La consultation des repr\u00e9sentants du personnel et l\u2019autorisation pr\u00e9alable du pr\u00e9fet sont aussi des d\u00e9marches obligatoires.<\/p>\n<p>Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France, revient sur ces \u00e9tapes.<\/p>\n<h2><b><a href=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/06\/croissance-externe-4.png\"><img fetchpriority=\"high\" decoding=\"async\" class=\" wp-image-3865 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/06\/croissance-externe-4-300x296.png\" alt=\"ch\u00f4mage partiel\" width=\"270\" height=\"266\" \/><\/a>Consultation des repr\u00e9sentants du personnel <\/b><\/h2>\n<p>Dans les entreprises de plus de 50 salari\u00e9s, <strong><span class=\"exergue\">l&#8217;employeur doit consulter les repr\u00e9sentants du personnel<\/span><\/strong> (comit\u00e9 d&rsquo;entreprise ou d\u00e9l\u00e9gu\u00e9s du personnel) avant la mise au ch\u00f4mage partiel. Et la consultation doit porter sur plusieurs points :<\/p>\n<ul>\n<li>les motifs \u00e9conomiques,<\/li>\n<li>les cat\u00e9gories professionnelles et les activit\u00e9s concern\u00e9es,<\/li>\n<li>le niveau et les modalit\u00e9s de mise en \u0153uvre des r\u00e9ductions d&rsquo;horaire,<\/li>\n<li>les actions de formation envisag\u00e9es.<\/li>\n<\/ul>\n<p>L&rsquo;entreprise doit, \u00e0 la suite de cette consultation, relever l\u2019avis pr\u00e9alable du comit\u00e9 d\u2019entreprise ou des repr\u00e9sentants du personnel. Si l\u2019entreprise ne dispose pas de repr\u00e9sentants du personnel, la direction doit alors informer l\u2019ensemble des salari\u00e9s sur les difficult\u00e9s de l\u2019entreprise et le projet de ch\u00f4mage partiel de tout ou partie du personnel.<\/p>\n<h2><b>Ch\u00f4mage partiel : autorisation pr\u00e9alable du pr\u00e9fet <\/b><\/h2>\n<p>Depuis le 22 novembre 2012,<strong><span class=\"exergue\"> l\u2019autorisation administrative pr\u00e9alable a \u00e9t\u00e9 r\u00e9tablie<\/span> <\/strong>pour obtenir l\u2019attribution de l&rsquo;allocation sp\u00e9cifique de ch\u00f4mage partiel aux entreprises.<\/p>\n<p>L\u2019employeur \u00e0 obligation d\u2019adresser \u00e0 la DIRECCTE dont d\u00e9pend son \u00e9tablissement une demande d\u2019autorisation pr\u00e9alable. Celle-ci lui permettra de mettre en place le ch\u00f4mage partiel dans l\u2019entreprise. Enfin, dans cette demande, l&#8217;employeur doit pr\u00e9ciser :<\/p>\n<ul>\n<li>les raisons de sa demande de ch\u00f4mage partiel,<\/li>\n<li>la dur\u00e9e et la p\u00e9riode pr\u00e9visible de sous-activit\u00e9 de l\u2019entreprise,<\/li>\n<li>le nombre de salari\u00e9s concern\u00e9s par la demande et leur dur\u00e9e de travail habituelle.<\/li>\n<\/ul>\n<p><strong><span class=\"exergue\">Elle doit \u00eatre accompagn\u00e9e de l&rsquo;avis pr\u00e9alable du comit\u00e9 d&rsquo;entreprise<\/span> <\/strong>ou de celui des d\u00e9l\u00e9gu\u00e9s du personnel (s\u2019il n\u2019y a pas de comit\u00e9 d\u2019entreprise).<\/p>\n<p>Le pr\u00e9fet dispose d\u2019un d\u00e9lai de 15 jours pour notifier sa d\u00e9cision. Au-del\u00e0 du d\u00e9lai, toute absence de r\u00e9ponse \u00e9quivaut \u00e0 un accord.<strong><span class=\"exergue\"> En cas de refus, la d\u00e9cision pr\u00e9fectorale doit \u00eatre motiv\u00e9e.<\/span><\/strong><\/p>\n<p>Une fois l&rsquo;autorisation administrative obtenue, l\u2019employeur peut r\u00e9duire ou suspendre son activit\u00e9 et mettre les salari\u00e9s en ch\u00f4mage technique. Cette autorisation permet alors \u00e0 l\u2019entreprise de se faire rembourser par l\u2019Etat des indemnit\u00e9s vers\u00e9es aux salari\u00e9s.<\/p>\n<p><b>\u00c0 savoir\u00a0:\u00a0<\/b>si l\u2019employeur a d\u00fb suspendre ou arr\u00eater l\u2019activit\u00e9 de l\u2019entreprise \u00e0 la suite\u00a0 d\u2019un sinistre ou d\u2019intemp\u00e9ries, il dispose de 30 jours pour adresser sa demande \u00e0 la pr\u00e9fecture.<\/p>\n<p>Cet article vous a plu ?
