On dit qu\u2019elle <strong>est nominative<\/strong>. <strong>C\u2019est \u00e0 l\u2019employeur de r\u00e9aliser cette formalit\u00e9<\/strong> pour chacun de ses salari\u00e9s relevant du r\u00e9gime g\u00e9n\u00e9ral de la S\u00e9curit\u00e9 sociale, quelle que soit la dur\u00e9e du contrat de travail, la forme juridique de l\u2019entreprise, son secteur d\u2019activit\u00e9 ou son effectif.<\/p>\n<p style=\"text-align: justify;\">La DPAE\u00a0 ne concerne pas :<\/p>\n<ul>\n<li style=\"text-align: justify;\">les particuliers employeurs qui utilisent les Titres Emploi Service (TESE),<\/li>\n<li style=\"text-align: justify;\">les entreprises qui embauchent via un contrat d\u2019intermittence du spectacle<\/li>\n<li style=\"text-align: justify;\">ni celles qui sont \u00e9tablies hors de France et qui utilisent le Titre Firme Etrang\u00e8re (TFE).<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\">La DPAE, pour quoi faire ?<\/span><\/h2>\n<p style=\"text-align: justify;\">La D\u00e9claration Pr\u00e9alable \u00e0 l\u2019Embauche a vocation \u00e0 <strong>centraliser un ensemble de formalit\u00e9s<\/strong> en une seule et m\u00eame d\u00e9claration. La DPAE remplace\u00a0:<\/p>\n<ul style=\"text-align: justify;\">\n<li><strong>l\u2019immatriculation du salari\u00e9 au r\u00e9gime g\u00e9n\u00e9ral de la S\u00e9curit\u00e9 sociale<\/strong><\/li>\n<li><strong>l\u2019immatriculation du salari\u00e9 \u00e0 la Caisse Primaire d\u2019Assurance Maladie<\/strong><\/li>\n<li><strong>l\u2019affiliation du salari\u00e9 \u00e0 l\u2019assurance ch\u00f4mage<\/strong><\/li>\n<li><strong>l\u2019affiliation du salari\u00e9 \u00e0 la m\u00e9decine du travail<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Elle sert \u00e9galement de pr\u00e9 D\u00e9claration Annuelle des Donn\u00e9es Sociales (DADS).<\/p>\n<p style=\"text-align: justify;\">Lorsque l\u2019employeur r\u00e9alise sa premi\u00e8re embauche, la DPAE fait office d\u2019immatriculation de l\u2019employeur :<\/p>\n<ul style=\"text-align: justify;\">\n<li>au r\u00e9gime g\u00e9n\u00e9ral de la S\u00e9curit\u00e9 sociale,<\/li>\n<li>au r\u00e9gime d\u2019assurance ch\u00f4mage,<\/li>\n<li>et au service de sant\u00e9 au travail.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\">La DPAE, comment \u00e7a marche ?<\/span><\/h2>\n<p style=\"text-align: justify;\"><strong><img fetchpriority=\"high\" decoding=\"async\" class=\" wp-image-11744 alignright\" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/louope-engrenage-gimp-70-1.jpg\" alt=\"dpae\" width=\"257\" height=\"245\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/louope-engrenage-gimp-70-1.jpg 376w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/10\/louope-engrenage-gimp-70-1-300x286.jpg 300w\" sizes=\"(max-width: 257px) 100vw, 257px\" \/>La DPAE\u00a0 d\u00fbment compl\u00e9t\u00e9e est transmise \u00e0 l\u2019URSSAF dont rel\u00e8ve l\u2019\u00e9tablissement de l\u2019entreprise<\/strong> qui a embauch\u00e9 le salari\u00e9. C\u2019est effectivement l\u2019URSSAF qui se charge ensuite de transmettre l\u2019ensemble des informations n\u00e9cessaires aux diff\u00e9rents organismes concern\u00e9s, ainsi qu\u2019\u00e0 P\u00f4le emploi.<\/p>\n<p style=\"text-align: justify;\">L\u2019employeur peut remplir la DPAE\u00a0 en version papier au moyen du Cerfa\u00a010563*05 puis la transmettre par voie postale, au service \u00ab\u00a0D\u00e9claration d\u2019embauche\u00a0\u00bb de l\u2019URSSAF dont rel\u00e8ve le salari\u00e9, mais il pourra \u00e9galement <strong>remplir et transmettre cette formalit\u00e9 directement sur Internet via le site de l\u2019URSSAF.<\/strong> Dans ce dernier cas seulement, l\u2019URSSAF\u00a0 accusera r\u00e9ception du formulaire en ligne, dans un d\u00e9lai de 5 jours ouvrables.<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\">Quel d\u00e9lai pour la D\u00e9claration Pr\u00e9alable \u00e0 l&rsquo;Embauche ?<\/span><\/h2>\n<p style=\"text-align: justify;\"><strong>L\u2019employeur doit avoir transmis la DPAE\u00a0 relative au salari\u00e9 embauch\u00e9 au maximum 8 jours avant la date d\u2019embauche et la prise de poste effective.<\/strong>\u00a0 Le non-respect de ce d\u00e9lai est passible de sanctions pour l\u2019employeur, mais il risque aussi de p\u00e9naliser le salari\u00e9 dans la bonne ouverture et le bon suivi de ses droits sociaux.<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"color: #008000;\">Les sanctions en cas d\u2019oubli ou de retard<\/span><\/h2>\n<p style=\"text-align: justify;\"><strong><img decoding=\"async\" class=\"alignleft wp-image-10733 \" src=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1.png\" alt=\"DPAE\" width=\"118\" height=\"98\" srcset=\"https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1.png 640w, https:\/\/valoxy.org\/blog\/wp-content\/uploads\/2015\/04\/le-licenciement-pour-inaptitude-1-300x249.png 300w\" sizes=\"(max-width: 118px) 100vw, 118px\" \/>L\u2019employeur qui ne transmet pas sa DPAE encourt une r\u00e9gularisation <\/strong>des cotisations sociales non pay\u00e9es, <strong>major\u00e9e d\u2019une p\u00e9nalit\u00e9<\/strong> \u00e9gale \u00e0 300 fois le taux horaire du SMIC. Si le tribunal venait \u00e0 consid\u00e9rer l\u2019absence de d\u00e9claration comme du travail dissimul\u00e9, l\u2019entreprise encourrait jusqu\u2019\u00e0 225\u00a0000 euros d\u2019amende et un placement sous surveillance judiciaire (ou 3 ans de prison si l\u2019employeur est une personne physique).<\/p>\n<p style=\"text-align: justify;\"><div class=\"encadre-style\">La D\u00e9claration Pr\u00e9alable \u00e0 l\u2019Embauche est <strong>une formalit\u00e9 habituellement r\u00e9alis\u00e9e<\/strong> par l\u2019expert-comptable.
