Afin de lutter contre la perte de revenus que peut entra\u00eener l\u2019\u00e9puisement obligatoire d\u2019anciens droits \u00e0 allocation <a href=\"https:\/\/valoxy.org\/blog\/indemnisation-chomage-partiel-ou-chomage-technique-pour-le-salarie\/\">ch\u00f4mage<\/a> (ARE) alors que vous avez retravaill\u00e9 et acquis de nouveaux droits plus \u00e9lev\u00e9s, P\u00f4le emploi propose d\u00e9sormais la possibilit\u00e9 aux personnes indemnis\u00e9es d\u2019abandonner leurs anciens droits afin de b\u00e9n\u00e9ficier directement des nouveaux, et ce en exer\u00e7ant un droit d&rsquo;option.<\/p>\n<p style=\"text-align: justify;\">Valoxy, cabinet d&rsquo;expertise comptable dans les Hauts de France, fait le point sur ce droit d\u2019option et sur ses conditions d\u2019acc\u00e8s.<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\"><strong>En quoi consiste le droit d\u2019option accord\u00e9 par P\u00f4le emploi ?<\/strong><\/span><\/h2>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/05\/info3.png\"><img decoding=\"async\" class=\" wp-image-3246 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/05\/info3.png\" alt=\"cr\u00e9ation d'entreprise\" width=\"63\" height=\"61\" \/><\/a>Habituellement, lorsque vous avez connu deux p\u00e9riodes d\u2019activit\u00e9<\/strong> pour lesquelles vous avez acquis des droits \u00e0 allocations ch\u00f4mage, <strong>il faut d\u2019abord \u00e9puiser les droits acquis lors de la premi\u00e8re p\u00e9riode avant de toucher ceux acquis lors de la seconde.<\/strong><\/p>\n<p style=\"text-align: justify;\">Ce syst\u00e8me est assez <strong>avantageux lorsque vous retravaillez peu de temps ou pour une r\u00e9mun\u00e9ration moindre.<\/strong> En effet, ce syst\u00e8me vous permettra de <strong>conserver le reliquat non vers\u00e9 et de l&rsquo;\u00e9puiser avant de toucher aux droits n\u00e9s de la nouvelle activit\u00e9.<\/strong><\/p>\n<p style=\"text-align: justify;\">En revanche, ce syst\u00e8me pr\u00e9sente un<strong> inconv\u00e9nient lorsque le salaire de la seconde p\u00e9riode est plus \u00e9lev\u00e9 et que\u00a0 l\u2019allocation ch\u00f4mage qui en d\u00e9coule l&rsquo;est aussi<\/strong>. Cette obligation d\u2019\u00e9puisement conna\u00eet dor\u00e9navant une exception.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/dessin-tirelire-gimp-70.jpg\"><img decoding=\"async\" class=\" wp-image-11762 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/dessin-tirelire-gimp-70-300x213.jpg\" alt=\"dessin tirelire gimp 70\" width=\"145\" height=\"103\" \/><\/a>En effet, depuis le 1<sup>er<\/sup> avril 2015, <strong>les personnes sans emploi indemnis\u00e9es par P\u00f4le Emploi b\u00e9n\u00e9ficient de ce que l\u2019on appelle un droit d\u2019option, qui consiste \u00e0 renoncer aux droits acquis lors de la premi\u00e8re activit\u00e9 pour toucher directement les droits acquis lors de la derni\u00e8re<\/strong>, mieux r\u00e9mun\u00e9r\u00e9e.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\"><div class=\"encadre-style\">A noter<\/span><\/strong>\u00a0: Les personnes qui ont d\u00fb \u00e9puiser d\u2019anciens droits entre le 1<sup>er<\/sup> octobre 2014 et le 1<sup>er<\/sup> avril 2015 ont la possibilit\u00e9 d\u2019exercer le droit d\u2019option.<\/div><\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\"><strong>Quelles sont les conditions \u00e0 remplir pour b\u00e9n\u00e9ficier du droit d\u2019option\u00a0?<\/strong><\/span><\/h2>\n<p style=\"text-align: justify;\">Pour pouvoir b\u00e9n\u00e9ficier de ce droit d\u2019option, <strong>la personne indemnis\u00e9e par P\u00f4le Emploi doit remplir les conditions suivantes\u00a0:<\/strong><\/p>\n<p style=\"text-align: justify;\"><div class=\"encadre-style\"><\/p>\n<ul style=\"text-align: justify;\">\n<li>Avoir un <strong>reliquat de droits \u00e0 allocations ch\u00f4mage ouverts mais non \u00e9puis\u00e9s<\/strong>;<\/li>\n<li>Avoir <strong>travaill\u00e9 assez pour acqu\u00e9rir de nouveaux droits<\/strong> (soit un minimum de 122 jours ou de 610 heures)\u00a0;<\/li>\n<li>B\u00e9n\u00e9ficier d\u2019une<strong> \u00ab\u00a0ancienne\u00a0\u00bb allocation ch\u00f4mage journali\u00e8re de 20 euros (ou moins)<\/strong> <span style=\"text-decoration: underline;\">OU<\/span>\u00a0d&rsquo;une\u00a0<strong>\u00ab\u00a0nouvelle\u00a0\u00bb allocation journali\u00e8re sup\u00e9rieure de 30%<\/strong> \u00e0 celle vers\u00e9e au titre des droits restants (reliquat).<\/div><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\"><strong>Comment exercer ce droit d\u2019option\u00a0?<\/strong><\/span><\/h2>\n<p style=\"text-align: justify;\">La demande est <strong>\u00e0 formuler par la personne indemnis\u00e9e elle m\u00eame.<\/strong><\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/07\/pole-emploi.png\"><img decoding=\"async\" class=\" wp-image-5634 alignleft\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2013\/07\/pole-emploi-300x240.png\" alt=\"Pole emploi et CSP\" width=\"136\" height=\"108\" \/><\/a>Il faut, dans un premier temps, adresser une <strong>r\u00e9clamation \u00e9crite<\/strong> \u00e0 votre bureau de P\u00f4le Emploi pour que ce dernier v\u00e9rifie votre \u00e9ligibilit\u00e9 \u00e0 l\u2019option. Si vous \u00eates \u00e9ligible,\u00a0P\u00f4le Emploi vous notifiera la dur\u00e9e et le montant de vos droits restants (reliquat) ainsi que ceux de vos nouveaux droits afin que vous puissiez juger de l\u2019opportunit\u00e9 d\u2019exercer votre droit d\u2019option.<\/p>\n<p style=\"text-align: justify;\">Vous disposez d\u2019un <strong>d\u00e9lai de r\u00e9flexion de 21 jours<\/strong> pour d\u00e9cider ou non de faire valoir votre droit d\u2019option. Ce d\u00e9lai court \u00e0 compter de la <strong>r\u00e9ception de la notification<\/strong> adress\u00e9e par Pole Emploi.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\"><div class=\"encadre-style\">Attention<\/span><\/strong>\u00a0: Si vous d\u00e9cidez d\u2019utiliser ce droit d\u2019option, <strong>votre reliquat de droits restants sera d\u00e9finitivement perdu.<\/div> <\/strong><\/p>\n<p style=\"text-align: justify;\">Cela signifie qu&rsquo;<strong>en optant pour un capital imm\u00e9diat plus \u00e9lev\u00e9, vous allez r\u00e9duire la dur\u00e9e de votre indemnisation. <\/strong>C&rsquo;est pour cela qu&rsquo;un d\u00e9lai de r\u00e9flexion est accord\u00e9, car\u00a0<strong>vous devez bien r\u00e9fl\u00e9chir et calculer l&rsquo;opportunit\u00e9 que cela peut repr\u00e9senter.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Les personnes indemnis\u00e9es par P\u00f4le emploi peuvent renoncer aux droits acquis\u00a0 d&rsquo;une premi\u00e8re p\u00e9riode d&rsquo;activit\u00e9 pour toucher directement les droits acquis lors de la derni\u00e8re, mieux r\u00e9mun\u00e9r\u00e9e.
