C\u2019est la <strong>responsabilit\u00e9 d\u00e9lictuelle<\/strong>.<\/p>\n<p>L\u2019article 1242 du Code civil dispose \u00ab\u00a0<em>qu\u2019on est responsable non seulement du dommage que l&rsquo;on cause par son propre fait, mais encore de celui qui est caus\u00e9 par le fait des personnes dont on doit r\u00e9pondre, ou des choses que l&rsquo;on a sous sa garde<\/em> \u00bb. Il y a, \u00e9videmment, des conditions \u00e0 remplir. Il est possible, dans certaines circonstances, de se d\u00e9douaner de sa responsabilit\u00e9.<\/p>\n<p class=\"p1\"><span class=\"s1\">Valoxy, cabinet d\u2019expertise comptable dans les Hauts de France,<span class=\"Apple-converted-space\">\u00a0<\/span>fait le point.<\/span><\/p>\n<h2>La responsabilit\u00e9 du dirigeant du fait de ses pr\u00e9pos\u00e9s<\/h2>\n<h3>Les conditions<\/h3>\n<p>Pour mettre en jeu la responsabilit\u00e9, il existe <strong>trois conditions cumulatives<\/strong>. Sans celles-ci, l\u2019employeur n&rsquo;est pas responsable.<\/p>\n<h4>L\u2019existence d\u2019un lien de pr\u00e9position<\/h4>\n<p>Un lien de pr\u00e9position est une <strong>relation d\u2019autorit\u00e9<\/strong> entre deux personnes, ce qui signifie que l\u2019une des deux personnes est en mesure de donner des ordres \u00e0 une autre, qui lui ob\u00e9it. Ainsi, d\u00e8s lors qu\u2019existe un contrat de travail, le lien de pr\u00e9position est pr\u00e9sum\u00e9.<\/p>\n<h4>La faute du salari\u00e9<\/h4>\n<p>Il faut d\u00e9montrer une simple faute du salari\u00e9 tel qu&rsquo;un non respect des r\u00e8gles de s\u00e9curit\u00e9.\u00a0<span class=\"s1\">(Non respect des r\u00e8gles de s\u00e9curit\u00e9, mauvaise utilisation d\u2019une machine, etc.)<\/span><\/p>\n<p>Si la faute r\u00e9sulte de l\u2019utilisation d\u2019un objet de l&rsquo;entreprise, le salari\u00e9 ne peut cependant \u00eatre consid\u00e9r\u00e9 comme le gardien de ce bien, qui reste son employeur. C&rsquo;est donc la responsabilit\u00e9 de ce dernier que l&rsquo;on appellera \u00e9ventuellement, \u00e0 ce titre, dans un deuxi\u00e8me temps.<\/p>\n<h4>Un lien entre le fait dommageable et les fonctions du salari\u00e9<\/h4>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"size-medium wp-image-18889 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/vision-1-300x300.jpg\" alt=\"condition responsabilit\u00e9\" width=\"300\" height=\"300\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/vision-1-300x300.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/vision-1-150x150.jpg 150w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/vision-1-45x45.jpg 45w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/vision-1.jpg 750w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>Il ne doit pas y avoir eu d\u2019<strong>abus de fonction<\/strong> du salari\u00e9. Ainsi, les employeurs sont responsables des dommages que causent leurs salari\u00e9s \u00ab <em>dans les fonctions auxquelles ils les ont employ\u00e9es<\/em> \u00bb.<\/p>\n<p>L\u2019employeur peut donc s\u2019exon\u00e9rer de sa responsabilit\u00e9 d\u00e9lictuelle si le salari\u00e9 agit hors des fonctions auxquelles il est employ\u00e9, sans autorisation et \u00e0 des fins \u00e9trang\u00e8res \u00e0 ses attributions.<\/p>\n<h3>Les causes d\u2019exon\u00e9ration de l\u2019employeur<\/h3>\n<p>L\u2019employeur n\u2019est pas responsable si l&rsquo;une des trois conditions cit\u00e9es n\u2019est pas respect\u00e9e.<\/p>\n<p>La responsabilit\u00e9 de l\u2019employeur repose sur une<strong> pr\u00e9somption<\/strong> de responsabilit\u00e9 et le fait qu\u2019il n\u2019ait pas lui m\u00eame commis de faute n\u2019est donc pas exon\u00e9ratoire.<\/p>\n<p>La seule possibilit\u00e9 d\u2019exon\u00e9ration pour l\u2019employeur dans ses rapports avec la victime est la d\u00e9monstration d\u2019une cause \u00e9trang\u00e8re (<strong>faute de la victime ou force majeure<\/strong>).<\/p>\n<p>L&#8217;employeur a l&rsquo;obligation de r\u00e9parer (dommages et inter\u00eats) le pr\u00e9judice qui trouverait sa source dans la non-ex\u00e9cution (ou la mauvaise ex\u00e9cution) d&rsquo;un contrat.<\/p>\n<p>En pratique, l\u2019employeur, apr\u00e8s avoir indemnis\u00e9 la victime, peut toujours se retourner contre le salari\u00e9. Il engage alors la <strong>responsabilit\u00e9 personnelle<\/strong> de celui-ci pour \u00eatre sorti des limites de sa mission.<\/p>\n<h2>La responsabilit\u00e9 d\u00e9lictuelle de l&rsquo;artisan du fait de son apprenti<\/h2>\n<p>Il faut qu\u2019il y ait une relation d\u2019artisan \u00e0 apprenti. C\u2019est le cas lorsqu\u2019il existe un contrat d\u2019apprentissage. Sur les autres conditions (faute et lien entre la faute et les fonctions), on retrouve les m\u00eames \u00e9l\u00e9ments que pour la responsabilit\u00e9 de l\u2019employeur du fait de son salari\u00e9.<\/p>\n<p>Concernant les <strong>causes d\u2019exon\u00e9ration<\/strong>, il semble que la responsabilit\u00e9 de l\u2019artisan du fait de son apprenti ne soit plus qu\u2019une <strong>pr\u00e9somption simple<\/strong> de faute, l\u2019artisan pouvant alors s\u2019exon\u00e9rer en d\u00e9montrant qu\u2019il n\u2019a pas commis de faute.
