En effet, les Conventions collectives ou les accords de branche peuvent pr\u00e9voir, dans une certaine limite, des modalit\u00e9s diff\u00e9rentes que celles fix\u00e9es dans le Code du travail.<\/p>\n<p>L\u2019employeur peut-il obliger un salari\u00e9 \u00e0 travailler un jour f\u00e9ri\u00e9 ? Quel impact sur les salaires en cas de travail un jour f\u00e9ri\u00e9 ? Et en cas de jour effectivement ch\u00f4m\u00e9 ? Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France, vous propose une synth\u00e8se.<\/p>\n<h4><strong>Le traitement des jours f\u00e9ri\u00e9s\u00a0: ce que pr\u00e9voit la loi<\/strong><\/h4>\n<p>Dans un premier temps, sachez que le Code du travail autorise l\u2019employeur \u00e0 faire travailler les salari\u00e9s un jour f\u00e9ri\u00e9. Toutefois, de nombreuses Conventions collectives ont \u00e9voqu\u00e9 ce point et, selon l\u2019accord, ont d\u00e9fini l\u2019un ou l\u2019autre des jours f\u00e9ri\u00e9s comme jour ch\u00f4m\u00e9 obligatoire. Dans ce contexte, d\u00e8s lors que l\u2019employeur demande de travailler un jour f\u00e9ri\u00e9 alors m\u00eame qu\u2019il a \u00e9t\u00e9 obtenu comme ch\u00f4m\u00e9 par sa Convention collective, le salari\u00e9 ne pourra pas \u00eatre sanctionn\u00e9 en cas d\u2019absence \u00e0 son poste ledit jour f\u00e9ri\u00e9.<\/p>\n<p>Conclusion\u00a0: sauf accord collectif, l\u2019employeur est en droit d\u2019obliger un salari\u00e9 \u00e0 travailler un jour f\u00e9ri\u00e9. De m\u00eame pour les traditionnels \u00ab\u00a0ponts\u00a0\u00bb qu\u2019il peut l\u00e9galement refuser <em>(l\u00e0 encore, sauf convention ou accord collectif).\u00a0<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><em><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-18893\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/hesitation-2.jpg\" alt=\"\" width=\"319\" height=\"319\" \/>Notez tout de m\u00eame que l\u2019employeur ne peut pas imposer de travailler un jour f\u00e9ri\u00e9 aux salari\u00e9s apprentis ou \u00e2g\u00e9s de moins de 18 ans.<\/em><\/p>\n<h4><strong>L\u2019exception du 1<sup>er<\/sup> mai<\/strong><\/h4>\n<p>Dans tous les cas et quelle que soit la convention collective, le 1er mai (f\u00eate du Travail) est un jour ch\u00f4m\u00e9. Il sera pay\u00e9 double en cas de journ\u00e9e de travail impos\u00e9e par l\u2019employeur.<\/p>\n<h4 class=\"p1\"><span class=\"s1\"><b>Le paiement des jours f\u00e9ri\u00e9s effectivement ch\u00f4m\u00e9s<\/b><\/span><\/h4>\n<p class=\"p1\"><span class=\"s1\">Le Code du travail stipule qu\u2019\u00e0 partir de trois mois d\u2019anciennet\u00e9, un jour f\u00e9ri\u00e9 (et non travaill\u00e9)<\/span><span class=\"s3\">\u00a0n\u2019entra\u00eene<\/span><span class=\"s1\"> aucune baisse de salaire<\/span><span class=\"s1\">, et ce <\/span><span class=\"s3\">quelle<\/span><span class=\"s1\"> que soit la nature du contrat de travail. La convention collective ou un accord de branche\/accord d\u2019entreprise <\/span><span class=\"s3\">peut <\/span><span class=\"s1\">pr\u00e9voir des conditions plus favorables aux salari\u00e9s qui disposent de moins de trois mois d\u2019anciennet\u00e9.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Conclusion\u00a0: <\/span><span class=\"s3\">lorsqu\u2019un salari\u00e9 ch\u00f4me<\/span><span class=\"s1\">\u00a0un jour f\u00e9ri\u00e9 \u2013 normalement jour ouvr\u00e9 \u2013<\/span><span class=\"s3\">\u00a0son<\/span><span class=\"s1\"> salaire au titre de cette journ\u00e9e est vers\u00e9 dans les conditions habituelles, primes et heures suppl\u00e9mentaires incluses.\u00a0<\/span><\/p>\n<h4 class=\"p1\"><span class=\"s1\"><b>Le paiement des jours f\u00e9ri\u00e9s travaill\u00e9s<\/b><\/span><\/h4>\n<p class=\"p1\"><span class=\"s1\">\u00c0 l\u2019inverse, un salari\u00e9 qui doit travailler un jour f\u00e9ri\u00e9 ne jouit pas d\u2019avantages sp\u00e9cifiques (augmentation de salaire, prime ou indemnit\u00e9 sp\u00e9ciale\u2026). Toutefois, de nombreuses conventions collectives ou accords de branches pr\u00e9voient une compensation, comme un jour de repos suppl\u00e9mentaire ou une majoration <\/span><span class=\"s3\">du<\/span><span class=\"s1\"> salaire journalier.<\/span><\/p>\n<h4 class=\"p1\"><span class=\"s5\">Le paiement du 1<\/span><span class=\"s1\">er<\/span><span class=\"s5\"> mai en cas de journ\u00e9e travaill\u00e9e<\/span><\/h4>\n<p class=\"p1\"><span class=\"s1\">Nous l\u2019\u00e9voquions ci-dessus, le 1er mai (f\u00eate du Travail) est une exception l\u00e9gale. Lorsque le salari\u00e9 travaille un 1er mai, l\u2019employeur doit lui verser une indemnit\u00e9 l\u00e9gale \u00e9gale au montant du salaire journalier.
