholique d\u2019embaucher une personne de confession catholique pour dispenser les cours de religion. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">De m\u00eame, certaines dispositions l\u00e9gales relatives \u00e0 la protection de la femme (grossesse et maternit\u00e9, par exemple), \u00e0 l\u2019emploi de handicap\u00e9s, ainsi que des mesures de \u00ab\u00a0discrimination positive\u00a0\u00bb d\u00e9rogent au principe de base de non discrimination.<\/span><\/p>\n<h2>Le principe de pertinence<\/h2>\n<p>Les informations demand\u00e9es lors de la s\u00e9lection des candidats ne peuvent avoir pour<strong> finalit\u00e9<\/strong> que d&rsquo;appr\u00e9cier sa capacit\u00e9 \u00e0 occuper l&#8217;emploi propos\u00e9. (ou d&rsquo;\u00e9valuer ses aptitudes professionnelles). Elles doivent pr\u00e9senter un<strong> lien direct et n\u00e9cessaire<\/strong> avec l&#8217;emploi ou les aptitudes professionnelles.<\/p>\n<p><strong>Que peut-on demander \u00e0 un candidat \u00e0 l&#8217;emploi\u00a0?<\/strong><\/p>\n<p>Il est possible de l&rsquo;interroger sur son \u00e9tat civil (nom, pr\u00e9nom, date et lieu de naissance), son adresse et sa nationalit\u00e9. Il est possible de demander les dipl\u00f4mes et les notes. L&rsquo;entreprise a le droit de se renseigner sur le pass\u00e9 professionnel du candidat \u00e0 l&#8217;emploi.
