﻿{"id":19293,"date":"2017-02-06T00:30:10","date_gmt":"2017-02-05T23:30:10","guid":{"rendered":"https:\/\/valoxy.org\/blog\/?p=19293"},"modified":"2024-09-26T17:01:49","modified_gmt":"2024-09-26T15:01:49","slug":"infraction-routiere-obligation-denonciation-employeur","status":"publish","type":"post","link":"https:\/\/valoxy.org\/blog\/infraction-routiere-obligation-denonciation-employeur\/","title":{"rendered":"Infraction routi\u00e8re : obligation de d\u00e9nonciation de l&#8217;employeur !"},"content":{"rendered":"<p>Depuis le <strong>01\/01\/2017<\/strong>, les soci\u00e9t\u00e9s doivent d\u00e9noncer les salari\u00e9s ayant commis une infraction routi\u00e8re en utilisant un v\u00e9hicule de soci\u00e9t\u00e9.<\/p>\n<p>Au-del\u00e0 des probl\u00e8mes \u00e9thiques que soul\u00e8ve\u00a0<strong>ce principe de d\u00e9lation&#8230; <\/strong>cette mesure pourrait compliquer les relations sociales entre l&#8217;employeur et ses salari\u00e9s.<\/p>\n<p>Petite revue de la mesure avec Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France.<\/p>\n<h2>La proc\u00e9dure de d\u00e9nonciation<\/h2>\n<p>Depuis le d\u00e9but d\u2019ann\u00e9e, un employeur doit, <strong>dans un d\u00e9lai de 45 jours<\/strong>, <strong>transmettre l\u2019identit\u00e9 et les coordonn\u00e9es du salari\u00e9 responsable<\/strong> d\u2019une infraction au code de la route alors qu\u2019il utilisait un v\u00e9hicule de la soci\u00e9t\u00e9.<\/p>\n<p><img decoding=\"async\" class=\" wp-image-18887 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/recherche.jpg\" alt=\"Infractions routi\u00e8res : obligation de d\u00e9nonciation de l'employeur !\" width=\"102\" height=\"84\" \/>En cas de cas de force majeure (vol, \u00e9change de plaque d\u2019immatriculation\u2026), <strong>l\u2019employeur devra fournir des justificatifs<\/strong> apportant la preuve qu\u2019aucun de ses salari\u00e9s ne conduisait le v\u00e9hicule lors de l\u2019infraction.<\/p>\n<p>La communication des informations se fera, soit via un formulaire en ligne disponible sur le site de l\u2019Agence Nationale des Traitements Automatis\u00e9s des Infractions, soit par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception, aupr\u00e8s des autorit\u00e9s comp\u00e9tentes.<\/p>\n<div class=\"encadre-style\">Si l\u2019employeur ne respecte pas cette obligation, il devra s\u2019acquitter d&rsquo;une amende <strong>de 750 \u20ac.<\/strong> (en plus de l\u2019amende due au titre de la contravention routi\u00e8re). La fausse d\u00e9claration sera susceptible de proc\u00e9dure p\u00e9nale.<\/div>\n<h2>Quelles cons\u00e9quences pour les entreprises\u00a0?<\/h2>\n<p><img decoding=\"async\" class=\" wp-image-18895 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/hesitation-3-2-1.jpg\" alt=\"Infractions routi\u00e8res : obligation de d\u00e9nonciation de l'employeur !\" width=\"128\" height=\"87\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/hesitation-3-2-1.jpg 750w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2017\/03\/hesitation-3-2-1-300x204.jpg 300w\" sizes=\"(max-width: 128px) 100vw, 128px\" \/>Le but de cette loi est de\u00a0<span class=\"s1\">sensibiliser les conducteurs \u00e0 une meilleure conduite, et, par voie de cons\u00e9quence,<\/span> de r\u00e9duire les infractions routi\u00e8res. Car les salari\u00e9s qui disposent d&rsquo;un v\u00e9hicule de soci\u00e9t\u00e9 avaient parfois un sentiment d\u2019impunit\u00e9. (du fait qu\u2019ils ne re\u00e7oivent pas toujours les \u00e9ventuelles contraventions).<\/p>\n<p>Cependant l\u2019application de cette loi est susceptible de poser certains probl\u00e8mes au sein des entreprises.<\/p>\n<p>Plusieurs salari\u00e9s, tout d&rsquo;abord, utilisent le v\u00e9hicule de soci\u00e9t\u00e9. Il peut donc \u00eatre malais\u00e9 pour l\u2019employeur de d\u00e9terminer le vrai responsable de l\u2019infraction. A savoir par exemple le cas d&rsquo;une entreprise qui, dans l&rsquo;obligation de d\u00e9noncer son commercial ou son chauffeur, serait amen\u00e9e \u00e0 lui faire perdre son permis de conduire suite \u00e0 de multiples d\u00e9nonciations d&rsquo;infraction. Dans ce cas, quel serait le devenir du salari\u00e9 dont le permis de conduire est absolument n\u00e9cessaire \u00e0 son emploi\u00a0 ? la question reste \u00e0 trancher&#8230;<\/p>\n<h2>En conclusion<\/h2>\n<p>Si l\u2019intention de la loi est louable, son application par les entreprises soul\u00e8ve de nombreuses difficult\u00e9s. Que ce soit en mati\u00e8re de temps, pour effectuer la d\u00e9nonciation, qu\u2019au niveau des conditions de travail et notamment du climat social. Il est donc important de bien sensibiliser les salari\u00e9s \u00e0 cette nouvelle obligation de l&#8217;employeur. (afin de ne pas les prendre au d\u00e9pourvu). Les entreprises qui disposent d&rsquo;une flotte importante de v\u00e9hicules notamment, devront \u00eatre particuli\u00e8rement vigilantes quant au message \u00e0 faire passer aupr\u00e8s de leurs conducteurs.<\/p>\n<p class=\"p1\"><div class=\"encadre-style\"><\/p>\n<p><strong>Rappel : <\/strong><b>Le paiement vaut avantage en nature<\/b><\/p>\n<p class=\"p1\">Lorsque l\u2019employeur prend en charge une amende pour un de ses salari\u00e9s, attention !
