Elle doit \u00eatre mentionn\u00e9e sur les fiches de paie.<\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\"alignleft wp-image-10574\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1-300x300.jpg\" alt=\"Conservation de la documentation sociale en entreprise\" width=\"99\" height=\"99\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1-300x300.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1-150x150.jpg 150w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1-45x45.jpg 45w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/05\/derogation-au-temps-partiel-a-24h-1.jpg 340w\" sizes=\"(max-width: 99px) 100vw, 99px\" \/>Une version \u00e0 jour de la convention collective doit \u00eatre \u00e0 disposition des salari\u00e9s et doit pouvoir \u00eatre consult\u00e9e dans un endroit neutre.<\/p>\n<p style=\"text-align: justify;\">Un avis doit \u00eatre affich\u00e9 sur le lieu de travail, indiquant l&rsquo;existence de la convention et pr\u00e9cisant o\u00f9 et dans quelles conditions elle peut \u00eatre consult\u00e9e.<\/p>\n<h3 style=\"text-align: justify;\">O\u00f9 peut-on se procurer la Convention Collective\u00a0?<\/h3>\n<p class=\"p1\"><span class=\"s1\">Il est possible de se procurer la convention collective nationale\u00a0:<\/span><\/p>\n<ul class=\"ul1\">\n<li class=\"li2\"><i><\/i><span class=\"s4\"><i>Soit en la t\u00e9l\u00e9chargeant sur L\u00e9gifrance (<\/i><a href=\"http:\/\/www.legifrance.gouv.fr\"><span class=\"s5\"><i>www.legifrance.gouv.fr<\/i><\/span><\/a><i>)<\/i><\/span><\/li>\n<li class=\"li2\"><i><\/i><span class=\"s4\"><i>Soit en achetant une version papier (<\/i><a href=\"http:\/\/www.ladocumentationfrancaise.fr\"><span class=\"s5\"><i>www.ladocumentationfrancaise.fr<\/i><\/span><\/a><i>)<\/i><\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\">Le Registre Unique du Personnel<\/h2>\n<p style=\"text-align: justify;\">Les employeurs, quel que soit l&rsquo;effectif de leur entreprise, doivent tenir \u00e0 jour un registre du personnel sur lequel doivent figurer, dans l&rsquo;ordre des embauches, les noms et pr\u00e9noms de tous les salari\u00e9s occup\u00e9s par l&rsquo;\u00e9tablissement, y compris les travailleurs \u00e0 domicile et les stagiaires.<\/p>\n<p style=\"text-align: justify;\">Les indications relatives \u00e0 l&#8217;embauche doivent \u00eatre port\u00e9es sur ce registre au moment de l&#8217;embauche et de fa\u00e7on ind\u00e9l\u00e9bile. Les mentions relatives aux \u00e9v\u00e9nements post\u00e9rieurs s&rsquo;ajoutent lorsque ces derniers surviennent.<\/p>\n<p style=\"text-align: justify;\">Ce registre contient un certain nombre de mentions obligatoires qui doivent \u00eatre conserv\u00e9es pendant 5 ans \u00e0 compter de la date du d\u00e9part des salari\u00e9s. Il doit \u00eatre tenu au si\u00e8ge de chaque \u00e9tablissement o\u00f9 se trouve l&#8217;employeur ou son d\u00e9l\u00e9gataire.<\/p>\n<h3 style=\"text-align: justify;\">O\u00f9 peut-on acheter un registre du personnel\u00a0?<\/h3>\n<p style=\"text-align: justify;\">Il est possible de se procurer ces registres aupr\u00e8s de libraires tels que le Furet du Nord, Cultura ou la Fnac, par exemple.<\/p>\n<h2 style=\"text-align: justify;\">Obligations et d\u00e9clarations li\u00e9es \u00e0 l&#8217;embauche<\/h2>\n<p style=\"text-align: justify;\">A chaque embauche, l&#8217;employeur a aussi l\u2019obligation de\u00a0:<\/p>\n<ul style=\"text-align: justify;\">\n<li>D\u00e9clarer le nouveau salari\u00e9 aupr\u00e8s de l\u2019<strong><a href=\"https:\/\/valoxy.org\/blog\/urssaf-03092014avallau\/\" target=\"_blank\" rel=\"noopener noreferrer\">URSSAF<\/a> <\/strong>au moyen <span class=\"s2\">d\u2019une\u00a0<a href=\"https:\/\/valoxy.org\/blog\/dpae-declaration-prealable-embauche\/\"><span class=\"s3\">D\u00e9claration Pr\u00e9alable \u00e0 l\u2019Embauche (DPAE)<\/span><\/a> sur <a href=\"https:\/\/www.due.urssaf.fr\/declarant\/index.jsf\"><span class=\"s3\">le site Internet de l&rsquo;URSSAF<\/span><\/a><\/span> d\u00e9di\u00e9 \u00e0 cet effet.<\/li>\n<li>\u00c9tablir un contrat de travail, dont l&rsquo;entreprise gardera un exemplaire;<\/li>\n<li>Proc\u00e9der \u00e0 la visite m\u00e9dicale d&#8217;embauche du salari\u00e9, via la m\u00e9decine du travail \u00e0 laquelle l&rsquo;entreprise adh\u00e8re, puis aux visites m\u00e9dicales p\u00e9riodiques ;<\/li>\n<li>Inscrire les coordonn\u00e9es du salari\u00e9 dans le registre unique du personnel\u00a0;<\/li>\n<li>Inscrire le salari\u00e9 aupr\u00e8s des organismes sociaux (retraite, pr\u00e9voyance, mutuelle, \u2026)\u00a0;<\/li>\n<\/ul>\n<p>Par la suite, il\u00a0 faudra (gestion administrative, dossier, etc.)<\/p>\n<ul>\n<li>Garder un double des bulletins de paie remis aux salari\u00e9s<\/li>\n<li>Garder une copie des mises en Demeure et observations<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><em>\u00a0<\/em>L\u2019affichage obligatoire<\/h2>\n<p style=\"text-align: justify;\"><em>La loi impose \u00e0 toutes les entreprises d\u2019afficher certains documents ou informations sous peine de sanctions p\u00e9nales pouvant aller de 450\u20ac \u00e0 1500\u20ac d\u2019amende.<\/em><\/p>\n<ul style=\"text-align: justify;\">\n<li><em>Nom de l\u2019Inspecteur du Travail<\/em><\/li>\n<li><em>Nom du M\u00e9decin du travail<\/em><\/li>\n<li><em>L\u2019horaire collectif de l\u2019entreprise (et dans certains cas les d\u00e9rogations aux horaires)<br \/>\n<\/em><\/li>\n<li><em>Les num\u00e9ros de t\u00e9l\u00e9phone des Services d\u2019Urgence<\/em><\/li>\n<li><em>Les consignes d\u2019Incendie<\/em><\/li>\n<li><em>Noms des Repr\u00e9sentants du personnel<\/em><\/li>\n<li><em>La r\u00e9f\u00e9rence de la convention collective<\/em><\/li>\n<li><em>D&rsquo;autres accords collectifs (s&rsquo;il y en a)<\/em><\/li>\n<li><em>Les textes relatifs au harc\u00e8lement moral et sexuel<\/em><\/li>\n<li><em>Les textes relatifs \u00e0 l\u2019\u00e9galit\u00e9 Professionnelle entre les Femmes et les Hommes<\/em><\/li>\n<li><em>Les articles pour la lutte contre la discrimination \u00e0 l\u2019embauche<\/em><\/li>\n<li><em>L\u2019interdiction de fumer dans les locaux de l\u2019entreprise<\/em><\/li>\n<li><em>Le Document Unique d\u2019\u00e9valuation des risques professionnels (DUERP)<\/em><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\">Le Document Unique d\u2019\u00e9valuation des Risques professionnels<\/h2>\n<p style=\"text-align: justify;\"><em><img decoding=\"async\" class=\"alignleft wp-image-10338\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/duerp5-1.png\" alt=\"Conservation de la documentation sociale en entreprise\" width=\"89\" height=\"84\" \/>L\u2019article L4121-1 <\/em>du Code du Travail oblige l&#8217;employeur \u00e0 transcrire et mettre \u00e0 jour dans <strong><a href=\"https:\/\/valoxy.org\/blog\/document-unique-devaluation-risques-professionnels-duerp\/\" target=\"_blank\" rel=\"noopener noreferrer\">un document unique les r\u00e9sultats de l&rsquo;\u00e9valuation des risques<\/a><\/strong> comportant \u00ab\u00a0un inventaire des risques identifi\u00e9s dans chaque unit\u00e9 de travail de l&rsquo;entreprise ou de l&rsquo;\u00e9tablissement\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\"><em>En cas d\u2019absence du document unique des risques, la sanction p\u00e9nale peut aller de 1500\u20ac, \u00e0 9000\u20ac en cas de r\u00e9cidive.<\/em><\/p>\n<p style=\"text-align: justify;\"><em><div class=\"encadre-style\">Selon l\u2019effectif, d\u2019autres documents viennent s\u2019ajouter \u00e0 cette obligation d&rsquo;affichage :<\/em><\/p>\n<ul style=\"text-align: justify;\">\n<li><em>Pour les entreprises d\u2019au moins 11 salari\u00e9s, la proc\u00e9dure d\u2019organisation de l\u2019\u00e9lection des d\u00e9l\u00e9gu\u00e9s du personnel;<\/em><\/li>\n<li><em>A partir de 20 salari\u00e9s, le r\u00e8glement int\u00e9rieur;<\/em><\/li>\n<li><em>A partir de 50 salari\u00e9s, les noms des membres du CHSCT et la localisation de leur poste, le compte rendu des r\u00e9unions du CHSCT, ainsi qu\u2019une information sur l\u2019existence d\u2019un accord de participation.<\/div><\/em><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><em>Lors d\u2019un contr\u00f4le URSSAF ou d\u2019une visite de l\u2019inspection du travail, le contr\u00f4leur ou
