salari\u00e9 inapte !<\/figcaption><\/figure>\n<h2><b>Les conditions d\u2019application du ch\u00f4mage partiel <\/b><\/h2>\n<p>Lorsqu\u2019une entreprise doit r\u00e9duire son activit\u00e9, elle peut <strong><span class=\"exergue\">recourir au ch\u00f4mage technique<\/span> <\/strong>si ses difficult\u00e9s sont dues \u00e0\u00a0:<\/p>\n<ul>\n<li>une conjoncture \u00e9conomique difficile,<\/li>\n<li>un sinistre, des intemp\u00e9ries, ou d\u2019autres circonstances exceptionnelles,\u00a0<span class=\"s2\">ce qui est le cas de la crise du coronavirus (Covid-19),<\/span><\/li>\n<li>des probl\u00e8mes d&rsquo;approvisionnement de mati\u00e8res premi\u00e8res ou d\u2019\u00e9nergie,<\/li>\n<li>la modernisation, la transformation ou la restructuration de l&rsquo;entreprise.<\/li>\n<\/ul>\n<p><b>\u00a0<\/b><\/p>\n<h2><b>Que se passe-t-il pour les salari\u00e9s concern\u00e9s par le ch\u00f4mage partiel ?<\/b><\/h2>\n<p>Les salari\u00e9s concern\u00e9s par une mesure de ch\u00f4mage partiel peuvent b\u00e9n\u00e9ficier <strong><span class=\"exergue\">d&rsquo;une allocation sp\u00e9cifique. <\/span><\/strong>Ils doivent \u00eatre pour cela confront\u00e9s \u00e0 l\u2019un des cas suivants:<\/p>\n<ul>\n<li>la fermeture temporaire d\u2019une partie ou de la totalit\u00e9 de leur entreprise,<\/li>\n<li>une baisse du temps de travail en dessous de la dur\u00e9e l\u00e9gale de travail,<\/li>\n<li>la r\u00e9duction collective du temps de travail, en dessous de la dur\u00e9e l\u00e9gale de travail, pour un groupe de salari\u00e9s d\u2019une m\u00eame activit\u00e9 dans l&rsquo;entreprise.<\/li>\n<\/ul>\n<p>Si les salari\u00e9s ne sont pas licenci\u00e9s, <strong><span class=\"exergue\">leur contrat de travail est suspendu, ce qui leur permet de suivre une formation en dehors du temps de travail.<\/span><\/strong><\/p>\n<p><b>Attention\u00a0:\u00a0<\/b>la dur\u00e9e de suspension d\u2019activit\u00e9 a des cons\u00e9quences sur le statut des salari\u00e9s\u00a0:<\/p>\n<ul>\n<li>on consid\u00e8re les salari\u00e9s comme \u00e9tant \u00e0 la recherche d&rsquo;un emploi si la suspension d&rsquo;activit\u00e9 continue au-del\u00e0 de 6 semaines,<\/li>\n<li>au-del\u00e0 de 3 mois, le pr\u00e9fet d\u00e9cide, pour une dur\u00e9e limit\u00e9e, si les salari\u00e9s peuvent encore \u00eatre consid\u00e9r\u00e9s comme \u00e9tant \u00e0 la recherche d&rsquo;un emploi.<\/li>\n<\/ul>\n<h3><b>Salari\u00e9s exclus <\/b><\/h3>\n<p><strong>Les salari\u00e9s ne b\u00e9n\u00e9ficient pas de l\u2019allocation de ch\u00f4mage partiel<\/strong>\u00a0dans les cas suivants\u00a0:<\/p>\n<ul>\n<li>lorsque le ch\u00f4mage est la cons\u00e9quence d\u2019un conflit collectif de travail,<\/li>\n<li>lorsqu\u2019ils sont en cours de licenciement \u00e9conomique ou de rupture conventionnelle,<\/li>\n<li>lorsque le temps de travail se d\u00e9termine par forfait annuel (sauf en cas de fermeture totale de leur \u00e9tablissement),<\/li>\n<li>lorsque la suspension d&rsquo;activit\u00e9 d\u00e9passe 6 semaines,<\/li>\n<li>s\u2019ils sont travailleurs saisonniers, sauf s&rsquo;ils d\u00e9montrent que leur situation de ch\u00f4mage est exceptionnelle \u00e0 l&rsquo;\u00e9poque de l&rsquo;ann\u00e9e \u00e0 laquelle elle se produit.<\/li>\n<\/ul>\n<p><b>\u00c0 savoir\u00a0:\u00a0<\/b>l&rsquo;incompatibilit\u00e9 entre activit\u00e9 partielle et licenciement \u00e9conomique ne vaut que pour les salari\u00e9s concern\u00e9s. <strong><span class=\"exergue\">L&#8217;employeur peut faire une demande d\u2019autorisation de ch\u00f4mage partiel pour certains salari\u00e9s, alors qu&rsquo;il proc\u00e8de aux licenciements d\u2019autres salari\u00e9s.<\/span><\/strong> Il faut pour cela qu&rsquo;il s&rsquo;agisse de personnes distinctes et que la proc\u00e9dure de licenciement ait \u00e9t\u00e9 engag\u00e9e avant la demande de ch\u00f4mage technique.<\/p>\n<p><b>\u00a0<\/b><\/p>\n<h3><b>Salari\u00e9s int\u00e9rimaires <\/b><\/h3>\n<p>Les salari\u00e9s d&rsquo;une entreprise de travail temporaire (en contrat d&rsquo;int\u00e9rim) peuvent \u00eatre admis au ch\u00f4mage partiel si l&rsquo;\u00e9tablissement, dans lequel ils ont \u00e9t\u00e9 d\u00e9tach\u00e9s, a plac\u00e9 ses propres salari\u00e9s en activit\u00e9 partielle.<\/p>\n<p>De m\u00eame, si les salari\u00e9s de l&rsquo;entreprise b\u00e9n\u00e9ficient d&rsquo;une convention d&rsquo;activit\u00e9 partielle de longue dur\u00e9e (APLD), les
