C\u2019est l\u2019occasion de rappeler les r\u00e8gles applicables aux cong\u00e9s pay\u00e9s. L\u2019article L3141-1 du Code du travail stipule que tout salari\u00e9 a droit \u00e0 un cong\u00e9 pay\u00e9 \u00e0 la charge de l\u2019employeur. Comment cela fonctionne-t-il ?<\/p>\n<p>Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France, explique dans cet article le fonctionnement des cong\u00e9s pay\u00e9s.<\/p>\n<h2>Acquisition de tous les cong\u00e9s pay\u00e9s<\/h2>\n<p>L&rsquo;acquisition des cong\u00e9s pay\u00e9s n&rsquo;est li\u00e9e \u00e0 aucune dur\u00e9e minimale de travail. Tous les salari\u00e9s ont droit aux cong\u00e9s pay\u00e9s, quels que soient leur type de contrat, la dur\u00e9e de travail ou leur anciennet\u00e9. De m\u00eame, qu&rsquo;il s&rsquo;agisse de travail effectu\u00e9 \u00e0 temps plein ou \u00e0 temps partiel. Voir aussi notre article <a href=\"https:\/\/valoxy.org\/blog\/conges-payes-et-maladie\/\">Cong\u00e9s pay\u00e9s et maladie : que dit la loi du 24 Avril 2024 ?<\/a><\/p>\n<p>Les droits \u00e0 cong\u00e9s s\u2019appr\u00e9cient sur une p\u00e9riode de r\u00e9f\u00e9rence. Cette p\u00e9riode est comprise entre le 1er Juin de l\u2019ann\u00e9e pr\u00e9c\u00e9dente et le 31 Mai de l\u2019ann\u00e9e en cours. Ainsi, les cong\u00e9s acquis entre le 1er juin N et le 31 mai N+1 doivent \u00eatre \u00e9puis\u00e9s au 30 avril N+2.<\/p>\n<p>Les cong\u00e9s pay\u00e9s se calculent<\/p>\n<ul>\n<li>soit en jours ouvrables (du lundi au samedi), c&rsquo;est \u00e0 dire 2,5 jours par mois<\/li>\n<li>soit en jours ouvr\u00e9s (du lundi au vendredi), c&rsquo;est \u00e0 dire 2,08 jours par mois.<\/li>\n<\/ul>\n<p>Dans les 2 cas, le salari\u00e9 acquiert 5 semaines de cong\u00e9s par an.<\/p>\n<p>La prise du cong\u00e9 principal s&rsquo;effectue entre le 1er Mai et le 31 Octobre de chaque ann\u00e9e. Durant cette p\u00e9riode, le salari\u00e9 doit obligatoirement prendre au minimum 2 semaines cons\u00e9cutives. Enfin, la dur\u00e9e du cong\u00e9 principal ne peut exc\u00e9der 4 semaines.<\/p>\n<p>La p\u00e9riode ordinaire des vacances doit \u00eatre port\u00e9e \u00e0 la connaissance des salari\u00e9s au moins 2 mois avant son ouverture. Si cette information n&rsquo;est pas diffus\u00e9e, l&#8217;employeur devra indemniser le salari\u00e9 qui n\u2019aurait pas pris ses cong\u00e9s.<\/p>\n<h2>L\u2019ordre des d\u00e9parts<\/h2>\n<p><img decoding=\"async\" class=\" wp-image-13902 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2016\/06\/0.jpg\" alt=\"les cong\u00e9s pay\u00e9s\" width=\"301\" height=\"138\" \/>L\u2019ordre des d\u00e9parts est communiqu\u00e9 \u00e0 chaque salari\u00e9 un mois avant son d\u00e9part et affich\u00e9 dans les locaux accessibles\u00a0\u00e0 tous. Il doit tenir compte de la situation de famille des salari\u00e9s et de leur \u00e9ventuelle activit\u00e9 chez un autre employeur.<br \/>\nL\u2019employeur et le salari\u00e9 doivent respecter l\u2019ordre et les dates de cong\u00e9s fix\u00e9s par l\u2019employeur. Leur modification ne peut pas intervenir dans le mois pr\u00e9c\u00e9dant le d\u00e9part, sauf circonstances exceptionnelles.<\/p>\n<p><strong>Un salari\u00e9 ne peut imposer une date ou une dur\u00e9e de cong\u00e9 sans consulter l\u2019employeur.<\/strong><\/p>\n<h2>La prise des cong\u00e9s<\/h2>\n<p>Le nombre de jours de cong\u00e9s se d\u00e9compte \u00e0 partir du 1er jour o\u00f9 le salari\u00e9 aurait d\u00fb venir travailler, jusqu\u2019\u00e0 la veille de sa reprise.<\/p>\n<ul>\n<li>Pour les entreprises qui comptent en jours ouvrables, une semaine de cong\u00e9s repr\u00e9sente 6 jours.<\/li>\n<li>Pour celles qui comptent en jours ouvr\u00e9s, une semaine de cong\u00e9s repr\u00e9sente 5 jours.<\/li>\n<\/ul>\n<p><strong>Attention, pour les entreprises qui comptent en jours ouvrables, la r\u00e8gle des 5 samedis n\u2019existe pas.<\/strong><\/p>\n<p>Le droit \u00e0 cong\u00e9s doit s\u2019exercer chaque ann\u00e9e. En principe, ni l\u2019employeur ni le salari\u00e9 ne peuvent exiger le report des cong\u00e9s sur l\u2019ann\u00e9e suivante.<\/p>\n<p>Le droit doit s\u2019exercer en nature. Le versement d\u2019une indemnit\u00e9 compensatrice ne peut en effet compenser les jours non pris, m\u00eame si l\u2019employeur et le salari\u00e9 en sont d\u2019accord.<\/p>\n<h2>La fermeture de l\u2019entreprise<\/h2>\n<p><img decoding=\"async\" class=\" wp-image-11803 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/choisir-gimp-70-1-300x289.jpg\" alt=\"cong\u00e9s pay\u00e9s\" width=\"138\" height=\"133\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/choisir-gimp-70-1-300x289.jpg 300w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/choisir-gimp-70-1.jpg 373w\" sizes=\"(max-width: 138px) 100vw, 138px\" \/>Il est tout \u00e0 fait possible de d\u00e9cider de fermer temporairement l\u2019entreprise en \u00e9t\u00e9 et d\u2019imposer aux salari\u00e9s de prendre leurs cong\u00e9s \u00e0 cette date. Il est n\u00e9cessaire pour cela de s\u2019y prendre suffisamment t\u00f4t et d\u2019accomplir certaines d\u00e9marches.<\/p>\n<p>De ce fait, un salari\u00e9 qui n\u2019a pas acquis assez de cong\u00e9s sera contraint de poser un cong\u00e9 sans solde.<\/p>\n<p>Cependant, il est toutefois int\u00e9ressant de l\u2019informer qu\u2019il peut pr\u00e9tendre \u00e0 une \u00ab\u00a0aide financi\u00e8re pour cong\u00e9s non pay\u00e9s\u00a0\u00bb, vers\u00e9e par P\u00f4le emploi. Cette aide est ouverte au salari\u00e9 qui, avant de reprendre un nouvel emploi, pouvait pr\u00e9tendre \u00e0 l\u2019aide au retour \u00e0 l\u2019emploi (ARE).<\/p>\n<h2>L\u2019incidence en cas d\u2019absence<\/h2>\n<p>En cas d\u2019absence maladie ou d\u2019accident de travail avant la prise de ses cong\u00e9s, le salari\u00e9 conserve ses droits et peut demander \u00e0 en b\u00e9n\u00e9ficier ult\u00e9rieurement.<\/p>\n<p>En revanche, en cas d\u2019absence pendant ses cong\u00e9s, le salari\u00e9 ne peut pr\u00e9tendre \u00e0 un report ou une prolongation de ses cong\u00e9s en fonction de la dur\u00e9e de l\u2019absence.<\/p>\n<h2>L\u2019indemnisation des cong\u00e9s pay\u00e9s<\/h2>\n<p style=\"text-align: justify;\">Le Code du Travail pr\u00e9voit 2 m\u00e9thodes de calcul. Il peut s&rsquo;agir soit du maintien de salaire, soit du 10\u00e8me de la r\u00e9mun\u00e9ration totale de la p\u00e9riode de r\u00e9f\u00e9rence.
