La loi Travail a supprim\u00e9 les dispositions des anciens articles L.\u00a04624-1 et R.\u00a04624-34 \u00e0 \u201336 du Code du travail qui pr\u00e9voyaient notamment qu&rsquo;en cas de difficult\u00e9 ou de d\u00e9saccord concernant un avis du m\u00e9decin du travail, l&#8217;employeur ou le salari\u00e9 pouvait exercer un recours, dans un d\u00e9lai de deux mois, devant l&rsquo;inspecteur du travail dont relevait l&rsquo;\u00e9tablissement employant le salari\u00e9.<\/p>\n<p>Comment contester ? Devant qui ? D&rsquo;abord le<strong>\u00a0salari\u00e9<\/strong> qui, d\u00e9clar\u00e9 inapte \u00e0 son poste par avis du m\u00e9decin du travail, entend remettre en cause cet avis, soit pour conserver son emploi, soit pour contester le licenciement dont il a fait l&rsquo;objet en raison de cette inaptitude. Mais aussi l&rsquo;<strong>employeur,<\/strong> qui peut vouloir remettre en cause l&rsquo;avis par lequel le m\u00e9decin du travail a pr\u00e9conis\u00e9 des am\u00e9nagements de poste pour un salari\u00e9.<\/p>\n<h2 class=\"p1\"><span class=\"s1\">Comment contester\u00a0? <\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">C\u2019est maintenant devant le <\/span><a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/les-prudhommes\/\" target=\"_self\" rel=\"noopener\">conseil de prud\u2019hommes<\/a> <span class=\"s1\">que se fait cette contestation.<\/span><\/p>\n<h2>Le d\u00e9lai pour contester\u00a0?<\/h2>\n<p>Le conseil de prud&rsquo;hommes doit \u00eatre saisi dans un d\u00e9lai de <strong>quinze jours<\/strong> \u00e0 compter de la notification de l&rsquo;avis.<\/p>\n<p>Les modalit\u00e9s de recours et ce d\u00e9lai doivent \u00eatre mentionn\u00e9s sur les avis et mesures \u00e9mis par le m\u00e9decin du travail.<\/p>\n<h2>Quel conseil de prud&rsquo;hommes saisir et comment\u00a0?<\/h2>\n<p>Le conseil de prud\u2019hommes comp\u00e9tent n&rsquo;est pas celui du lieu o\u00f9 exerce le m\u00e9decin du travail dont l&rsquo;avis est contest\u00e9, mais celui du lieu o\u00f9 est situ\u00e9 l&rsquo;\u00e9tablissement o\u00f9 travaille le salari\u00e9 concern\u00e9, soit, lorsque le travail est accompli \u00e0 domicile ou en dehors de toute entreprise ou \u00e9tablissement, celui du lieu o\u00f9 est situ\u00e9 le domicile du salari\u00e9.<\/p>\n<div class=\"encadre-style\"> Le salari\u00e9 peut \u00e9galement saisir le conseil du lieu o\u00f9 l&rsquo;engagement a \u00e9t\u00e9 contract\u00e9 ou celui du lieu o\u00f9 l&#8217;employeur est \u00e9tabli. <\/div>\n<p>Sauf choix d&rsquo;une saisine par acte d&rsquo;huissier de justice, le demandeur doit \u00e9tablir une requ\u00eate qu&rsquo;il remettra au greffe du conseil de prud\u2019hommes.<\/p>\n<div class=\"encadre-style\"> Cette saisine ne va pas aboutir \u00e0 l\u2019annulation de l\u2019avis du m\u00e9decin du travail. <\/div>\n<p>En effet, la finalit\u00e9 de la contestation n&rsquo;est que d&rsquo;obtenir la d\u00e9signation par le conseil de prud&rsquo;hommes d&rsquo;un <strong>m\u00e9decin expert<\/strong>.<\/p>\n<p>Il doit s&rsquo;agir d&rsquo;un m\u00e9decin expert inscrit sur la liste des experts pr\u00e8s la cour d&rsquo;appel. Ce dernier pourra avoir acc\u00e8s au dossier m\u00e9dical, de plein droit et sans que puisse lui \u00eatre oppos\u00e9 le <strong>secret m\u00e9dical.<\/strong><\/p>\n<p>Ainsi, il est toujours possible de contester l\u2019avis du m\u00e9decin du travail.
