D\u00e9finition<\/h2>\n<p>On ne met pas \u00e0 pied un salari\u00e9 sur un coup de t\u00eate. Une mise a pied conservatoire doit \u00eatre envisag\u00e9e <strong>dans le cas d&rsquo;une faute\u00a0commise par un salari\u00e9 et jug\u00e9e suffisamment grave pour \u00eatre sanctionn\u00e9e<\/strong>. En r\u00e8gle g\u00e9n\u00e9rale, la mise \u00e0 pied conservatoire est prononc\u00e9e<strong> dans le cadre d&rsquo;une proc\u00e9dure de licenciement pour faute grave.<\/strong><\/p>\n<p>Cette mise \u00e0 pied est d\u00e9cid\u00e9e dans le but d&rsquo;\u00e9loigner le salari\u00e9 de l&rsquo;entreprise le temps d&rsquo;engager la proc\u00e9dure de sanction. La faute doit \u00eatre suffisamment grave pour que<strong> la pr\u00e9sence du salari\u00e9 soit nuisible au bon fonctionnement de l&rsquo;entreprise.<\/strong><\/p>\n<p>Pendant cette phase, le salari\u00e9 voit donc son <strong>contrat de travail suspendu.<\/strong><\/p>\n<h2>2 . Dur\u00e9e<\/h2>\n<p>Il n&rsquo;y a pas de dur\u00e9e l\u00e9gale pour une mise \u00e0 pied conservatoire. Si le salari\u00e9 est mis \u00e0 pied \u00e0 titre conservatoire dans le cadre d&rsquo;une proc\u00e9dure de licenciement pour faute grave, sa mise \u00e0 pied s&rsquo;applique jusqu&rsquo;\u00e0 ce que le licenciement soit prononc\u00e9.<strong> La mise \u00e0 pied a donc une dur\u00e9e illimit\u00e9e.<\/strong><\/p>\n<p>Attention, m\u00eame si c&rsquo;est souvent le cas, la proc\u00e9dure ne d\u00e9bouche <strong>pas toujours sur un licenciement.<\/strong><\/p>\n<p><img decoding=\"async\" class=\" wp-image-18885 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/recherche-idee-2.jpg\" alt=\"Comprendre la mise \u00e0 pied conservatoire\" width=\"145\" height=\"90\" \/>En effet, la mise \u00e0 pied conservatoire peut d\u00e9boucher sur une sanction moins \u00ab\u00a0grave\u00a0\u00bb comme un simple avertissement ou une mutation (pour peu que l&rsquo;on consid\u00e8re qu&rsquo;une mutation soit une sanction). Elle <strong>peut \u00e9galement \u00eatre requalifi\u00e9e en une mise \u00e0 pied disciplinaire,\u00a0<\/strong>qui devient alors la sanction. Attention, cette requalification r\u00e9pond \u00e0 certaines r\u00e8gles &#8211; v\u00e9rifiez par exemple si le r\u00e8glement int\u00e9rieur l&rsquo;autorise si votre entreprise dispose de plus de 20 salari\u00e9s.<\/p>\n<p><div class=\"encadre-style\">La p\u00e9riode de mise \u00e0 pied conservatoire doit alors \u00eatre <strong>imput\u00e9e sur la dur\u00e9e de la mise \u00e0 pied disciplinaire.<\/div><\/strong><\/p>\n<h2>3. Cons\u00e9quence financi\u00e8re de la mise \u00e0 pied conservatoire<\/h2>\n<p>La mise \u00e0 pied conservatoire suspend le salari\u00e9 de son poste. En cons\u00e9quence, <strong>le salaire est \u00e9galement suspendu pendant cette p\u00e9riode.<\/strong><\/p>\n<div class=\"encadre-style\">Attention: si la mise a pied ne d\u00e9bouche pas sur un licenciement pour faute grave, le salari\u00e9 pourra demander<strong> le remboursement de son salaire<\/strong> sur cette p\u00e9riode.<\/div>\n<p>Il peut arriver que l&#8217;employeur d\u00e9cide de requalifier la faute lourde en une faute simple ou s\u00e9rieuse. Dans ce cas, le salaire suspendu<strong>\u00a0doit \u00eatre revers\u00e9.<\/strong><\/p>\n<h2>4. La proc\u00e9dure de la mise \u00e0 pied conservatoire<\/h2>\n<p>Il n&rsquo;existe pas de proc\u00e9dure particuli\u00e8re pour notifier \u00e0 un salari\u00e9 sa mise \u00e0 pied. Elle peut <strong>tout \u00e0 fait \u00eatre notifi\u00e9e verbalement.<\/strong><\/p>\n<p><img decoding=\"async\" class=\"wp-image-16697 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2016\/05\/rediger-un-courrier-1.jpg\" alt=\"Comprendre la mise \u00e0 pied conservatoire\" width=\"196\" height=\"98\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2016\/05\/rediger-un-courrier-1.jpg 660w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2016\/05\/rediger-un-courrier-1-300x150.jpg 300w\" sizes=\"(max-width: 196px) 100vw, 196px\" \/>Cependant, il est <strong>vivement conseill\u00e9 d&rsquo;avoir une trace \u00e9crite de cette notification,<\/strong>\u00a0particuli\u00e8rement si la mise \u00e0 pied conservatoire d\u00e9bouche sur une proc\u00e9dure de licenciement.\u00a0Une lettre recommand\u00e9e ou la lettre de convocation \u00e0 l&rsquo;entretien pr\u00e9alable peuvent alors \u00eatre des solutions.<\/p>\n<h2>5. Cas particulier du salari\u00e9 prot\u00e9g\u00e9<\/h2>\n<p>Si votre salari\u00e9 est un salari\u00e9 prot\u00e9g\u00e9, c&rsquo;est le cas du d\u00e9l\u00e9gu\u00e9 syndical par exemple, vous devez imp\u00e9rativement<strong>\u00a0informer l&rsquo;inspection du travail sous 48h apr\u00e8s la notification de mise \u00e0 pied au salari\u00e9.<\/strong><\/p>\n<p>Si ce n&rsquo;est pas le cas, il y a alors<strong> d\u00e9faut de notification<\/strong> et donc irr\u00e9gularit\u00e9 de la mise \u00e0 pied. Le salari\u00e9 peut alors vous<strong> r\u00e9clamer le paiement des salaires suspendus<\/strong> durant cette p\u00e9riode (voir Cass. Soc. 23-6-1999 n\u00b097-42.202 PB).<\/p>\n<p>Cependant, dans le cadre d&rsquo;une proc\u00e9dure de licenciement pour faute grave, le Conseil d&rsquo;\u00c9tat a admis que l&rsquo;irr\u00e9gularit\u00e9 de notification \u00e0 l&rsquo;inspecteur du travail n&rsquo;avait <strong>pas \u00ab\u00a0<em>d&rsquo;incidence sur la r\u00e9gularit\u00e9 de l\u2019autorisation administrative de licenciement prise par ce dernier<\/em><\/strong>\u00ab\u00a0.<\/p>\n<h2>Conclusion<\/h2>\n<p>La mise a pied conservatoire est une mesure suspensive, en vue d&rsquo;une sanction disciplinaire. Elle ne doit pas \u00eatre confondue avec la mise \u00e0 pied disciplinaire qui est, elle, une sanction \u00e0 part enti\u00e8re. M\u00eame si son instauration est simplifi\u00e9e, il n&rsquo;en reste pas moins que cette mesure doit \u00eatre justifi\u00e9e.
