Cette qualification est importante, car elle permet une gestion sp\u00e9cifique de la victime par la S\u00e9curit\u00e9 sociale.<\/p>\n<p>Quels sont les crit\u00e8res et pourquoi qualifier ainsi un accident du travail ? Quelles sont les d\u00e9marches \u00e0 effectuer c\u00f4t\u00e9 employeur et c\u00f4t\u00e9 salari\u00e9 ? Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts-de-France, fait le point.<\/p>\n<h3><strong>Les crit\u00e8res l\u00e9gaux pour qualifier un accident du travail<\/strong><\/h3>\n<p>Le Code de la S\u00e9curit\u00e9 sociale encadre la notion d\u2019accident du travail et le d\u00e9finit comme \u00ab\u00a0<em>un sinistre survenu brutalement par le fait ou l\u2019occasion du travail et qui entra\u00eene des blessures physiques ou psychiques\u00a0<\/em>\u00bb &#8211; article\u00a0L411-1 du Code de la S\u00e9curit\u00e9 sociale.<\/p>\n<p>C\u2019est au salari\u00e9 de prouver qu\u2019il a \u00e9t\u00e9 victime d\u2019un accident du travail. Pour cela, il devra valider\u00a0:<\/p>\n<ul>\n<li>le caract\u00e8re de l\u2019\u00e9v\u00e9nement\u00a0: celui-ci doit \u00eatre arriv\u00e9 soudainement, ce qui diff\u00e9rence l\u2019accident du travail de la maladie professionnelle<\/li>\n<li>le cadre\u00a0: l\u2019accident doit avoir eu lieu dans le cadre de l\u2019exercice de l\u2019activit\u00e9 salari\u00e9e, que cela soit le lieu de travail directement, ses infrastructures d\u00e9di\u00e9es (parking, cantine, atelier, chantier&#8230;) o\u00f9 en dehors en cas de d\u00e9placement professionnel. Notez qu\u2019un accident survenu sur le trajet entre la r\u00e9sidence principale et le lieu de travail peut \u00eatre consid\u00e9r\u00e9 comme accident du travail<\/li>\n<li>le moment\u00a0: l\u2019accident doit avoir lieu alors que le salari\u00e9 est soumis \u00e0 la subordination de son employeur, incluant les temps de pause. Ce crit\u00e8re \u00e9largit le cadre de l\u2019accident du travail aux voyages professionnels, rendez-vous client&#8230;<\/li>\n<\/ul>\n<h3><strong><img decoding=\"async\" class=\" wp-image-19712 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/accident-du-travail-1.jpg\" alt=\"accident du travail\" width=\"189\" height=\"126\" \/>Pourquoi d\u00e9clarer un accident du travail ?<\/strong><\/h3>\n<p>Un accident caract\u00e9ris\u00e9 comme accident du travail ouvre des droits sp\u00e9cifiques \u00e0 la victime\u00a0:<\/p>\n<ul>\n<li>une prise en charge des soins<\/li>\n<li>le versement d\u2019une indemnit\u00e9 de remplacement de salaire pendant la dur\u00e9e de l\u2019arr\u00eat<\/li>\n<li>le versement d\u2019une rente ou d\u2019un capital en cas d\u2019invalidit\u00e9 emp\u00eachant le retour au travail ou d\u2019un capital d\u00e9c\u00e8s aux ayants droit si l\u2019accident engendre le d\u00e9c\u00e8s du salari\u00e9<\/li>\n<li>la garantie de retrouver un emploi \u00e0 l\u2019issue de l\u2019arr\u00eat de travail ou une mise en conformit\u00e9 du poste de travail par l&rsquo;entreprise, en cas de handicap, le cas \u00e9ch\u00e9ant<\/li>\n<\/ul>\n<h3><strong>Que doit faire le salari\u00e9 victime pour d\u00e9clarer un accident du travail ?<\/strong><\/h3>\n<h4><u>\u00c9tape\u00a01\u00a0: informer l\u2019employeur<\/u><\/h4>\n<p>Le salari\u00e9 (ou\u00a0ou un proche en cas d\u2019incapacit\u00e9) dispose de 24 heures pour informer l\u2019employeur de l\u2019accident ; l\u2019id\u00e9al \u00e9tant de transmettre un courrier en recommand\u00e9 avec accus\u00e9 de r\u00e9ception. Le salari\u00e9 doit pr\u00e9ciser le lieu de l\u2019accident, la cause, les circonstances et r\u00e9cup\u00e9rer les coordonn\u00e9es des \u00e9ventuels t\u00e9moins, au cas o\u00f9 la caisse de S\u00e9curit\u00e9 sociale concern\u00e9e souhaite mener l\u2019enqu\u00eate.<\/p>\n<p class=\"p1\"><span class=\"s1\">A noter que si l\u2019accident a lieu dans les locaux de l\u2019entreprise, l\u2019employeur lui m\u00eame, ou son repr\u00e9sentant (chef d\u2019atelier, secr\u00e9taire, etc.) est d\u00e9j\u00e0 inform\u00e9, inscrira souvent lui m\u00eame toutes les informations n\u00e9cessaires dans un registre, et se chargera de la plupart de ces d\u00e9marches.<\/span><\/p>\n<h4><u>\u00c9tape\u00a02\u00a0: obtenir un certificat m\u00e9dical<\/u><\/h4>\n<p>Le salari\u00e9 doit consulter un m\u00e9decin pour \u00e9tablir un certificat m\u00e9dical d\u2019arr\u00eat de travail d\u00e9taill\u00e9 (nature des l\u00e9sions et sympt\u00f4mes, s\u00e9quelles, \u00e9tat de la victime, dur\u00e9e de l\u2019arr\u00eat prescrit, nature des soins&#8230;).<\/p>\n<h4><u>\u00c9tape\u00a03\u00a0: transmettre le certificat m\u00e9dical<\/u><\/h4>\n<p>Le salari\u00e9 doit transmettre le certificat m\u00e9dical \u00e0 son employeur. Notez que le m\u00e9decin est, de son c\u00f4t\u00e9, charg\u00e9 de transmettre des informations relatives \u00e0 l\u2019accident aupr\u00e8s de la caisse de S\u00e9curit\u00e9 sociale concern\u00e9e.<\/p>\n<h4><u>\u00c9tape\u00a04\u00a0: attendre les instructions de la caisse de S\u00e9curit\u00e9 sociale (CPAM)<\/u><\/h4>\n<p>La caisse de S\u00e9curit\u00e9 sociale concern\u00e9e, \u00e0 savoir la CPAM du salari\u00e9 (Caisse Primaire d\u2019Assurance Maladie) dispose de 30 jours maximum \u00e0 compter de la r\u00e9ception du certificat m\u00e9dical pour instruire le dossier puis valider ou invalider le caract\u00e8re professionnel de l\u2019accident. Ce d\u00e9lai peut \u00eatre prolong\u00e9 de deux mois en cas de complexit\u00e9 et sous conditions d\u2019avoir pr\u00e9alablement inform\u00e9 par \u00e9crit la victime et l\u2019employeur. C\u2019est au cours de cette p\u00e9riode que la CPAM est susceptible de mener une enqu\u00eate (demande de t\u00e9moignages, consultation d\u2019experts, visite des lieux&#8230;).<\/p>\n<h3><strong><img fetchpriority=\"high\" decoding=\"async\" class=\" wp-image-18875 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/hesitation.jpg\" alt=\"accident de travail\" width=\"278\" height=\"209\" \/>Quelles formalit\u00e9s accomplir en cas d\u2019accident du travail d&rsquo;un salari\u00e9 ?<\/strong><\/h3>\n<p>Si le salari\u00e9 a la charge (le cas \u00e9ch\u00e9ant)\u00a0 de prouver le caract\u00e8re professionnel de l\u2019accident, l\u2019employeur doit, de son c\u00f4t\u00e9, effectuer un certain nombre de d\u00e9marches pour permettre une prise en charge ad\u00e9quate de la victime par la S\u00e9curit\u00e9 sociale.<\/p>\n<h4><u>\u00c9tape\u00a01\u00a0: la feuille d\u2019accident pour le salari\u00e9<\/u><\/h4>\n<p>En tant qu\u2019employeur, vous devez imm\u00e9diatement remplir et remettre au salari\u00e9 une feuille d\u2019accident Cerfa S6201 permettant une prise en charge des soins.<\/p>\n<h4><u>\u00c9tape 2 : la D\u00e9claration d\u2019Accident du Travail (DAT) pour la CPAM<\/u><\/h4>\n<p>Vous devez d\u00e9clarer l\u2019accident dans les 48 heures (dimanche et jours f\u00e9ri\u00e9s non compris) :<\/p>\n<ul>\n<li>aupr\u00e8s de la CPAM dont d\u00e9pend le salari\u00e9 concern\u00e9,<\/li>\n<li>remplir la DAT (D\u00e9claration d\u2019Accident du Travail) &#8211; Cerfa 14463*01,<\/li>\n<li>et ce de la mani\u00e8re la plus d\u00e9taill\u00e9e possible :\n<ul>\n<li>conditions de l\u2019accident,<\/li>\n<li>lieu,<\/li>\n<li>coordonn\u00e9es des \u00e9ventuels t\u00e9moins,<\/li>\n<li>etc.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4><u>\u00c9tape\u00a03\u00a0: l\u2019attestation de salaire en cas d\u2019arr\u00eat de travail pour la CPAM<\/u><\/h4>\n<p>En cas d\u2019arr\u00eat de travail confirm\u00e9, vous devez \u00e9galement adresser une attestation de salaires \u00e0 la CPAM. (pour versement des indemnit\u00e9s journali\u00e8res au salari\u00e9).<\/p>\n<p><u>La d\u00e9claration d\u2019accident du travail d\u00e9mat\u00e9rialis\u00e9e pour l\u2019employeur<\/u><\/p>\n<p>En tant qu\u2019employeur, vous pouvez d\u00e9sormais r\u00e9aliser directement vos d\u00e9clarations d\u2019accident sur le site net-entreprises.fr. Cette d\u00e9marche vous permet de centraliser l\u2019ensemble de vos formalit\u00e9s \u00e0 remplir en tant qu\u2019employeur, \u00e0 savoir\u00a0:<\/p>\n<ul>\n<li>\u00e9diter la feuille d\u2019accident Cerfa\u00a0S6201 permettant une prise en charge des soins pour le salari\u00e9<\/li>\n<li>remplir la DAT Cerfa\u00a014463*01<\/li>\n<li>remplir l\u2019attestation de salaires en cas d\u2019arr\u00eat pour permettre le versement des indemnit\u00e9s journali\u00e8res \u00e0 votre salari\u00e9<\/li>\n<\/ul>\n<p><em>Notez que les attestations de salaires doivent appara\u00eetre dans la DSN (D\u00e9claration Sociale Nominative) relative au salari\u00e9 concern\u00e9.<\/em><\/p>\n<p class=\"p1\"><span class=\"s1\">C\u2019est la r\u00e9activit\u00e9 qui aidera \u00e0 passer ce cap difficile, pour le salari\u00e9 comme pour l\u2019employeur.
