Et il faut veiller \u00e0 ce que le contrat mis en place soit conforme \u00e0 ce que pr\u00e9voit la Convention collective applicable.<\/p>\n<p style=\"text-align: justify;\">Valoxy,\u00a0<span class=\"s1\">cabinet d\u2019expertise comptable dans les Hauts-de-France,<\/span> explique dans cet article la mise en place et le suivi de la compl\u00e9mentaire sant\u00e9. Le respect de ce formalisme peut vous \u00e9viter un redressement en cas de contr\u00f4le URSSAF.<\/p>\n<h2 style=\"text-align: justify;\">La d\u00e9cision unilat\u00e9rale<\/h2>\n<p style=\"text-align: justify;\">Tout d\u2019abord, il est n\u00e9cessaire de mettre en place une <strong>d\u00e9cision unilat\u00e9rale.<\/strong> (qui sera \u00e0 transmettre au contr\u00f4leur <a href=\"https:\/\/valoxy.org\/blog\/controle-urssaf-05092014avallau1\/\" target=\"_blank\" rel=\"noopener noreferrer\">URSSAF<\/a>). Elle comportera notamment le coll\u00e8ge assur\u00e9, les cas de dispense, le montant de la cotisation et le pourcentage de prise en charge de l\u2019entreprise. Elle l&rsquo;accompagnera d&rsquo;un\u00a0 <strong>coupon-r\u00e9ponse<\/strong> afin de d\u00e9terminer s&rsquo;ils acceptent ou refusent la compl\u00e9mentaire sant\u00e9. (en cas de refus, le salari\u00e9 doit indiquer dans quel cas de dispense il se situe).<\/p>\n<p style=\"text-align: justify;\"><strong>L\u2019ensemble de ces documents sont \u00e0 conserver pr\u00e9cieusement.<\/strong><\/p>\n<h2 style=\"text-align: justify;\"><strong>Les cas de dispense<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Tous les cas de dispense pr\u00e9vus dans la d\u00e9cision unilat\u00e9rale ou dans la convention collective n\u00e9cessitent une attention particuli\u00e8re, et notamment<\/strong>\u00a0:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Dispense pour les <strong>salari\u00e9s b\u00e9n\u00e9ficiaires de la CMU ou de l\u2019ACS<\/strong>\u00a0: vous devez veiller \u00e0 recevoir chaque ann\u00e9e le justificatif de droit.<\/li>\n<li>Dispense pour les<strong> salari\u00e9s qui b\u00e9n\u00e9ficient d\u00e9j\u00e0, au moment de la d\u00e9cision unilat\u00e9rale, d\u2019un contrat frais de sant\u00e9 individuel\u00a0<\/strong>: cette dispense s\u2019applique jusqu\u2019\u00e0 la date d\u2019\u00e9ch\u00e9ance du contrat, sous pr\u00e9sentation d\u2019un justificatif. D\u00e8s que le contrat cesse, il faut affilier le salari\u00e9 \u00e0 la compl\u00e9mentaire sant\u00e9 d\u2019entreprise de mani\u00e8re obligatoire et d\u00e8s le mois suivant.<\/li>\n<li>Dispense des <strong>salari\u00e9s d\u00e9j\u00e0 couverts au titre d\u2019ayant droit obligatoire. <\/strong>Il faut demander au salari\u00e9 concern\u00e9 une attestation de sa compl\u00e9mentaire sant\u00e9 afin de valider le caract\u00e8re obligatoire de son affiliation.<\/li>\n<\/ul>\n<h4 style=\"text-align: justify;\"><strong>Attention !<\/strong><\/h4>\n<p style=\"text-align: justify;\"><div class=\"encadre-style\">Si l&rsquo;on ne suit pas ces pr\u00e9cautions, le caract\u00e8re collectif de la compl\u00e9mentaire sant\u00e9 d\u2019entreprise peut \u00eatre remis en question. <strong>L&rsquo;entreprise risque alors un redressement sur l\u2019ensemble de ses cotisations de compl\u00e9mentaire sant\u00e9<\/strong>. C\u2019est pourquoi nous vous conseillons la vigilance tant\u00a0 sur la mise en place que sur le suivi du contrat de votre compl\u00e9mentaire sant\u00e9.<\/div><\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\"wp-image-11778 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/bonhomme-loupe-1.png\" alt=\"mutuelle obligatoire cas de dispense\" width=\"98\" height=\"104\" \/>Ainsi, \u00e0 chaque embauche, veillez \u00e0 ce que :<\/p>\n<ul>\n<li style=\"text-align: justify;\">la d\u00e9cision unilat\u00e9rale soit remise au salari\u00e9 entrant,<\/li>\n<li style=\"text-align: justify;\">\u00e0 ce qu\u2019il signe la liste d\u2019\u00e9margement,<\/li>\n<li style=\"text-align: justify;\">et \u00e0 ce qu\u2019il remette le coupon-r\u00e9ponse compl\u00e9t\u00e9 accompagn\u00e9 de l\u2019\u00e9ventuel justificatif.<\/li>\n<\/ul>\n<p>Mettez en place des rappels pour les salari\u00e9s qui ont une dispense temporaire.
