D\u00e9finition de la mise \u00e0 pied disciplinaire<\/h2>\n<p>Vous \u00eates dirigeant et vous jugez que l&rsquo;un de vos salari\u00e9s \u00e0 commis<strong> une faute suffisamment grave pour justifier d&rsquo;une sanction<\/strong>, et plus particuli\u00e8rement de son exclusion temporaire de l&rsquo;entreprise : vous pouvez donc avoir recours \u00e0 <strong>la mise \u00e0 pied disciplinaire,\u00a0<\/strong><span class=\"s1\"><b>qui emp\u00eache le salari\u00e9 d\u2019avoir acc\u00e8s \u00e0 son poste de travail.\u00a0<\/b><\/span><\/p>\n<h2>2. Dur\u00e9e de la mise \u00e0 pied<\/h2>\n<p>La mise \u00e0 pied disciplinaire est <strong>limit\u00e9e dans le temps<\/strong>.<\/p>\n<div class=\"encadre-style\">Attention, une m\u00eame faute <strong>ne peut \u00eatre sanctionn\u00e9e deux fois<\/strong>, que ce soit par une mise \u00e0 pied ou toute autre sanction<\/div>\n<h2>3. Cons\u00e9quences de la mise \u00e0 pied<\/h2>\n<p>La mise \u00e0 pied disciplinaire entra\u00eene <strong>une suspension du contrat de travail<\/strong> durant une dur\u00e9e d\u00e9termin\u00e9e. Et qui dit suspension du contrat de travail, dit \u00e9galement<strong> suspension du salaire sur la p\u00e9riode de mise \u00e0 pied<\/strong>.<\/p>\n<p>La dur\u00e9e de la mise a pied ne doit pas \u00eatre disproportionn\u00e9e. Il est \u00e9vident que la faute doit \u00eatre av\u00e9r\u00e9e et vous, employeur, <strong>devez avoir suffisamment d&rsquo;\u00e9l\u00e9ments<\/strong>\u00a0pour d\u00e9cider de mettre \u00e0 pied votre salari\u00e9.<\/p>\n<div class=\"encadre-style\"> Sachez \u00e9galement que si vous d\u00e9cidez d&rsquo;une mise \u00e0 pied votre salari\u00e9, <strong>vous ne pourrez plus le licencier pour la raison de cette mise \u00e0 pied disciplinaire<\/strong>. Sauf s&rsquo;il y a r\u00e9cidive ou faits nouveaux \u00e0 partir de la mise \u00e0 pied<\/div>\n<h2>4. La proc\u00e9dure<\/h2>\n<p><img decoding=\"async\" class=\" wp-image-11197 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/03\/choisir-9.jpg\" alt=\"Comprendre la mise \u00e0 pied disciplinaire\" width=\"210\" height=\"146\" \/>La mise \u00e0 pied disciplinaire est une sanction lourde qui doit respecter un formalisme strict. Il est<strong> important de v\u00e9rifier que le r\u00e8glement int\u00e9rieur de l&rsquo;entreprise l&rsquo;autorise<\/strong>. Ce m\u00eame r\u00e8glement doit en outre pr\u00e9voir sa dur\u00e9e maximale.<\/p>\n<p>Voici les deux principales \u00e9tapes de la mise en oeuvre:<\/p>\n<h3>4.1 L&rsquo;entretien pr\u00e9alable<\/h3>\n<p>Avant tout, il est n\u00e9cessaire de convoquer le salari\u00e9 fautif \u00e0 un entretien pr\u00e9alable.<\/p>\n<p>Cet entretien peut lui \u00eatre notifi\u00e9<strong> verbalement ou par lettre recommand\u00e9e<\/strong>, ce qui est pr\u00e9f\u00e9rable afin de garder une trace du processus.<\/p>\n<p>La convocation doit \u00e0 minima comporter :<\/p>\n<ul>\n<li><strong>l&rsquo;objet de l&rsquo;entretien,<\/strong><\/li>\n<li><strong>la date,<\/strong><\/li>\n<li><strong>le lieu,<\/strong><\/li>\n<li><strong>l&rsquo;heure,<\/strong><\/li>\n<li><strong>la possibilit\u00e9 donn\u00e9e au salari\u00e9 d&rsquo;\u00eatre assist\u00e9 par quelqu&rsquo;un de l&rsquo;entreprise.<\/strong><\/li>\n<\/ul>\n<p>L&rsquo;entretien est l&rsquo;occasion d\u2019\u00e9changer sur la faute commise. Elle permet au salari\u00e9 de s&rsquo;expliquer et \u00e0 l&#8217;employeur de se faire une id\u00e9e sur la sanction \u00e0 donner. L&#8217;employeur<strong> peut tout \u00e0 fait d\u00e9cider de ne pas sanctionner<\/strong> le salari\u00e9 \u00e0 l&rsquo;issue de cet entretien.<\/p>\n<h3>4.2 La lettre de notification<\/h3>\n<p><img decoding=\"async\" class=\" wp-image-11401 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/recommande-2.jpg\" alt=\"Comprendre la mise \u00e0 pied disciplinaire\" width=\"143\" height=\"107\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/recommande-2.jpg 479w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/09\/recommande-2-300x225.jpg 300w\" sizes=\"(max-width: 143px) 100vw, 143px\" \/>L&rsquo;entretien est pass\u00e9 et vous souhaitez toujours sanctionner votre salari\u00e9 pour la faute qu&rsquo;il a commise. Sachez que vous devez obligatoirement lui <strong>notifier sa sanction par courrier recommand\u00e9 avec accus\u00e9 de r\u00e9ception<\/strong>, dans le cas pr\u00e9sent sa mise \u00e0 pied. Ce courrier mentionnera donc la d\u00e9cision de mise \u00e0 pied mais \u00e9galement la dur\u00e9e de la sanction.<\/p>\n<p>Attention, il doit obligatoirement y avoir <strong>un d\u00e9lai de deux jours ouvrables entre l&rsquo;entretien pr\u00e9alable, et la mise en oeuvre de la sanction<\/strong>. Inutile donc de poster la lettre de notification avant ou le jour m\u00eame de l&rsquo;entretien.<\/p>\n<p>A savoir \u00e9galement, la sanction <strong>doit \u00eatre mise en oeuvre dans un d\u00e9lai d&rsquo;un mois maximum apr\u00e8s l&rsquo;entretien pr\u00e9alable.<\/strong><\/p>\n<h2>5. Quel recours pour le salari\u00e9 ?<\/h2>\n<p>Le salari\u00e9 a deux possibilit\u00e9s de contester sa sanction; soit il constate que les d\u00e9lais l\u00e9gaux n&rsquo;ont pas \u00e9t\u00e9 respect\u00e9s, soit il juge que la sanction est disproportionn\u00e9e.<\/p>\n<p>En mati\u00e8re de d\u00e9lais, le salari\u00e9 pourra notamment vous faire remarquer :<\/p>\n<ul>\n<li><strong>le non respect de la prescription<\/strong>. En effet, une sanction ne peut intervenir au del\u00e0 de 2 mois apr\u00e8s que la faute ait \u00e9t\u00e9 port\u00e9e \u00e0 la connaissance de l&#8217;employeur,<\/li>\n<li><strong>le non-respect des d\u00e9lais entre l&rsquo;entretien pr\u00e9alable et la mise en oeuvre de la sanction<\/strong>: pour rappel 2 jours ouvrables au minimum et 1 mois au maximum.<\/li>\n<\/ul>\n<p>Le salari\u00e9 peut \u00e9galement juger que l&rsquo;application d&rsquo;une mise \u00e0 pied, qui pour rappel entra\u00eene une suspension de la r\u00e9mun\u00e9ration, est disproportionn\u00e9e au regard de la faute commise.<\/p>\n<p><img decoding=\"async\" class=\" wp-image-11808 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/contrat-4-gimp-90-1.jpg\" alt=\"Comprendre la mise \u00e0 pied disciplinaire\" width=\"138\" height=\"208\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/contrat-4-gimp-90-1.jpg 239w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/contrat-4-gimp-90-1-200x300.jpg 200w\" sizes=\"(max-width: 138px) 100vw, 138px\" \/>Dans les deux cas pr\u00e9c\u00e9dents, le salari\u00e9 a la possibilit\u00e9 d&rsquo;\u00e9crire \u00e0 son employeur pour l&rsquo;informer de sa contestation. Si aucun terrain d&rsquo;entente n&rsquo;est trouv\u00e9 entre les deux parties, le salari\u00e9 peut recourir <strong>au conseil des <a class=\"mkd-pt-link\" href=\"https:\/\/valoxy.org\/blog\/les-prudhommes\/\" target=\"_self\" rel=\"noopener\">prud\u2019hommes<\/a><\/strong>. Le juge v\u00e9rifiera alors la r\u00e9gularit\u00e9 de la proc\u00e9dure, l&rsquo;existence et la r\u00e9alit\u00e9 de la faute commise et la proportionnalit\u00e9 de la sanction.<\/p>\n<p>En cas de d\u00e9faut de r\u00e9gularit\u00e9 ou de disproportion, l&rsquo;entreprise aura \u00e0 <strong>rembourser le salaire du salari\u00e9 non vers\u00e9 durant la p\u00e9riode de mise \u00e0 pied.<\/strong><\/p>\n<h2>Conclusion<\/h2>\n<p>La mise \u00e0 pied disciplinaire est une sanction grave.
