(pour rappel, il est toujours possible d\u2019aller plus loin que le droit du travail, celui-ci ne donnant que les r\u00e8gles minimum). Cependant <strong>ces pratiques, souvent tacites, peuvent \u00eatre consid\u00e9r\u00e9es comme des usages. Elles impliquent le respect de certaines r\u00e8gles, notamment lorsque l\u2019employeur veut les d\u00e9noncer.<\/strong> Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France, revient dans cet article sur la notion \u00ab\u00a0d&rsquo;usage\u00a0\u00bb.<\/p>\n<h2><span style=\"color: #fb4c35;\">D\u00e9finition de l&rsquo;usage<\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>Un usage, c\u2019est un avantage instaur\u00e9 volontairement dans l\u2019entreprise par l\u2019employeur.<\/strong> Ni le code du travail, ni\u00a0 une convention collective ne l&rsquo;impose.<\/p>\n<p style=\"text-align: justify;\"><div class=\"encadre-style\"> Il peut s\u2019agir par exemple d\u2019une prime ou de cong\u00e9s compl\u00e9mentaires <\/div><\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\"alignright wp-image-11798\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/choisir2-gimp-70-1.jpg\" alt=\"qu'est-ce qu'un usage en etntreprise\" width=\"132\" height=\"164\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/choisir2-gimp-70-1.jpg 289w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/choisir2-gimp-70-1-242x300.jpg 242w\" sizes=\"(max-width: 132px) 100vw, 132px\" \/>Pour \u00eatre qualifi\u00e9 d\u2019usage, l\u2019avantage doit pr\u00e9senter trois caract\u00e9ristiques. Il doit \u00eatre :<\/p>\n<ul>\n<li style=\"text-align: justify;\">g\u00e9n\u00e9ral, c\u2019est \u00e0 dire<strong> concerner l\u2019ensemble des salari\u00e9s de l\u2019entreprise ou une cat\u00e9gorie \u00ab d\u00e9finie<\/strong> \u00bb de personnel (par exemple, les cadres).<\/li>\n<li style=\"text-align: justify;\">r\u00e9p\u00e9t\u00e9, c&rsquo;est \u00e0 dire qu&rsquo;il<strong>\u00a0doit avoir lieu r\u00e9guli\u00e8rement<\/strong> (tous les ans par exemple).<\/li>\n<li style=\"text-align: justify;\">fixe, c&rsquo;est \u00e0 dire <strong>qu&rsquo;il doit reposer sur un mode de calcul pr\u00e9\u00e9tabli, ou fixe<\/strong> (une prime de 250 \u20ac pour No\u00ebl par exemple).<\/li>\n<\/ul>\n<h2><span style=\"color: #fb4c35;\">Comment d\u00e9noncer un usage ?<\/span><\/h2>\n<p style=\"text-align: justify;\">Un employeur peut tr\u00e8s bien, en p\u00e9riode d\u2019expansion de son activit\u00e9, r\u00e9compenser les salari\u00e9s par l\u2019octroi de primes. Cependant, si ces primes correspondent \u00e0 la d\u00e9finition de l\u2019usage, leur d\u00e9nonciation doit respecter une proc\u00e9dure sous peine de nullit\u00e9.<\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\"alignright wp-image-11742\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/liste2-gimp-70-1.jpg\" alt=\"Comment d\u00e9noncer un usage ?\" width=\"147\" height=\"158\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/liste2-gimp-70-1.jpg 335w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/liste2-gimp-70-1-280x300.jpg 280w\" sizes=\"(max-width: 147px) 100vw, 147px\" \/>Pour d\u00e9noncer un usage, l\u2019employeur doit :<\/p>\n<ul>\n<li style=\"text-align: justify;\"><strong>Informer le Comit\u00e9 d\u2019Entreprise<\/strong> ou, en l\u2019absence de celui-ci, les D\u00e9l\u00e9gu\u00e9s du Personnel.<\/li>\n<li style=\"text-align: justify;\"><strong>Informer individuellement l\u2019ensemble des salari\u00e9s concern\u00e9s.<\/strong> Cette information peut se faire par lettre simple ou par lettre recommand\u00e9e.<\/li>\n<li style=\"text-align: justify;\"><strong>Respecter un d\u00e9lai de pr\u00e9venance suffisant<\/strong>.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Si l&rsquo;entreprise ne respecte pas ces r\u00e8gles, les salari\u00e9s peuvent demander le maintien de l\u2019usage et \u00e9ventuellement entamer une action aux Prud\u2019hommes.<\/p>\n<p style=\"text-align: justify;\"><div class=\"encadre-style\"> <strong>La notion de \u00ab d\u00e9lai suffisant \u00bb est judiciairement assez floue puisqu\u2019elle n\u2019est pas d\u00e9finie avec pr\u00e9cision.<\/strong> Elle doit permettre l\u2019existence de n\u00e9gociation entre l\u2019employeur et les repr\u00e9sentants du personnel. Le d\u00e9lai est donc jug\u00e9 suffisamment long si des n\u00e9gociations effectives ont pu avoir lieu. <\/div><\/p>\n<h2><span style=\"color: #fb4c35;\">Quelques particularit\u00e9s juridiques<\/span><\/h2>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\"alignright wp-image-11744 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/louope-engrenage-gimp-70-1.jpg\" alt=\"particularit\u00e9s juridiques de l\u2019usage\" width=\"187\" height=\"178\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/louope-engrenage-gimp-70-1.jpg 376w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/louope-engrenage-gimp-70-1-300x286.jpg 300w\" sizes=\"(max-width: 187px) 100vw, 187px\" \/>Si l\u2019entreprise ne poss\u00e8de pas de repr\u00e9sentant du personnel (li\u00e9 \u00e0 l\u2019existence d\u2019une carence lors des \u00e9lections des D\u00e9l\u00e9gu\u00e9s du Personnel ou des membres du Comit\u00e9 d\u2019entreprise, ou parce que l\u2019entreprise ne remplit pas les conditions de taille rendant obligatoire les \u00e9lections), alors <strong>elle doit uniquement informer les salari\u00e9s concern\u00e9s individuellement.<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>En l\u2019absence de repr\u00e9sentant du personnel, l\u2019employeur doit quand m\u00eame respecter un d\u00e9lai suffisant de n\u00e9gociation<\/strong> m\u00eame si l\u2019ensemble des salari\u00e9s a accept\u00e9 la d\u00e9nonciation de l\u2019usage.<\/p>\n<p style=\"text-align: justify;\">Si l\u2019usage a fait l\u2019objet d\u2019une contractualisation, c\u2019est-\u00e0-dire d\u2019un contrat \u00e9crit entre les salari\u00e9s et l\u2019employeur, alors sa d\u00e9nonciation passe par la mise en place d\u2019un avenant au contrat qui doit \u00eatre accept\u00e9 par l\u2019ensemble des salari\u00e9s.<\/p>\n<p style=\"text-align: justify;\">L\u2019employeur doit donc veiller \u00e0 \u00eatre attentif \u00e0 l\u2019existence des usages dans son entreprise.
